Smith has been released from jail. The 49ers expect Smith to play on Sunday.


San Francisco 49ers
linebacker Aldon Smith is on the defensive again -- legally ... he's been busted  for DUI and pot possession.

Smith was popped after he crashed his pickup truck around 7 AM.  He wasn't hurt ... but the breathalyzer almost was.

The 49ers say they're on top of it.  San Francisco plays the Colts on Sunday ... Smith's status for the game is in doubt.

The All Pro linebacker works as a receiver off the field -- receiver of  legal charges.

- Arrested in Miami last year for DUI -- later reduced to reckless driving. 
- Stabbed during a party at his house in June 2012.
- Named in a lawsuit by a man who claims he was shot at Smith's house during a party.

Smith is currently being held on $5,250 bail.

The NFL can only do so much.They actually have a driving service that is free for all players. Especially a star player like him who is making really good money there is absolutely no excuse for anyone to drive drunk let alone a rich athlete at 7 am. 7 what the hell were you doing out at 7?

Harvey can hire one of these POS for their "Sports Guy." They obviously won't be playing this week. The NFL and NBA need to re-visit their guidelines or how about creating guidelines instead of allowing players like this on their teams. I realize it's nuts as it is all about money so the NFL and NBA will continue to allow any douche bag on their teams no matter what they are arrested for. What the hell is happening to our country?

I just do not understand how you spend your entire life trying to get a dream gig--and this IS a dream gig, a starting spot with the SF 49ers for God's sake--and then you revert to idiotic, child-like, thuggish behavior. They need to include morality clauses along with the dollar amount for athletes. They, along with all celebs are role models, whether they like it or not and should be held to high standards. This guy should have been let go after the first DUI!

If you really think there is any chance at all the team will do more than tell him, "Dude, you can't be doing this during the season." You know absolutely nothing about sports at any level.

Of course, if he was a backup, he'd have been cut already as a PR ploy about how the team cares about doing the the right thing. But a star pretty much has to stab a coach to get sit down, much less suspended by the team.

Teams have the power to suspend players for breaking team rules or conduct detrimental to the team but they NEVER do. They always leave it up to the league so they can pretend they did what they should have done.
