Jon Gosselin -- The Check's in the Mail
TMZ has learned at 1:23 PM ET -- 30 minutes ago from the time of this post -- Kate Gosselin's lawyers received an email from Jon Gosselin's Pennsylvania lawyer stating that he has $152,000 from Jon that will repay Kate for the money he looted from the joint account.
As we first reported, the judge in the case ordered Jon to repay $180,000 -- Jon has already repaid $28,000 so the balance is $152,000.
Under the terms of the judge's order, Jon is required to wire the money to Kate's lawyers. That has not been done yet.
Kate's lawyer, Mark Momjian, tells TMZ if he gets the money today he'll cancel the court hearing on Monday.
There's another $55,000 in dispute. Jon says Kate had no right to take the money. Kate says she spent it on household matters. The arbitrator will decide who's right at a later date.
Gosselin's Lawyer Formally Up a Creek
Jon Gosselin may be on the hunt for a new lawyer soon, because we've learned the person who sponsored New York attorney Mark Heller to appear on Gosselin's behalf in Pennsylvania has formally made a motion with the court to withdraw his support.
Attorney Mike Marino filed his motion today, saying he wants to wash his hands of the whole case. Marino told us he had never had contact with Heller until Mr. Heller found him in a legal directory, cold called him and asked Marino to sponsor him for a one-time-only case -- Jon vs. Kate.
Marino says he had never heard of "Jon & Kate Plus 8" when he agreed to sponsor Heller. As Marino put it, "I don't watch that kind of junk on TV."
The judge will schedule a hearing on Marino's motion. We also learned Marino sent the judge a letter last week requesting out of the whole case.
If Heller doesn't find a new sponsor, he can't practice in PA.

Jon Gosselin -- Overpay for Play
UPDATE: The MJ Show just posted the email exchange they had with Gosselin's rep. Click here to read it.
Jon Gosselin sincerely believes his time and energy is worth somewhere around $12,000-per hour -- because that's how much he's demanding to appear on a Florida radio show.
TMZ spoke with the host of Tampa's MJ Morning Show who told us he contacted Gosselin's rep in the hopes of booking the reality star to guest co-host the show for one morning.
The radio show offered two first class round trip plane tickets, limo service and a "first class" hotel room -- but that wasn't enough to seal the deal.
Gosselin's rep requested an "appearance fee ... in the 10-12K range."
Team Gosselin justified the amount by saying, "[Jon's] name and appearance on your show will instantly draw press ... and will be a high point for the show." The rep also describes Gosselin as "quite funny, sharp witted and interesting."
The radio host tells us he "fell out of his chair" when he read the demand. Looks like Jon will have to go back to "Entertainment Something" to lock down that kind of money.

TLC to Jon -- Pants on Fire!
TMZ has obtained a copy of the lawsuit TLC just filed against Jon Gosselin, and the network is essentially saying Jon is a liar by now claiming he stopped production because he's concerned about the welfare of his kids -- TLC says Jon is concerned about the welfare of Jon.
According to the suit, filed by Paul Gaffney of the law firm of Williams & Connolly in DC, the day TLC recast the show as "Kate Plus 8," Jon's lawyer contacted TLC and demanded that they release him from the "exclusivity" provision of the contract, even though Jon was still drawing a full salary. The suit claims Jon's laywer gave an ultimatum -- either release him from the exclusivity clause within one hour, or Jon would block the filming of the TLC show on grounds it was "detrimental to his children."
TLC notes Jon never uttered a peep about how bad the show was for his kids, until it affected his pocketbook.
And, TLC claims Jon is pulling in some serious bucks from "Entertainment Tonight" -- aka "Entertainment Something."

Jon Gosselin Ordered to Return $180,000
TMZ has learned Jon Gosselin has been ordered to return $180,000 in marital funds, which were removed in violation of an arbitrator's order.
According to Kate's lawyer, Mark Momjian, "The remaining sum of $55,000, which Ms. Gosselin used for household bills and expenses relating to the children, will be subject to further determination by the arbitrator at a later date."
Jon is required to repay the loot by October 26 -- the next hearing -- or appear before the judge for a contempt proceeding.
The judge also ordered Kate to provide an accounting of past expenses -- also due by Oct. 26.
Kate says, "As difficult as this has been for me, I am pleased that the Court has ruled fairly on behalf of myself and my children. Now that this matter has been ruled on, I look forward to returning to private arbitration, as we have agreed to do, to resolve any remaining issues."
Judge to Jon & Kate -- Settle this Mess!
The judge in the Jon and Kate Gosselin divorce clearly has had it up to here ... he didn't rule on any of the epic conflicts but ordered Jon and Kate to settle up and work it out with the arbitrator. The judge said he'll be down with anything the arbitrator decides ... with one provision -- it has to be in the best interests of the children.
The judge said any monies taken improperly from the joint account should be returned, but he didn't get specific. He also admonished Jon and Kate to keep things "private" and "amicable." Good luck with that.
Before the short open hearing, lawyers met with the judge in chambers for about an hour but no settlement was reached.
They're due back in court on October 26.
Jon & Kate Plus a Court Date
UPDATE: The brief hearing is over -- Jon and Kate are due back in court on October 26.
Jon & Kate Gosselin walked into Montgomery Courthouse in Pennsylvania just moments ago -- separately -- ready to battle over the $230,000 Jon allegedly withdrew from the bank account he shares with Kate.
Jon has fired back at Kate -- filing papers claiming she withdrew over $60,000 from their joint account this year without permission ... and that there's over $1 million that hasn't been properly accounted for.

Lawyer Says Jon & Kate -- 'So Insignificant'
Under the category, "No Good Deed Goes Unpunished" ... the lawyer who stepped in to vouch for Jon Gosselin's attorney has some deep regrets today, over a case he says is "so insignificant to me."
As we first reported, attorney Michael Marino was contacted by Jon's lawyer, Mark Heller, asking for help to get admitted to the Pennsylvania Bar on a one-time-only basis. Marino tells TMZ he had never met or spoken with Heller before and thinks Heller randomly pulled his name out of a legal directory.
Marino says he agreed to do a solid for Heller and sponsor him so Heller could get permission from the judge to rep Jon.
Marino says at the time, he had no idea who Jon and Kate Gosselin were -- "The names didn't mean anything to me," Marino said, adding, "I thought it was some simple divorce case where some lawyer wanted to be introduced to the court."
Marino, who is semi-retired, says "I don't watch that kind of junk on TV. It was so insignificant to me." Marino told us when he realized the divorce was a contested mess, he wanted out, and it had nothing to do with the fact that Heller had been suspended by the New York State Bar for a variety of misdeeds.
Heller withdrew his sponsorship this past Thursday. The ball's in your court, Mark.

Jon Fires Back at Kate -- You Took $$$ Too!
In football, if both teams commit a penalty on the same play, they just do the play over. Does the same thing apply when Jon and Kate Gosselin both allegedly violate a court order?
A few days after Kate claimed Jon raided their joint bank account (a legal no-no), Jon filed papers of his own claiming she did the same. According to the papers filed last week, Jon claims Kate withdrew over $60,000 from their joint account between July and September 2009.
He also claims she took out over $1 million from February 2008 to June 2009 that have not been properly accounted for.
Sources connected to Kate contend her withdrawals were legal and note that Jon withdrew $230,000 without the necessary permission required by the arbitrator. Both sides are due back in court on Tuesday.
