'Resident Evil' Stuntwoman Blamed for Set Accident ... Losing Your Arm Was On You!!!

Milla Jovovich's stuntwoman in the last 'Resident Evil' movie lost her arm while shooting a scene, but the film company says investigators determined she has no one to blame but herself.
Olivia Jackson is suing director Paul W.S. Anderson, the production company and others associated with the 2016 flick, "Resident Evil: The Final Chapter," after getting brutally injured in a motorcycle stunt while filming in South Africa.
In her suit, Jackson says the stunt called for her to ride toward an oncoming vehicle with a camera attached to a mechanical arm. She says the arm was supposed to lift up at the last second, but that didn't happen ... and the equipment ended up slicing her arm and shattering the bone.
Eventually, it had to be amputated, and Jackson says she was in a coma for 2 weeks.
In new legal docs, obtained by TMZ, the production company -- Impact Pictures -- fires back, saying Jackson rehearsed the stunt twice before a final run-through, and she was given every opportunity to speak up if she was uncomfortable with anything. Impact says she did not.
IP also cites a report issued by a South African insurer which says Jackson was riding the motorcycle faster than rehearsal, and she could have avoided the collision with "a mere throttle-off or use of the excellent brakes." The company says it has footage to prove it.
Jackson blamed it on Paul and co. alleging their insurance policy wasn't up to snuff to cover her injuries. She also claims, in docs, the stunt was carelessly planned and last-minute tweaks -- including start times -- made it unsafe.
Last but not least, Impact Pictures says it believes Jackson is only going after them in an L.A. court to create buzz for her new biography. Impact's lawyers say the case belongs, if anywhere, in a South Africa court ... and they note Jackson has already filed 3 suits there.

Cuba Gooding Jr. Pleads Not Guilty to Sexual Abuse ... Indictment Includes 12 Other Allegations
-
Breaking News

11:05 AM PT -- Cuba's attorney Mark Heller responded to the 12 allegations, telling us ... "Cuba denies all of these allegations. This is a typical scenario in which random people come out of the woodwork to accuse a celebrity who has already been charged. They have no credibility because Cuba was not charged with any of those allegations."
10:25 AM PT -- It's a 4-count indictment against Cuba and he's facing one count of forcible touching and one count of sexual abuse in the third degree for the new accuser -- both misdemeanors. He's facing the same 2 charges for the original accuser from the rooftop bar incident in June 2019.
The incident involving the new accuser went down at TAO Nightclub on Oct. 24, 2018. According to docs, Cuba allegedly pinched the accuser's buttocks without consent. She confronted him on the spot, and Cuba said he'd pinched her on the back.
The accuser claims he made a "sexually suggestive remark" to her earlier that same night.
The indictment also includes 12 allegations, for which Cuba is not being charged. However, prosecutors say they're including them to show a pattern of behavior. Among the 12 accusers are a woman who claims Cuba was at the Yard House in Long Beach, CA and while taking a photo with her he squeezed her butt and said something to the effect "You've got a good piece of ass."
Another accuser says he bit her shoulder a couple of times in the Hollywood bar Chi back in 2006. She also claims he thrust his pelvis against her leg and tried to lift up her shirt.
Around February 2011, another accuser says she had an encounter at an unnamed Los Angeles bar. She claims he grabbed her arm as she walked past him, placed his hand inside her blouse and squeezed her bare breast. She claims he said, in substance, "Sit on my face, pee in my mouth."
In 2014, while at Cafe Havana in Malibu, a woman claims Cuba reached under her skirt and touched her vagina over her underwear. She says she saw him about a year later at another bar in Santa Monica, punched him in the chest and yelled at him for the Cafe Havana incident.
Prosecutors say the 12 uncharged allegations would refute any claim from Cuba's team the 2 NYC incidents -- for which he's been indicted -- are innocent, accidental or consensual.
9:53 AM PT -- Cuba's arraignment is over, and he walked out of court free of handcuffs, and still confident he'll be exonerated. We're about to get details on the new indictment, but we're told it includes TWO misdemeanor charges related to the new accuser, and also charges related to the original accuser.
9:21 AM PT -- Cuba has just arrived to court for his arraignment on the new charge. Although he was smiling, his hands were cuffed behind him and he was flanked by an NYPD detective.
NYPD has a new set of Cuba Gooding Jr.'s fingerprints after booking the Oscar winner on a new charge ... one prosecutors are still keeping under wraps.
Cuba was processed Tuesday morning, ahead of his scheduled arraignment Tuesday afternoon. While that was going on, his attorney, Mark Heller, was in front of the Manhattan courthouse and said Cuba had surrendered to cops.
Heller also took several jabs at the prosecutors, insinuating they only tacked on this additional charge after coming up short on evidence in the initial case -- the alleged groping at a rooftop bar. He also groused at prosecutors moving both cases to New York's Supreme Court because it allows them to start the case all over, and delay Cuba from getting his day in court.
The Manhattan D.A. has remained tight-lipped about what exactly the new alleged victim is claiming. The charge will be revealed at Tuesday's arraignment, and we're told Cuba will plead not guilty.
Art The Clown in 'All Hallows' Eve' 'Memba Him?!
Staten Island-local Mike Giannelli is best known for playing the creepy Art The Clown -- who terrorizes, tortures and murders young people on a VHS tape -- in the 2013 killer clown film "All Hallows' Eve."
Mike Giannelli is cemented into the ranks of classic homicidal clown movies including "Killer Klowns From Outer Space," "Poltergeist," 2019's "Joker" and of course Stephen King's "IT."
Freaky fact: Mike Giannelli did not take on the role of Art The Clown in the 2016 fright follow-up, "Terrifier," instead the clown was played by David Howard Thorton.
Guess what he looks like now without all the clown makeup!!!

Zoe Kravitz Cast as Catwoman in 'The Batman' ... Still Too 'Urban'???
The cat's outta the bag -- Zoe Kravitz is playing Catwoman in the new 'Batman' movie ... which is interesting, considering she was allegedly too "urban" for Christopher Nolan's take.
The news broke Monday, with multiple outlets reporting that Zoe had landed the role after testing out some scenes last week opposite heartthrob Robert Pattinson -- who's donning the cowl next in Matt Reeves' "The Batman" ... which is hitting theaters in 2021.
The ironic thing about Zoe's casting here is that she told Nylon back in 2015 that she couldn't even get an audition for Nolan's last Batman flick, "The Dark Knight Rises," which she attributed to her race. That's not out of the clear blue sky either.
Zoe said she was basically blocked from even reading for a small role in the movie, allegedly being told that somebody had said they weren't "going urban" with the last installment.

Cuba Gooding Jr. is now being accused of another incident of sexual misconduct -- the 5th such allegation -- and he's going to face a new charge for it, this week in court.
Law enforcement sources tell TMZ several other women have recently come forward to make new allegations of sexual misconduct against Cuba. We're told one of them is a woman making a claim about Cuba from October 2018.
While the D.A.'s kept details of the allegation under wraps ... it's expected to come out Tuesday when Cuba is arraigned on a new charge. Cuba's attorney, Mark Heller, tells us his client will plead not guilty.
Heller also says the new accuser never pressed charges immediately following the incident, and he claims she only came forward after seeing Cuba's arrest this year. He further claims, her attorney tried to settle the case, but Cuba "declined to be shaken down."
We're told cops are also investigating 3 other alleged incidents -- from 2008, '13 and '15 -- but there are no charges, as of now, related to them.

The Joker is actually a good guy -- at least in real life -- because when Joaquin Phoenix hit a fire department vehicle, he tracked down the paramedics to confess.
Law enforcement sources tell TMZ ... Joaquin was making a right turn out of a parking lot in West Hollywood Tuesday afternoon when his Tesla scraped the bumper of an unoccupied L.A. County Fire Dept. truck.
We're told Joaquin parked and found the paramedics, who were on a call, and explained what happened -- he simply misjudged it and didn't make a wide enough turn. Police were called, everyone exchanged insurance info and a damage report was also taken because L.A. County property was damaged.
Kevin Hart Car Crash Caused By Driver's Sudden Acceleration ... CHP Says No One Wore Seat Belts
-
Exclusive
- 2.4K shares
2:52 PM PT -- According to the crash report -- obtained by TMZ -- it details Kevin leaving the scene after the accident while Black and Broxterman remained trapped.
The report also lists the extensive bodywork Kevin had done to the Barracuda ... including adding a 6.4L Hemi V-8 engine, sport tires as well as custom gauges and graphics. It also mentions the vehicle was without an anti-lock braking system.
As for the seat belts, the report says, "There were fold and crease marks on the belt surfaces consistent with being folded and tucked into the seats and no indicators of occupant loading were present." Cops say even if the belts were worn at the time of the crash, "They were being worn improperly due to excessive slack in the belts."
The report says Broxterman was pinned between the top of the right passenger seat and the collapsed roof of the vehicle, with her head facing the windshield. The report also notes the car was, "not outfitted to carry rear seat passengers." Kevin replaced the backseats with plastic storage boxes.
Kevin Hart's car crash was caused by the driver operating the vehicle in a reckless fashion ... this according to the California Highway Patrol, which has just completed its report on the accident.
Law enforcement sources tell us ... Kevin's 1970 Plymouth Barracuda crashed because driver Jared Black gunned the engine and lost control. The car had incredible power with a 720-HP engine. We're told the sudden acceleration and loss of control caused the vehicle to go into a spin and it ended up crashing through a fence and into an embankment.
According to our sources, the report says none of the 3 people in the car were wearing seat belts. As we reported, the Barracuda did not have safety harnesses, but now it's not an issue since they weren't wearing any safety device.
Our sources say the vehicle did not have any mechanical issues. It was purely driver error -- willful or wanton disregard for people or property.
Cuba Gooding Jr. Charged with New Crime ... In Sexual Assault Case
Cuba Gooding Jr. has just been charged with another crime, although the Manhattan D.A. is being super secretive over the exact nature of the charge and the alleged victim.
Cuba showed up in court Thursday -- everyone thought it was for his sexual assault case -- but apparently that was not the case. The D.A. told the judge there was an additional incident that is the basis of the new charge.
It's unclear if the alleged victim is the same woman who made the initial allegation against the actor. When Cuba was arrested, the D.A. revealed there was an additional incident the NYPD was investigating, but it's unclear if this is the basis for the new allegation.
Cuba will be arraigned on the new charge next week.

Kevin Hart is getting back to his famous "Hustle Hart" mode after his horrific car accident -- but he's not rushing into anything intense -- like full action scenes -- just yet.
Sources connected to Kevin tell TMZ ... he's reported to work this week to promote the upcoming 'Jumanji' sequel in a new marketing campaign, which clearly required his presence, because he's nowhere near 100 percent yet.
Ever the trooper though, we're told Kevin is committed to fulfilling his commitments as best as he can. For example, our sources say Kevin did 2 hours of shoots on set Monday, another 2 hours Tuesday, and will be back for another couple on Thursday.
We're told Kevin has not been in full costume for these shoots and he's not walking much for them either -- sitting through most of the day -- even though he can walk on his own these days.
Everyone else on set -- including The Rock, Jack Black, Nick Jonas and others -- have been doing full days themselves. Of course, they're not recovering from a near-fatal wreck.

Charlie Brown isn't about to let Dolly Parton's theme park get away with using his famous Christmas tune -- at least not on the watch of the song's cowriter.
Lee Mendelson's production company is suing Dollywood for using the song "Christmas Time Is Here" in a play the amusement park puts on each year. Lee cowrote the song -- famously featured in "A Charlie Brown Christmas" -- and his production studio owns the copyright.
According to the docs, obtained by TMZ, Mendelson's company says it recently became aware Dollywood weaves the track into its stage play, "Twas the Night Before Christmas," which LM's team claims has been happening, without permission, since '07.
The use of the song is no secret ... you can find clips of the performance online, in which the cast sings the track. The iconic piano melody shows up as background music too.

You know Marvel's "X-Men" as defenders of justice, but a TV show -- in Hungary of all places -- claims Wolverine and co. are guilty of stealing the theme song to their hit cartoon.
A guy named Zoltan Krisko is suing every media giant you can imagine -- Marvel, Disney, FOX, Apple, Amazon and more -- claiming the TV execs behind the animated series from the '90s jacked the intro music from an even older show ... called "Linda."
Bear with us ... "Linda" aired in Hungary from 1984 to 1991, and according to a lawsuit filed by Krisko it was a hit cop comedy/thriller. Hey, genres are different over there.
Anyway, Krisko says he manages the estate of a Hungarian composer named Gyorgy Vukan, who created and copyrighted the "Linda" theme song in 1983. Krisko says it sounds exactly like the tune the "X-Men" cartoon used years later.
