Kelly Rutherford and Daniel Giersch are at war over their kid, Hermes. The judge presumably will decide today whether Kelly can travel to NYC this weekend with the kid to film the show. Giersch doesn't want Rutherford to travel with the kid because he says she gets all crazy when she films and the kid is a basket case.

Rutherford got emotional after yesterday's hearing.

Attention golddiggers: 85-year-old Sumner Redstone is back on the market. His divorce became final yesterday.

Forbes reported Redstone was worth $7.6 billion in 2007. So even if he's lost 80% of it, it's still more than a billion, ladies ... and he's 85 for God's sake.

Here's how nasty the Kelly Rutherford/Daniel Giersch divorce has gotten -- they're bickering over who doesn't wipe their kid.

In legal papers filed today, Giersch claims he tried to potty train their son, Hermes, early on but Rutherford took his mini-toilet seat away and hid it and did not "encourage him to use the toilet."

Giersch adds, "I have witnessed that she does not always keep his bottom clean."

And there's more. Giersch says it is not "reasonable or appropriate for [Rutherford] to be breast feeding when he is nearly 2 1/2 years old."

As if to punctuate his point, Giersch says the kid is old enough to be fluent in German.

Kelly Rutherford, who plays Lily van der Woodsen, was in court this morning, asking an L.A. County Superior Court judge to green light her request to bring her two-year-old son Hermes to NYC to begin filming this coming Sunday.

Standing in her way -- estranged hubby Daniel Giersch -- who claims the kid is a basket case when he goes back to New York because Kelly gets crazy with her work schedule. Kelly says she's been taking the kid back and forth for a long time and it's no problemo.

Kelly Rutherford, who plays Lily van der Woodsen on "Gossip Girl," claims her husband is ominous, violent and bad news for their kid.

Rutherford filed legal papers that the judge will consider tomorrow in a showdown hearing. Rutherford's estranged husband, Daniel Giersch, wants the judge to prohibit his soon-to-be ex-wife from taking two-year-old Hermes to NYC to film the show.

Rutherford claims Giersch has gotten into blowout arguments with her, in one case allegedly coming at her. She says he's an avid boxer and kickboxer and she is "intimidated by him."

She also says he's threatened to teach her a lesson by taking the child. She says it's gotten so bad she called the cops twice and he's been forced to leave.

Giersch has claimed the kid is totally stressed out around Rutherford and that she can't be a real mom because her shooting schedule is insane. She says it's just not true.

Denise Richards could take lessons from the wife of Miami Heat guard Dwyane Wade when it comes to the airing of dirty laundry.

According to docs from recent divorce proceedings Siohvaughn, Wade's soon-to be-ex wife, has a few minor complaints which include child abandonment, adultery, and the case of a nasty little STD infection she allegedly received from him.

She also alleges their one-year-old doesn't even recognize the baller because he's been so absent from the two kids they share. Siohvaughn is demanding the names of every one of his alleged sexual partners during their marriage, and it's no secret that actress Gabrielle Union -- Wade's rumored GF -- could possibly end up on that list.

According to the Miami Hearld, Wade's lawyer claims all allegations are false.

Now here's the problemo. Sources on "Gossip Girl" tell us Kelly is supposed to be in New York to shoot by January 27. If the judge shuts her down next week that's not going to happen. Producers could deal with a small delay and shoot her out of sequence, but if the delay is longer they could just shoot her -- as in her character.

In court papers, report People, Rutherford wants to bar her estranged husband David Giersch from leaving the country with their two-year-old son, alleging he's a flight risk and could vanish with the child overseas. Giersch, on the other hand, charges Rutherford has anger issues, claiming Kelly tossed a laptop at him and has tried to "hit him with an open fist."

Kelly filed for D on Jan. 2.

Things really are looking up for Amy Winehouse -- her junkie, jailed husband wants a divorce.

Blake Fielder-Civil's lawyer, Henri Brandman, told us he's getting the wheels turning on divorce papers. Amy has been spotted hooking up with a 21-year-old dude while vacationing in St. Lucia, according to the Daily Mail.

Amy just admitted in an interview that she's "forgotten I'm even married" and that their "whole marriage was based on drug use."

Fathers, lock up your daughters: R. Kelly is now officially a free man.

His lawyers announced yesterday Kells and his wife of 11 years, Andrea Lee, have split for good, and among other things, will share custody of their three kids. The couple filed for the big D in 2006, and Andrea had filed an emergency protective order back in 2005 against R., which she ultimately pulled.

One of the chicks from "The Real Housewives of Atlanta" is raising hell over her multi-million dollar divorce settlement -- claiming she needs more cash to compensate for her total lack of brain power.

Sheree Whitfield -- who was married to former NFL lineman Bob Whitfield -- just filed an appeal with the Georgia Supreme Court. According to a court spokesperson, Sheree's lawyers argued she was wrongly denied alimony and needs it because she lacks the education and skill set to make good money on her own.

Under the original settlement agreement, Whitfield received a $775,000 lump sum, more than $1.1 million in marital property, a portion of Bob's NFL retirement plans and $2,142 a month in child support -- but no alimony.

Bob's attorney claims the $113,422-a-year he's required to give her is enough -- and claims Sheree should be fined $2,500 by the court for wasting everyone's time.

And you thought the radioactive Christie Brinkley-Peter Cook divorce was over. Not quite.

Cook's lawyer told us he filed contempt of court papers yesterday against Christie, claiming she didn't hand over son Jack's passport back in November, thereby preventing him from being able to take a school trip to Egypt. They claim she broke an agreement to hand over the passport on or before Nov. 19.

Two things here: Peter Cook calling out anyone for being a bad parent, and ... who takes a field trip to Egypt?

The woman who plays serial divorceé Lily van der Woodsen on "Gossip Girl" is imitating her character -- she's filed for divorce. Oh, and she's pregnant.

TMZ obtained legal papers filed December 30 in L.A. County Superior Court. Kelly Rutherford is asking a judge to end her marriage of two years to Daniel Giersch, citing "irreconcilable differences." In addition to a child on the way, they have a two-year-old son, Hermés Gustaf Daniel Giersch.

It's Kelly's second marriage, which gives you an idea why she was cast.

Jodie Sweetin is not allowed to see her 8-month-old daughter without supervision.

Moments ago, an Orange County, Ca. judge made the explosive ruling after Sweetin's estranged husband Cody Herpin accused the "Full House" star of being an unfit mother -- citing an alleged incident where Sweetin drove intoxicated with their baby in the car.

The couple faced off in open court today for an emergency custody hearing at Cody's request.

Jodie, an admitted meth addict and alcoholic who lives with her parents, will not be allowed to be with the child unless one of her folks is present.

A doctor also took the stand and claimed that Jodie had recently fallen off the wagon. However, the doc confirmed Jodie has been in touch with her sponsor and is attending AA meetings. The doctor said she does not believe the baby is at risk at the moment.

Jodie Sweetin is locked in a custody battle so ferocious that her estranged husband called for an emergency hearing this morning to get access to their 8-month old daughter ASAP.
