Rumor Has It: Gossip Girl Happy On Set
Kelly Rutherford with son Hermes looking the opposite of "crazy" on the set of Gossip Girl in NYC Friday.
Her soon-to-be ex husband Daniel Giersch still contends Kelly is too crazed while she's filming, which isn't a good influence on their son.

A judge just ruled Kelly Rutherford can take her kid to NYC while she films "Gossip Girl."
The judge said Kelly can go on Sunday and her estranged hubby Daniel Giersch is free to travel there as well. He had argued he needed to stay in L.A. to do his business, but the judge begged to differ. Daniel told the court he will travel to New York.
Rutherford filed for divorce on December 30. She is also pregnant.
Giersch was awarded two overnight visits per week for the month of February and three per week for March. They all need to come back to L.A. for a minimum of four days, at least twice. During the L.A. stays, Hermes will alternate between the two parents.
The judge also ruled 2-year-old Hermes will bounce between NYC and L.A. for the next two months while the feuding couple tries to hash out a long-term custody arrangement. Good luck.

The "Gossip Girl" custody case is back in court this morning and today's ruling not only will have a profound impact on the parents -- but also the fate of the show could be affected.
Kelly Rutherford and Daniel Giersch are at war over their kid, Hermes. The judge presumably will decide today whether Kelly can travel to NYC this weekend with the kid to film the show. Giersch doesn't want Rutherford to travel with the kid because he says she gets all crazy when she films and the kid is a basket case.
Rutherford got emotional after yesterday's hearing.

Here's how nasty the Kelly Rutherford/Daniel Giersch divorce has gotten -- they're bickering over who doesn't wipe their kid.
In legal papers filed today, Giersch claims he tried to potty train their son, Hermes, early on but Rutherford took his mini-toilet seat away and hid it and did not "encourage him to use the toilet."
Giersch adds, "I have witnessed that she does not always keep his bottom clean."
And there's more. Giersch says it is not "reasonable or appropriate for [Rutherford] to be breast feeding when he is nearly 2 1/2 years old."
As if to punctuate his point, Giersch says the kid is old enough to be fluent in German.

A main character in "Gossip Girl" may be killed off, depending on what a judge rules tomorrow.
Kelly Rutherford, who plays Lily van der Woodsen, was in court this morning, asking an L.A. County Superior Court judge to green light her request to bring her two-year-old son Hermes to NYC to begin filming this coming Sunday.
Standing in her way -- estranged hubby Daniel Giersch -- who claims the kid is a basket case when he goes back to New York because Kelly gets crazy with her work schedule. Kelly says she's been taking the kid back and forth for a long time and it's no problemo.
The judge says he'll decide tomorrow if Kelly can take Hermes back this weekend. If the answer is no, Kelly has to decide whether to go back alone or even quit the show.
"Gossip Girl" Divorce Gets Even Nastier
Kelly Rutherford, who plays Lily van der Woodsen on "Gossip Girl," claims her husband is ominous, violent and bad news for their kid.
Rutherford filed legal papers that the judge will consider tomorrow in a showdown hearing. Rutherford's estranged husband, Daniel Giersch, wants the judge to prohibit his soon-to-be ex-wife from taking two-year-old Hermes to NYC to film the show.
Rutherford claims Giersch has gotten into blowout arguments with her, in one case allegedly coming at her. She says he's an avid boxer and kickboxer and she is "intimidated by him."
She also says he's threatened to teach her a lesson by taking the child. She says it's gotten so bad she called the cops twice and he's been forced to leave.
Giersch has claimed the kid is totally stressed out around Rutherford and that she can't be a real mom because her shooting schedule is insane. She says it's just not true.

Serena's mom on "Gossip Girl" could face an untimely death unless a judge lets her fly.
Kelly Rutheford (Lily van der Woodsen) has a big problem. We've learned she went to court last week and pleaded with the judge in her divorce case to let her go to NYC with her two-year-old, Hermes. The judge shut Kelly down, telling her he'll take the issue up a week from today.
Kelly's going through a mega-nasty divorce with her hubby of 2+ years, Daniel Giersch.
Now here's the problemo. Sources on "Gossip Girl" tell us Kelly is supposed to be in New York to shoot by January 27. If the judge shuts her down next week that's not going to happen. Producers could deal with a small delay and shoot her out of sequence, but if the delay is longer they could just shoot her -- as in her character.
Kelly is pregnant with their second kid. Giersch doesn't want Hermes to travel to NYC because he claims Kelly works insane hours and gets totally stressed out when she's shooting.
"Gossip" Mom Wants Hubby's Wings Clipped
The divorce case of "Gossip Girl" star Kelly Rutherford is starting to sound like something out of ... "Gossip Girl."
In court papers, report People, Rutherford wants to bar her estranged husband David Giersch from leaving the country with their two-year-old son, alleging he's a flight risk and could vanish with the child overseas. Giersch, on the other hand, charges Rutherford has anger issues, claiming Kelly tossed a laptop at him and has tried to "hit him with an open fist."
Kelly filed for D on Jan. 2.

TMZ obtained legal papers filed December 30 in L.A. County Superior Court. Kelly Rutherford is asking a judge to end her marriage of two years to Daniel Giersch, citing "irreconcilable differences." In addition to a child on the way, they have a two-year-old son, Hermés Gustaf Daniel Giersch.
It's Kelly's second marriage, which gives you an idea why she was cast.

We're told Blake was "extremely kind" during the fitting and even offered to walk over to an ATM to get cash out for the work, but Bilotti told her not to worry. Since then, Bilotti alleges she's tried to contact Blake directly to no avail.
Blake's rep tells us Bilotti botched the job on the dress and Lively agreed to pay her half the fee.

For Penn Badgley and a haggard Blake Lively in NYC, finding a taxi was almost as hard as finding people who actually watch their show.
