Diddy's fighting back against the massive $100 million default judgment leveled against him this week ... claiming he never received a copy of the lawsuit -- and, even if he had, the statute of limitations ran out years ago.

The controversial music mogul filed the emergency motion to set aside the massive judgment Thursday ... saying the plaintiff, Derrick Lee Cardello-Smith, never served him with a lawsuit -- and, he didn't know he had to handle the matter until news outlets started reporting on the judgment.

Worth noting ... Diddy's lawyers aren't just trying to get the case thrown out for failing to serve him properly -- they're denying all wrongdoing wholeheartedly. They say the "facially implausible allegations are completely fabricated."

Fulton County Superior Court Judge Scott McAfee tossed out 2 criminal counts against 45 in the case on Thursday.

Sources with direct knowledge tell TMZ ... the original child support order in the Britney/Kevin Federline divorce provided that child support payments would cease on the 18th birthday of Jayden, the youngest son, OR when he graduates high school, WHICHEVER IS LATER. We've learned Jayden will graduate from high school in Hawaii in November -- it's an early graduation -- so the child support payments will continue until then. That means Britney will make payments in October and November, and then it all stops.

We're told the original child support order was $20,000 a month. But, in 2018, it went up to $40k a month, partly because Kevin pretty much had the kids all the time, and there were additional expenses as the kids got older.

Harvey Weinstein is facing new criminal charges ahead of his rape retrial in New York ... with prosecutors hitting him with a brand new indictment after more accusers came forward.

Manhattan prosecutors revealed in a hearing Thursday a grand jury handed up additional charges, which will remain sealed until Weinstein is arraigned -- which won't happen until he gets out of the hospital.

Weinstein reportedly faces the possibility of 3 new criminal complaints from 2005, 2006 and 2016.

TMZ got the docs -- an entity controlled by Leo Kryss, co-founder of Brazilian toy and electronics company Tectoy, is suing real estate firm Douglas Elliman ... claiming its CEO, Jay Parker, personally called to assure him Bezos was not the buyer behind an offer on his fancy Florida estate.

Kryss claims in the lawsuit he agreed to cut his asking price from $85 million down to $79 million after Parker assured him Bezos wasn't behind the deal -- and the purchaser wouldn't budge on the offer. But Kryss says he found out later the buyer of his Indian Creek oasis was indeed Bezos.

Jesse Williams is back to fighting with his ex-wife over their child custody schedule ... and it's getting nasty.

The actor just filed new docs, obtained by TMZ, seeking a change in their child custody agreement ... and he's taking a few shots at his ex in the process.

5:00 PM PT -- Tyrese was released from custody Monday after his attorney Tanya Mitchell Graham filed an appeal of the judge's ruling ... according to law enforcement sources.

We're told the appeal means Tyrese did not have to pay the $73K before he was released. That does not mean he no longer owes the back child support, it's just delayed, for now. It's the same legal maneuver Tyrese and his attorney made last year when the judge ordered him to pay up the child support.

9/6 8:43 AM PT -- Hunter Biden followed through with his plans to switch up and plead guilty in his tax evasion trial. The judge ticked off each of the 9 charges against Hunter in court, with President Joe Biden's son repeatedly saying "guilty" to each one.

The judge scheduled sentencing for December 16 ... and in the meantime, Hunter will remain free on bond.

Hunter Biden is planning to enter a guilty plea in his controversial tax evasion trial ... the first son's attorneys have revealed.

President Joe Biden's son arrived at a Los Angeles courthouse alongside his wife, Melissa Cohen Biden, on Thursday ... but Hunter's trial is unlikely to last long given his decision to change his plea.
