Diddy is firing back at federal prosecutors who are opposed to throwing out his conviction on Mann Act charges in his criminal case ... he says Uncle Sam is using the wrong definition of prostitution to prosecute him under the Mann Act, and says he deserves, at minimum, a new trial.

In new legal docs, obtained by TMZ, Diddy's legal team take shots at the feds as they try to make the case for Judge Arun Subramanian to change Diddy's Mann Act conviction to an acquittal or give him a new trial.

While Diddy's sitting in jail awaiting sentencing in his federal criminal case ... he can celebrate a win in a civil lawsuit filed by a guy who claimed the mogul drugged him and sexually assaulted him in a nightclub.

The lawsuit was filed back in February, and the plaintiff said he was an up-and-coming 23-year-old artist in 2015 when he scored a gig at an L.A. nightclub ... where Diddy was in attendance.

The alleged details sound like several other Diddy lawsuits -- the John Doe plaintiff claimed he'd been given a drink, fell unconscious and woke up to Diddy having "unwanted sexual contact" with him. In the lawsuit, filed by attorney Tony Buzbee, Doe also claimed Diddy threatened his future career if he resisted.

Federal prosecutors are calling BS on Diddy's attempt to throw out his conviction on Mann Act charges in his criminal case.

Prosecutors from the Southern District of New York filed new legal docs Wednesday, torching Diddy's motion to get his conviction on 2 counts of the Mann Act overturned or, if not, getting a new trial.  As you know, the Mann Act prohibits the transportation of individuals across state lines for the purposes of prostitution.

Diddy's lawyers previously pointed out he made ZERO dollars off prostitution and insist the Mann Act is usually designed for going after people running sex rings.

They also say Diddy never had sex with the male sex workers, and never directly arranged for their transportation, claiming he was merely a voyeur who enjoyed recording his ex-girlfriends having sex.

Marc Agnifilo -- the lead lawyer on Diddy's legal team -- tells us Diddy needs and wants therapy for both anger issues and substance abuse ... but says prisons aren't equipped to provide optimal help in those areas.

Harvey asked Agnifilo squarely -- will he ask the judge to place his client on home confinement rather than prison when he is sentenced, and he said that's on the table.

Sean "Diddy" Combs isn't going anywhere, at least for now ... he was again hoping for a taste of freedom, but the judge in his criminal case just denied bail, for the second time, pending his upcoming sentencing.

Judge Arun Subramanian ruled Monday against granting Diddy bail ... siding with federal prosecutors and keeping Diddy locked up at MDC Brooklyn as he awaits his October 3 sentencing for his conviction on a couple Mann Act charges.

In his order, the judge said there were no "exceptional reasons" warranting a release before his sentence.
