I Reject Your Plea Deal

0222-justin-bieber-getty-02Justin Bieber will REJECT the plea deal prosecutors in his Miami Beach DUI case have offered ... and a big reason is because he doesn't want random drug testing.

TMZ broke the story ... prosecutors offered Bieber a deal they often give to first-time DUI offenders ... it includes community service, an alcohol ed course and random drug testing.

Sources connected to Bieber tell TMZ ... there are several reasons they aren't buying what prosecutors are selling.  First, there are huge problems with the case -- they believe the cop lied when he said Bieber reeked of booze (he only blew a .014), and he was also lying about observing Bieber drag race -- the GPS device registered a very reasonable 27 MPH.

But the bigger issue is this -- our sources say Bieber will NOT accept any plea that has probation ... where the judge can throw the book at him if he screws up.

In particular there's NO WAY Bieber will agree to random drug testing.  Fact is ... he has a problem with weed and sizzurp.   If you don't understand his worry, just remember Lindsay Lohan, who became a habitual probation offender for more than 7 years.

Also, we're told Justin will not accept an alcohol ed course as part of a plea deal, because he'd become a spectacle.

We're told Bieber is open to a plea ... but not this one.

Really why are people so anxious that he have these random drug tests based off of false information by the police? For one teen pop idol..we are willing to allow ourselves to become under the foot of a police state.
If it happens to a famous person where police lie IT CAN HAPPEN TO YOU. Only you don't have the same cash flow as Justin Beiber to fight back.

since the halfwits that write for TMZ neglect to mention ANY alcohol in someone under the age of 21 is illegal it does NOT MATTER how little there is he should not be been drinking, smoking pot and under the influence of other sedatives and gotten behind the wheel of a car driving slow or not. Also he already is a spectacle. But yes why take any sort of responsibility for anything now after all his Mommy still takes care of all that for him...

I'm Canadian and i get tired of hearing everyone thinks his actions are ok because he's young, a kid, well if it was anyone else some thing would of been done.
Ok ,he's 19, big deal , he knows right from wrong, but as long as news puts his crap out there he gets attention, so quit posting everything he does..

The facts indicate the arresting officer didn't have probable cause to stop him, therefore any evidence is inadmissible in court.

To make this case stick the arresting officer will have to commit perjury, which apparently isn't a problem.

They don't want a case trial. Nolo Contendere plea & $500 fine is the best they'll get.

He going to offer his own plea deal most likely to them. I can see him saying this do a 10 month interlocking device in his car he will do 60 hour of couminty service and He will most like offer fine of 3,500 dollars. I would do that. They also risk the traffic stop not being legal as well. that could come in to questioning the officer and he will have to take the stand if this goes to trial without him the Prosecution has no Strong Evedince.

Roy Black has the prosecutor by the nose hairs and knows it.. They probably already sent a alternate plea bargain to the prosecutor that would involve Justin pleading down to a minor traffic infraction of driving without a valid license that only comes with a massive $68 fine.. That's sixty eight dollars. Now that would depend on the judge accepting it from the prosecutor and may depend on whether Justin can renew his drivers license before the court date.. The big issue is that his license was expired over 4 months not under. A expired license over 4 months in Florida is a misdemeanor and no way in hell would they accept that because it could possibly affect his traveling.

Good for you Justin!! The fact that the police report was riddled with fabrications makes this case immediately dismissible due to a technical violation. That means that all the evidence acquired goes right down the drain with the report as well. Clearly, the State of Florida ruled that a BAC that is under 0.02 is considered not to be drunk driving. And this rule was written this way because a BAC of 0.014 is hardly considered to be drunk. If the state felt that a BAC of 0.02 or less was dangerous and lethal drunk driving, the state would have simply ruled any BAC over 0.00 is drunk. As for the "alcohol smell," Justin left a club with people who were drinking. More than one person could have spilled alcohol on him, his body, or his clothes. So, he probably "smelled like alcohol" but not enough proof to show he over drank. Sorry, GPS data proved no speeding at the time of his arrest. And let's remember people, the "burden of proof" is on the prosecution and our Constitutional rights state that we are "innocent until proven guilty." Does the DA have sufficient evidence to prove his/her case to a jury based on the facts? Officer lied, police report a fabrication, smell of alcohol undetermined, BAC was 0.014, and the GPS data shows 27 MPH. Hmmmm...a jury can dismiss this case based on any form of "reasonable doubt."
