Conan O'Brien, The Tonight ShowConan O'Brien is losing "The Tonight Show" but he'll be getting a $32.5 million consolation prize courtesy of NBC ... sources tell TMZ.

In return, we've learned Conan has agreed to sit on the bench until September. Translation -- he can't host another show until the fall.

In addition to the $32.5 mil, we've learned NBC is also paying severance to Conan's "Tonight Show" employees. In all, we're told NBC's payout is around $40 million.

But Conan probably won't see close to the $32.5 mil. Under the deal, any money Conan makes during the remaining contract period with NBC will offset the network's obligation. So, if Fox were to make a deal with Conan and pay him $25 mil during the NBC contract period, Conan would only score $7.5 mil from NBC.

One well-placed NBC source told us something surprising -- looks like NBC may keep its intellectual property rights. So Conan can't take his creations -- such as Triumph the Insult Comic Dog and the Masturbating Bear -- to his next gig.

We're told the Conan/NBC deal still isn't completely done, but it's very close.

Because in contract law, the wronged party has to try to mitigate damages. If Conan were to do as you suggest, NBC could ask a judge to void any further payments to Conan and they would win that motion.

Basically, NBC screwed the life out of Conan, paying him little to leave, keeping his Int Prop, keeping him off the air for a while and putting a muzzle on him about NBC comments.

I hope he'll take some of his 32 million and pay a year's wage to his staffers who took a chance on his ability to pull in viewers and moved across the country with him. He ought to help them while they search for work. He could pay them just off the interest. I hope he proves to be a true stand-up guy and does the right thing by those who've stood by him.

He can't HOST a show of his own until September. However that doesn't prevent him from appearing on all kinds of shows. I hope he does a bunch of guest appearances to raise his profile and to try new things so we're not depleted of Conan until The CoCo Christopher Hour starts in the fall.

Seriously? Conan should RUN to Fox and just delay any sort of payment from them until after his deal with NBC expires. Those idiots at NBC deserve to lose some money for putting Conan in this spot.

firstly who gives two squats about late night tv.its for weed heads
and loners .i used to watch the leno open,switch to letterman for the top 10,catch jimmy kimmel and then grab some coco and drift off.
who knew what he did that last half.he should hold out for bigger bucks .and not sit on any benches.
THEN do a show with fox just to crush jay ,and start 5 minutes before.jay is an ass.he shouldve left on a high note .he has the first dime he ever earned.do other things .carson just disappeared.
CONAN do something else .like simpsons.beg triumph to go with you .

This deal shows Conan had no legs to stand on. Lots of comprimise on his part.

I personally did not find his humor funny and I seriously doubt FOX will pick him up.

I wish him and his staff the best after this ordeal. Hopefully they are the wiser for contract negogiation in the future.

25. So let's see. NBC is paying out a total of $40 million. $32.5 million goes to O'Brien. Then $7.5 million is left for severance pay for 200 jobless employees.

$7.5 million/200 = $37,500 per employee.

You can bet that people like the producers, writers, band will get a lot more than $37,500 and the line people will get significantly less.

200 people out of work because Conan refused to start the show at 12:05. Nice.

I don't know about you but losing your job and still getting what amounts to about a year's salary doesn't sound to bad to me.

Plus, I think Conan has shown he's willing to take care of his staff. I think when he gets back on TV in the fall everyone that sticks with him will be rewarded in the end.

Now regarding NBC keeping Triumph...That's a great idea...for me to poop on.(:

Conan may find some other Network stupid enough to want him to do for them what he did for NBC (in other words ...last place in the ratings!) ...but, he'll always be known as the guy who lost the Tonight Show and got canned because nobody watched him. Quite an endorsement to carry with him from here.

What I find funny in this whole ordeal is... what happens once Jay Leno REALLY wants to retire? They're gonna get JIMMY FALLON to do the Tonight Show? LOL.

He should sign a deal with Fox where he gets Paid $1 a year for the first few years and then be over compensated whenever his deal with NBC runs out, make it so NBC has to pay him all that money to host a show on another channel.
