Sheriff: Richie Was 'Cooperative' -- DUH!
TMZ has received a statement from the L.A. County Sheriff's Department regarding the 82-minute incarceration of Nicole Richie:
On August 23 2007, at 3:15 PM Miss Nicole Camille Richie reported to CRDF and surrendered herself following a July 27 arrest, she was sentenced to serve 96 hours in County Jail. Miss Richie was accompanied by her attorney, Shawn Chapman Holley and her boyfriend Joel Madden. Miss Richie was booked and processed into the jail system. Miss Richie was cooperative during the process. Based on her sentence and federal court guidelines, Miss Richie was released at 4:37 PM today.

Just 82 minutes after Nicole Richie checked herself into Lynwood jail, she left a free woman. Hard time her ass!
According to the official website of the L.A. Sheriff's Dept., Richie checked in at 3:15 PM and was released at 4:37 PM. She was assigned to a cell for only 35 minutes! It takes longer to watch an episode of "The Simple Life" ... and it's more painful!
A Sheriff's source tells TMZ Nicole was routinely processed and released according to normal operating rules.
One of the more brilliant moves by Nicole's lawyer, Shawn Chapman Holley, who snuck Nicole in and out while everyone was focused on Lindsay. Well played!
Nicole Richie Checks into Jail
Talk about a smart move! Nicole Richie snuck into jail today to serve her sentence for DUI.
She was booked at the Lynwood Jail, where Paris did her time, at 3:15 this afternoon. Great move by her lawyer, Shawn Chapman Holley. While all the attention was focused on Lindsay, no one was watching Nicole.
Nicole is being processed right now. Her photo hasn't even been taken. A Sheriff's guy says she's still being processed.
Nicole was sentenced to four days in the pokey for driving the wrong way on an L.A. freeway while under the influence. She was given credit for 1 day because she was in the slammer for 6 hours after her arrest.
Because of overcrowding, it's possible -- but not certain -- Nicole will be a free woman when we all wake up tomorrow.
Miss Richie is pregnant with her first child.

Nicole Will Do Time at Paris' Big House
TMZ has learned Nicole Richie will do her time at the Lynwood jail -- the place Paris Hilton called home for 23 days.
Richie had the option of serving her 90 hours at a "private jail." These facilities are nicer than Lynwood, for sure, but there's a downside. When an inmate does time at a private facility, they must serve out the entire sentence. At Lynwood, the Sheriff could turn a 4-day sentence into a revolving door, because of the overcrowding problem.
Even if Nicole didn't go in and out, she would do much less than 4 days. She could enter Lynwood late one evening (as Paris did) and she'd get credit for an entire day. On top of that, there's "good time" credit that would shave a significant portion of the sentence.
We're told Nicole's lawyer, Shawn Chapman Holley, notified the Sheriff her client has chosen Lynwood. And Sheriff's spokesperson Steve Whitmore confirmed it.

TMZ was in L.A. County Superior Courtroom moments ago, where a pregnant Nicole Richie faced the music for her wrong-way DUI bust in December -- her second DUI conviction in 4 years.
A court commissioner sentenced Richie, represented by uber-lawyer Shawn Chapman Holley, to serve four days in the City or County Jail (her choice!) -- she got credit for one day, based on the six hours she served after being busted. So when she goes back in to the pokey, she'll only serve three days.
Richie was also fined $2,048, was ordered back to school for an alcohol education course and on three years probation.
Richie must report to serve her time by September 28.
The commissioner issued Richie a stern warning, telling her if she drove drunk again and she actually killed someone, she could be charged with murder -- not manslaughter. That's because after her first DUI, Richie agreed that if she drove under the influence and killed someone, she'd be nailed for murder.
The 25-year-old is expected to give birth sometime in January.
A source close to Richie said at today's sentencing she was "stoic and serious, but not emotional."
Richie Can't Keep Up With Paris
It's not quite the scene created by Paris, but things are getting pretty crazy outside of the L.A. County Superior Court where Nicole Richie is set to face the judge over her December wrong-way DUI.

Nicole Will Do Time
TMZ has learned Nicole Richie will appear in court Friday and will cop a plea in her DUI case.
Sources tell TMZ Richie will plead either guilty or no contest to DUI. She will appear before the Court Commissioner, who will sentence her on the spot. Sources say Richie will receive a minimum sentence of five days in jail. By law, anyone with two DUI convictions must serve at least five days. This conviction will be Nicole's second DUI.
Nicole was arrested on December 11, after cops say she drove the wrong way on a California highway.

Shakira Staten gave birth to a baby girl on July 10, the day before her 22nd birthday, according to the Times-Tribune. The paper goes on to say that a female guard cut the umbilical cord with her fingernails. Now that's what we call hard labor!
Nicole's DUI case, which originally scheduled for July 11, is now set to begin on August 16. She faces a minimum of five days in prison if convicted.

Sources tell TMZ the test that allegedly proves Nicole Richie was under the influence was a urine exam-- not blood.
In a declaration filed today and obtained by TMZ, Nicole's lawyer, Shawn Chapman Holley, challenged the urinalysis on grounds that it's unreliable -- blood is generally considered the more accurate test.
The cops say Nicole confessed that she had taken Vicodin and smoked pot before driving the wrong way on an L.A. Freeway last December.
Richie Gets a Break -- For Now

The commissioner in Richie's DUI case has just granted a continuance, pushing her next court date back to August 16. He also ordered Nicole to appear in court on that date.
Richie's lawyer, Shawn Chapman Holley, requested the extension for an expert witness who was unavailable for today's trial date due to vacation plans. As TMZ first reported, Dr. Terence McGee will challenge the results of Nicole's drug test.
