Charlie Sheen's latest rant shockingly has not incited Brooke Mueller or the L.A. County Department of Children Services into running to court for a contempt citation ... but when Sheen comes face to face with "Judge Anus" it could be a whole different story.

Multiple sources involved in the case tell TMZ ... Charlie's Twitter rant Friday night -- in which he railed on Brooke, DCFS and the judge -- CLEARLY violates the gag order but they don't feel the need to have Charlie thrown in jail.

Our sources say Brooke's reasoning is that it's not her place to put Charlie in the pokey. As for DCFS ... they think it's simply evidence that Charlie is psychologically imbalanced.

The judge is a different story. As we first reported, hizzonor made it clear this week to Sheen ... if he opened his trap about the case one more time he's going to jail. Now that Charlie has called the judge "Mr. I'm Italian judge anus-brain" it seems almost certain Charlie has forced the judges hand.

Charlie Sheen just violated the gag order in his custody case in a spectacular way, calling the judge Mr. "I'm Italian judge anus-brain," and threatening him if his kids are hurt in the newest custody configuration.

It's something of an understatement to say Charlie is not pleased that the judge just made Brooke Mueller's brother Scott the temporary guardian of twins Bob and Max. The judge also allowed Scott and the kids to live with Brooke so they could be close to school. That effectively puts Brooke back in the position of having full custody while she tries to beat her latest drug abuse problem.

Charlie just tweeted, "So lemme see if I got this straight ... my twin boys are now in harm's way and in grave danger, being 'raised' by a gaggle of incompetent and lascivious marionettes all ruled and fooled by an Adderall snorting husk called Brooke."

Now it gets good ... "And guess what CPS and 'I'm Italian' judge anus-brain, you may have gagged me temporarily, but mark my unspoken words, anything happens to my boys, and you will get to know me, know who I truly am, a loving father."

He ends, "Tag -- I'm it."

The judge just hauled Charlie into court a few days ago, telling him he's going to jail if he violates the gag order again.

Suri Cruise has the confidence and maturity that far exceeds the norm for a 7-year-old ... so says Suri expert Tom Cruise.

In his deposition in the defamation case, Tom says Suri is a good communicator, which allows him to have meaningful conversations with her when he's not with her.

But more than that ... Cruise swore under oath ... his daughter is "confident" and has "a good sense of herself."

Brooke Mueller loves her kids, but her feelings over custody seem to have a direct correlation to how much money she was getting from Charlie Sheen.

Here's what we know ....

-- Before Brooke lost custody of her kids, she was getting $55,000 a month from Charlie.

-- In May -- after DCFS removed twins Bob and Max from her house and gave them to Denise Richards under a guardianship -- Brooke fought tooth and nail to change the arrangement so that her brother Scott would get the kids. Sources familiar with the situation say Brooke wanted Scott because she'd be less likely to lose her child support if he had them.

-- In June, our sources say Brooke changed her tune with Denise, because there had been no movement to alter child support. We're told Brooke was downright cordial to Denise -- even grateful.

-- Everything changed in July, when Charlie filed legal docs to cut off Brooke's child support. Brooke was fighting Charlie, while Denise watched the kids.

-- In September, the family court judge cut Brooke's child support IN HALF. We're told the judge said Brooke could get the full amount back when she had the kids for a certain number of hours per week. Sources say that's when Brooke declared WAR on Denise, saying she was brainwashing the boys against her and scheming with Charlie to hurt her.

Brooke Mueller's got her hands back on her and Charlie Sheen's twins -- picking them up from school today and bringing them to her home ... for the foreseeable future.

As we reported, the judge ruled 4-year-old Bob and Max will move in with Brooke along with Brooke's brother Scott, who is now the legal guardian.

Scott became the temporary owner of the twins after Denise Richards said she could no longer care for the boys -- because they had become violent with her daughters and because she couldn't handle Brooke's craziness.

The L.A. County Dept. of Children and Family Services has opened a fresh investigation into allegations that someone hurt Bob, one of Charlie Sheen and Brooke Mueller's twins ... and we've learned Brooke is pointing the finger at Denise Richards.

Sources familiar with the situation tell TMZ ... Brooke reported the incident over the weekend, just after Charlie appeared on TMZ Live and railed on her. We've learned Brooke told DCFS ... there was a cut on Bob's back that was deep enough to scab over, and she said it happened on Denise's watch.

As you know ... Denise was the guardian of the twins while Brooke tried to beat her latest bout of drug abuse. Denise threw in the towel yesterday, saying the kids were too violent, and now Brooke's brother Scott is the guardian.

We're told social workers went to Bob's school and determined the cut had been there for more than a week, which means it could have happened while Bob was under Brooke's care. DCFS then interviewed Denise, who said the cut had been there for more than a week.

Our DCFS sources say the timing of Brooke's complaint is suspect because the accusation came on the heels of Charlie attacking her on TMZ Live.

Katie Holmes and Suri Cruise went to the mountaintop ... but were forced to come down ... though certainly not as dramatically as her ex-hubby would do it.

Katie had some downtime from shooting "The Giver" in Cape Town ... so she took Suri to Table Mountain -- a famed tourist spot with stunning views. It's one of the new 7 wonders of the world.

Turns out it was a bad day for sightseeing. It was cloudy, windy and cold, making it almost impossible to see in front of your face.

Suri was clinging to her mom while they waited for a cable car to take them down.

Tom surely would have strapped her to his back and rappelled down the mountain. After all, that's the way they do it in Afghanistan.

Charlie Sheen is going nuts over the judge's decision to give Brooke Mueller's brother Scott guardianship of their twins and then allowing her brother and the kids to live at her house -- a house Charlie owns.

What Charlie is telling friends is choice, so it just can't be paraphrased. Here it goes ...

-- "This pig circus overflowing with buffoons, sycophants and heretics cannot be trusted to safely raise a colony of ferrets."

-- "Brooke will fail and her brother [who lives by the beach] will be selling his ass under a pier and the evil nanny will die from ugly."

-- "When, not if, this psychotic and desperately irresponsible sham goes sideways, DCFS will burn to the ground, topped off with the smoldering robe of the judge."

The change of guardianship that just went down in the Charlie Sheen/Brooke Mueller custody war has just taken a radical turn -- TMZ has learned Scott Mueller, the new guardian, and the kids will be moving in with Brooke.

Sources connected with the case tell TMZ ... the judge who granted the guardianship today felt it was important for the kids to stay in the same school. Scott lives far away in a beachside community, so the judge ruled he could move in with Brooke.

This is hugely significant, because the L.A. County Dept. of Children and Family Services has NOT given Brooke full custody rights. DCFS felt it was important to gradually reintroduce the kids to Brooke, because of her drug problems. But now it's as if she has full custody again.

In effect, Brooke is getting the kids back along with a babysitter.

There has been a changing of the guard ... Brooke Mueller's brother, Scott, has just gone to court and won temporary guardianship of Brooke and Charlie Sheen's twins Bob and Max ... TMZ has learned.

As TMZ first reported ... Denise Richards -- who had temporary guardianship -- made it clear to the L.A. County Dept. of Children and Family Services during a meeting Thursday -- she could no longer handle Bob and Max because they were violent toward her daughters.

We've learned DCFS has signed off on Scott becoming guardian. We're told he will get the children tonight.

Story developing ...

Tom Cruise admitted that Katie Holmes left him partly because of his ties to Scientology.

Cruise sat for a deposition in his $50 million libel suit against a magazine company that claimed he abandoned his daughter Suri.

In the deposition ... Cruise squirmed in his chair as the lawyer for the magazine repeatedly asked if Katie fled their marriage because of the Church. Cruise hemmed and hawed, suggesting it wasn't true, and then the lawyer asked whether "Katie Holmes left you in part to protect Suri from Scientology."

Cruise answered: "Did she say that? That was one of the assertions, yes."

Cruise also admitted that Suri is NOT a member of Scientology anymore.

The story that triggered the lawsuit claimed Tom abandoned his daughter. In his depo, Cruise says for the period between June 18, 2012 and Thanksgiving, 2012, he estimates he only saw Suri 10 days. During one stretch ... Tom admits he didn't see his daughter for more than 100 days.

The lawyer for the magazine grilled Tom about his desire to see Suri. The lawyer pulled out aviation documents showing Tom flew from Pittsburgh to London on Oct. 15 for the International Association of Scientology convention. Tom returned to Pittsburgh the next day. Tom said it was very important to attend, and then the lawyer made it clear Tom never took such quick trips to see Suri.

And in another part of the deposition, the magazine's lawyer brought up the part of the story in which they claimed Suri was "upset and crying a lot" when Tom was absent. In the depo, Tom admits being absent, but adamantly denied Suri was upset.

Denise Richards told the L.A. County Dept. of Children and Family Services ... she cannot care for Bob and Max, the twins of Charlie Sheen and Brooke Mueller, because she claims her own kids are in danger and she feels Brooke is insane ... sources tell TMZ.

TMZ broke the story ... Denise and Brooke had a sit-down Thursday with Dr. Charles Sophy, the DCFS Medical Director. We're told Denise told Sophy what we reported ... that Bob and Max were violent and attacked her daughters numerous times. She said she couldn't control the twins and could no longer serve as temporary guardian.

Sources say Denise told Sophy what we reported ... that the only way she would continue on as guardian is if the kids got the psychological help Brooke had blocked.

Our sources say Sophy has not given up ... he believes there is still room to keep Denise in the game.

Part of Tom Cruise's lawsuit against two tabloids reads like one of his spy movies -- with Tom's publicity team accusing Katie Holmes of espionage ... as in working directly with the tabs to publish stories skewering Tom as a horrible father.

In emails to Tom's legal team ... his publicist Amanda Lundberg fingers specific people in Katie's camp -- including publicists and hair/makeup people -- for feeding stories to "In Touch."

Amanda accuses her #1 suspect of "speaking to the press constantly. She is the one saying -- K[atie] is disciplinarian and T[om] is spoiling and so on."

Amanda also directly accuses Katie's publicist, saying ... "leslee sloan [sic] calls the paparazzi every time K gets ready to leave the building as the doormen are always surprised how they suddenly show up when she is about to leave."

The emails were submitted as part of Tom's $50 million suit against the publisher of "In Touch" and "Life & Style" ... for allegedly defaming him with headlines about him abandoning Suri after the divorce.

Tom's publicist Amanda also emailed Katie's people directly, accusing them of remaining silent about a story that claimed Tom broke a promise to Suri. In the email, Amanda demands ... "Can you guys comment and deny this as we all know this is not true."

At the end of the email Amanda begs ... "Help?!!!"

In short, Tom's people are bitching that Katie's people play dirty pool ... allegedly planting negative stories ... or refusing to blunt the ones they know to be false.

Truth is ... this kinda thing happens every day behind the scenes in Hollywood.

Here's something you didn't know about Sum 41 singer Deryck Whibley -- he took Avril Lavigne's last name when he married her, and now ... 3 years after divorcing her he's finally sick of it ... because he's filed legal docs to drop it.

Deryck Jason Lavigne Whibley just filed in L.A. County Court to go back to his birth name ... sans Lavigne.

It's pretty crazy -- A) because he took her last name in the first place and NO ONE KNEW, and B) because it took him so long (FOUR YEARS) to switch it back.

Whibley and Lavigne got hitched in 2006 and divorced in 2010.

To review: Deryck ended up stuck with Avril's last name -- and Avril ended up ... stuck with Chad Kroger.

It's a toss up who got the worst end of that deal.

Brooke Mueller and Denise Richards were actually cordial with each other during a mandatory sit-down with a chief honcho from the L.A. County Dept. of Children and Family Services ... but the drama is far from over ... TMZ has learned.

As we first reported ... Denise and Brooke showed up at an L.A. courthouse today and met with DCFS Medical Director Dr. Charles Sophy. We're told Sophy also asked Charlie Sheen to attend the meeting, but Sheen declined.

Sources familiar with the situation tell TMZ ... although the 2 warring women were not openly hostile toward each other, their problems were NOT solved during the 4-hour session. We're told Denise is still waffling on whether she'll continue to serve as temporary guardian for twins Bob and Max.

Here's what our sources say happened in the meeting:

--- Sophy did a lot of clarifying as to what the goals were -- specifically, to gradually "reunify" Brooke with her kids

-- Sophy made it clear the goal is not for Denise to keep custodial control over the twins. Her role would diminish as Brooke became stronger and able to provide parenting. We're told this will be a slow process and Sophy established more specific guidelines as to how it will happen

-- There was an acknowledgment by all that Bob and Max have been significantly damaged psychologically by the turmoil in the family

-- There was also an acknowledgment ... there is no "magic bullet" to solve their emotional problems

-- Charlie is NOT being looked at as an option for custody

-- As for Denise, she still feels Brooke is interfering with the proper treatment of Bob and Max, and fears the twins will physically hurt her daughters

-- We're told there was no evidence Brooke has lapsed back into drug use

We're told no follow-up meetings are scheduled with Sophy and the women. We're told DCFS social workers will now take over. As for when Brooke gets full custody -- currently she's getting 2 overnights a week and 3 days. We're told the process of full custody will be fairly slow.
