Abe Vigoda's family is demanding an apology from the Oscars, saying leaving him out of the "In Memoriam" segment was a final injustice to his memory and career.

Carol Vigoda tells TMZ ... "Last night the Oscars dismayed many and cheated Abe Vigoda by not paying tribute to the immense professional energies and talents that he brought to the industry."

She added, "Let's not forget the personal and family sacrifices that were willing made to achieve that essential devotion. The Oscars fell short in many ways and as my father Abe Vigoda said the Oscars have earned, 'one demerit.'"

Carol's also not going to buy the excuse that Abe -- who starred in "The Godfather," "Look Who's Talking" and countless other films -- was omitted because he died too recently (Jan. 26, 2016) because David Bowie was included ... as was Alan Rickman.

Carol says there's a "hole in my heart that needs to be filled."

Dr. Luke is not letting Kesha get away with embracing Lady Gaga for Sunday night's Oscars performance ... he's lashed out at her saying "Til It Happens to You" has nothing to do with her.

Luke is responding to Kesha's tweet, "thank you @ladygaga and VP @JoeBiden for bringing attention to sexual assault at the oscars. it hit very close to my heart for obvious reasons."

Luke's attorney, Christine Lepera, tells TMZ, "Ms. Sebert [Kesha], who in sworn videotaped testimony from 2011 stated that she had never been sexually abused or drugged by Dr. Luke is neither a victim nor the appropriate person to be held up as an example for this important issue."

Kesha -- who's vacationing in Turks and Caicos -- claims Luke threatened her into denying allegations of rape during the depo.

Leo DiCaprio is a seasoned actor, but he's a neophyte when it comes to Oscar etchings ... so he proved when he took his trophy upstairs to get it engraved.

You gotta watch the video -- there's wonderment in Leo's eyes as the woman burns his Best Actor title onto the prize.

Feels like an odd word to describe it, but this is kinda ... adorable.

The Vanity Fair Oscar Party was the place to be after the ceremony.

It went down in Bev Hills at the Wallis Annenberg Center for the Performing Arts. Lots of stars stopped by, including Chris Rock, Louis C.K., Dave Chappelle, Sarah Silverman, Vince Vaughn, Jeremy Renner, Adrien Brody, and Alejandro Iñárritu.

When you sit through 3 hours of that ... you deserve to party.

Sam Smith suggesting he might be the first openly gay man to win an Oscar ... pissed off screenwriter Dustin Lance Black, who's now calling out Smith.

Not long after Smith won Best Original Song for the "Spectre" theme ... Black, who is openly gay, tweeted a reminder that HE won the Oscar for Best Original Screenplay in 2009 for "Milk."

He also claims Smith is infatuated with his fiance, olympic diver Tom Daley.

The "first" argument might seem kinda petty -- especially since Smith didn't state he was first as fact -- but Black tells TMZ, "I think knowing our collective LGBTQ history is important. That's all. We stand on the shoulders of countless brave men and women. We should honor that."

As for the shot about Daley ... Black wouldn't elaborate. We've reached out to Smith, but no word back.

Fun fact: Elton John also won an Oscar, long before Black, in 1994.

Smith has now apologized.

Leo DiCaprio celebrated his Oscar win by puffing on a vape pen and sipping a cocktail.

Leo was at Ago restaurant in WeHo to celebrate his win, and he was the center of attention.

When he left, someone gave him a bottle of booze. And the weirdest thing ... someone ran out after Leo's car with his Oscar, almost as if someone forgot to take it.

Michael Rapaport perfectly captured what all of us were feeling when someone other than Sylvester Stallone won the Best Supporting Actor award Sunday night ... "WHAT THE F**K IS GOING ON?!"

You gotta watch the video ... Rapaport goes off when Stallone was upset by someone named Mark Rylance.

"YOU MOTHER F**KERS! WHO THE F**K IS THIS?!"

Hilarious.

By the way, Sly's friend Arnold Schwarzenegger also had a message for the actor -- but there's not as much yelling and cussing.

Oscar time in L.A. ain't just for the (white) movie stars ... some of the biggest names in sports come out too .. and they were looking their best Sunday night.

Serena Williams, Aaron Rodgers, Robert Kraft and GRONK all took part in the Tinseltown festivities ... most opting for the Vanity Fair after-party in Beverly Hills.

So, who looked the best? Hard not to go Serena here ... but Aaron Rodgers seemed to have the entire media talking about his classic look ... and his smokin' hot date Olivia Munn.

But yeah, it was Serena ... check out the pics.

Gwen Stefani and Blake Shelton went for the glitz at the Vanity Fair Party ... sort of.

Gwen killed in a red sheer dress ... Blake wore jeans.

On the other hand ... guess who was more comfortable?

Charlie Sheen wanted everyone to know he's HIV free -- at least that's what his wardrobe seemed to be screaming at Elton John's AIDS Foundation party.

Charlie's t-shirt at Elton's annual Oscar event read, "Stay positively negative." Sheen has maintained there's no trace of HIV in his blood ... ever since announcing last November he'd contracted the virus.

The event raised more than $6 million for AIDS research, and if some thought Sheen's clothing selection was in questionable taste -- Elton and his husband David Furnish didn't seem to mind.

First off ... props to Aaron Rodgers and his girlfriend Olivia Munn for reaching into their pockets and shelling out some cash to help the Girl Scouts at the Oscars Sunday night.

That being said ... WHO THE HELL BUYS SAVANNAH SMILES?!

(FYI, Savannah Smiles are zesty, lemon-flavored cookies dusted with powdered sugar ... which sound fine, but they're no Thin Mints).

The good news ... Munn got a full box of Thin Mints, because she clearly has taste.

Oscars host Chris Rock says he ultimately raised more than $65k in his Oscars Girl Scout cookies stunt -- including $20 from Vice President Joe Biden.

Hopefully, he got something better than SAVANNAH SMILES!!!

Kesha's not fully unplugged during her Caribbean vacay -- she tuned in for the Oscars and used the buzz around Lady Gaga to put a spotlight on her sexual assault allegations against Dr. Luke.

Last night she thanked Gaga and Vice Prez Joe Biden for "bringing attention to sexual assault at the Oscars."

As we've reported, Kesha jetted to Turks & Caicos over the weekend to escape her legal problems, but she was obviously watching when Biden intro'd Gaga's performance of "Til It Happens to You."

Kesha's review -- "It hit very close to my heart for obvious reasons."

Eddie Redmayne could learn a thing from Tracy Morgan about how to werk it in heels ... and eat a danish.

The Oscars put together a brilliant skit about how this year's nominated films would look if black actors landed roles in them. Tracy deserves a trophy -- or at least a pastry.

Chris Rock went all in on the #Oscarssowhite controversy during his Oscars monologue, but perhaps no one got it worse than Jada Pinkett Smith.

Rock was responding to Smith's video last month in which she stated she was boycotting this year's Oscars, but Rock was quick to point out ... she wasn't close to getting nominated anyway.

Damn.

Anne Hathaway is super pregnant, but lookin' great Saturday night as she left Leo DiCaprio's pre-Oscar party.

Leo threw his bash at Emporio Armani in Bev Hills and it was well-attended.

Jamie Foxx thinks people have gotten way too serious about the Oscar protests ... and thinks everyone's just got to laugh more.

Jamie took some heat for joking about #WhatsTheBigDeal and #ActBetter recently at the American black film festival awards. The Oscar winner is firing up his new comedy act, and thinks people have got to start exercising their funny bones more.
