10/9 10:27 AM PT -- The Cornell University disciplinary committee expelled Jonathan Newell because he had sex with her without her consent ... Jane Doe's lawyer tells TMZ.

Newell was the Chi Phi fraternity brother who sent the "free p***y" Snapchat message in the frat's group chat.

Someone who reviewed the hearing panel's decision told us the panel found Newell did NOT have "affirmative consent," meaning there was NOT express consent to engage in sex with Doe. Title IX says "silence or lack of resistance in and of itself does not demonstrate consent."

Jane Doe was in serious text mode 2 days after the alleged sexual assault, almost consoling one of the men she would later accuse of rape, saying there was nothing to be ashamed of.

TMZ obtained a text chain between Jonathan Newell and Jane Doe. On the evening of October 21, 2024, Jonathan apologizes to Jane and says, "You're an amazing person and I genuinely hope ur not catching as much heat from this as we r. We've been shutting down any stories we've heard but again I'm so so sorry."

Jane responds, "aw jonathan i really appreciate this text. my memories super clouded too. I think we were all way to f***ing drunk and high."

Christa Pike is going through some major psychological trauma after surviving her botched execution ... this according to her legal team.

TMZ obtained a statement from Pike's lawyers -- Randy Spivey, Kelly Gleason, Stephen Ferrell and Luke Ihnen -- who say her physical health is improving ... but the ordeal has taken a psychological toll.

The lawyers say she's eating a regular diet and her lungs are clear, but added ... "While her physical recovery has been remarkable, significant questions remain about the long-term effects of what she endured."

TMZ obtained a text chain between Jonathan Newell and Jane Doe ... and on the evening of October 21, 2024, Jane tells him, "ps. i'm not sure if u remember but i did ket off your d*** at some point❓and i honestly think that was one of the most insane/jaw dropping moments of the night."

Jonathan -- a defendant in Jane Doe's lawsuit -- responds ... "I have no memory of that last part 😭"

J.R. Smith has been banned from contacting the woman he allegedly injured during a violent altercation last month ... with a Texas judge ordering the former NBA star to steer clear of his accuser.

The order, signed on September 29, bars the retired hooper from communicating with the woman who accused him of hurting her. Smith must also remain at least 1,000 feet away from her home and work.

J.R. was also ordered not to possess any guns or ammo.

Hayden Panettiere's daughter appeared in court alongside her father, Wladimir Klitschko, and he was granted temporary guardianship over the late actress's estate.

Kaya appeared remotely during a hearing Thursday about Hayden's estate. Klitschko was not visible on camera, but Kaya briefly appeared and answered the judge's questions about her identity and whether she was with her father, according to PEOPLE.

Hayden's daughter reportedly wore a white T-shirt with her hair pulled back and appeared composed as she spoke with the judge.

Christa Pike is back on her feet after surviving two lethal injections ... she's now able to walk again following the botched execution.

Her lawyer, Stephen Ferrell, told the BBC ... "She is up and walking for the first time today, but just around the room, not very far."

Charles Manson family killer Patricia Krenwinkel is on the doorstep of freedom after being recommended for parole in California ... but Governor Gavin Newsom could still step in and keep her locked up.

Krenwinkel, who was among the Manson family members convicted in the Tate-LaBianca murders in 1969, was granted parole on a preliminary basis Tuesday ... according to the California Department of Corrections and Rehabilitation.

It's the third time 78-year-old Krenwinkel has been approved for parole ... Newsom used his power to prevent her release the previous two times ... and it will be interesting to see if he does so again or if the third time's the charm for Krenwinkel.

8:54 AM -- We obtained the dispatch call tied to the swatting incident, and you hear the dispatcher say cops determined there was "nothing going on."

The woman at the center of the "Cornell 7" gang rape case was the victim of a "swatting" incident this week, prompting heavily armed police to respond to her home and causing concern for her and her family ... according to her lawyer.

Her attorney, Thomas Giuffra, told CNN's Kaitlan Collins Wednesday night that his client -- known as Jane Doe -- was still reeling from Tuesday night's swatting incident that brought law enforcement officers to her doorstep with their guns drawn.

Giuffra said Doe's family filed a police report detailing what happened ... according to the report, a person called 911 claiming a man had shot his mother to death before turning the gun on his sister ... they gave cops her address, but the info was totally bogus.

10/9 11:11 AM PT -- A rep for Max tells TMZ ... "Max made a left turn without realizing that turns were prohibited at that location. The incident was a mistake, and he received a citation."

Demi Lovato's ex Max Ehrich is getting super familiar with Florida law enforcement... because just weeks after being arrested for nitrous oxide possession, he was cited for driving the wrong way down a divided highway.

The singer and actor was cited just after 9 AM on September 30 after cops claimed he was driving his 2020 white BMW the wrong way down a divided highway in Port St. Lucie.

This traffic violation came about a month after cops arrested Max for possession of nitrous oxide on August 25 in Florida.

Texas has carried out an execution days after Tennessee inmate Christa Pike survived two doses of lethal injection ... with the condemned killer's final words directed at his victim's family.

Jamaal Howard was pronounced dead Wednesday night at a Texas prison after receiving a dose of pentobarbital ... the same drug used during Pike's botched execution last week.

Howard was convicted of fatally shooting convenience store clerk Vickie Swartout during a 2000 robbery in Texas. Surveillance video showed Howard shooting Swartout in the chest before stealing $114 and a carton of cigarettes.

Before the execution, Howard apologized to Swartout's family, who watched from a viewing room near the death chamber.

Halle Berry has completed a mandatory parenting program as she battles ex-husband Olivier Martinez over custody of their son ... TMZ has learned.

According to court docs obtained by TMZ, Berry signed a certificate Tuesday verifying she completed the Los Angeles Superior Court's "Our Children First" online mediation orientation and parent education program.

Per the court's website, parents are required to complete the court's online child custody mediation orientation and parent education program, officially known as "Our Children First," before moving forward with custody or visitation disputes.

Andrew and Tristan Tate are asking a federal judge to set bail so they can be released from prison pending trial.

According to court docs obtained by TMZ, the brothers filed a petition Wednesday seeking immediate release on bond. The court has refused to set bond pending the courts decision on whether to extradite them to the United Kingdom to face trial.

The Tates argue prosecutors have failed to show they are flight risks or a danger to the community. They claim they have no criminal history in the United States and complied with release conditions during their legal battles in Romania.

An attorney for one of the men accused in the Cornell 7 rape case is asking a judge to officially block New York Attorney General Letitia James from running the criminal investigation ... claiming her public comments create an appearance of bias.

Gillio Lopes' attorneys filed a petition Wednesday, asking the court to void Governor Kathy Hochul's appointment of James as special prosecutor or limit her personal involvement in the case.

According to court docs obtained by TMZ, James posted on the New York Attorney General's official social media September 28 ... just a few days before her appointment saying the alleged victim's experience was "horrific and unacceptable" and that she stood with her and "all survivors."

The former Cornell student who says seven Chi Phi fraternity brothers drugged and raped her claims folks are pressuring her to drop her civil lawsuit ... and they're threatening violence and even death.

According to the New York Post, Jane Doe has been hit with a barrage of threatening calls and texts since filing suit last month ... including gun violence threats against her family.

One alleged message reads, "Can't guarantee you'll be safe."

Another warns her to "withdraw the case" if she cares about her family ... and threatens, "Would you like to see [redacted]'s brains in front of [redacted]?"

Los Angeles County health officials are preparing to investigate the infamous "trash house" ... they'll be snooping around, evaluating the property for accumulated trash, sanitation problems, and evidence of vermin activity or infestation ... and they'd better bring some extra gloves.

The L.A. County Department of Public Health tells TMZ ... its Environmental Health division will conduct a "site investigation" after being alerted to the property's current conditions.

As we reported ... TMZ obtained new photos Wednesday showing the yard once again buried in trash and debris. Witnesses told us bugs were flying throughout the area.

The Jane Doe who says she was gang-raped by several members of Cornell's Chi Phi fraternity in 2024 says she felt "prostituted" during the alleged incident.

The former student made the comment to a Cornell panel several months after the alleged October 2024 sexual assault ... according to the transcript obtained by ABC News.

Jane Doe said, "I was prostituted, and I was held up like bait for a gaggle of men. I remember a dark room with shadows of men in and out constantly. And I remember feeling like there was a joke and I was not in on it."
