Update

12:41 PM PT -- Lindsay Clancy's attorney, Kevin Reddington, spoke to the media after a Massachusetts Supreme Judicial Court justice upheld the mistrial ... blasting investigators and the District Attorney Tim Cruz.

Kevin also called Lindsay a wonderful woman who is going through a very difficult time now ... before thanking the 11 jurors who came to a consensus -- and singling out the 12th for robbing them of their verdict.

Worth noting ... Cruz said Friday his office will not decide today whether to retry the case or not.

11:20 AM PT -- The mistrial will stand in Lindsay Clancy's trial. The State Supreme Court Justice rejected Reddington's motion to overturn the mistrial.

10:05 AM PT -- The judge has given the defense another hour to go before the State Supreme Court and argue the mistrial should be overturned.

We know the defense has filed legal docs with the SC, but it is unclear if the Court will hear the matter. It is likely that one SC Justice will look at the defense petition and make a decision, at least temporarily, until the full Court can hear the case.

A clerk for the SC just told TMZ ... the Court will hear the defense's motion to overturn the mistrial.

Lindsay Clancy, her lawyers, the prosecution, and the judge headed back to the courtroom soon ... and we're live streaming it all.

The trial's principals are back after the judge's shocking deadline to her attorney -- Kevin Reddington ... giving him just an hour to go to the Massachusetts Supreme Judicial Court to petition a justice to overturn the judge's mistrial decision.

DELIBERATING..AGAIN!

As we reported ... Judge Sullivan sent jurors back into the deliberation room Friday morning -- but they emerged a short time later and once again said they were deadlocked. He declared a mistrial, then gave Reddington one hour to get someone above his pay grade to change his mind.

Update

10:50 AM PT -- The Massachusetts Supreme Court Justice has heard arguments from both sides, and will make a ruling ... and she says she'll do it pretty quickly. Stay tuned, because she could be back within just a few minutes.

The Supreme Court of Massachusetts has agreed to hear Lindsay Clancy's argument to block the trial judge from declaring a mistrial, and we are livestreaming in the Supreme Court.

Clancy's lawyer, Kevin Reddington, is trying to block the mistrial, arguing in part the holdout juror is not following the law concerning reasonable doubt ... at least so claims the jury foreman.

The vote is 11 - 1, and although we do not know what specific charge is behind the vote, it seems somewhat likely the 11 may be voting not guilty by reason of insanity.

LETS TAKE IT TO THE SUPREME

The jury in Lindsay Clancy’s murder case was unable to reach a verdict, and the judge just declared a mistrial.

They deliberated for 38 hours ... 2 hours after the judge said the lone holdout could remain on the jury.

The jury has sent the judge a note ... saying it was with a heavy heart that the jury could not reach a unanimous verdict.

The judge said after sending the jury back twice, he was required by law to declare a mistrial.

Clancy's lawyer, Kevin Reddington, argued the judge had discretion to make the jury press on, but the judge rejected the argument.

DELIBERATING..AGAIN!

Lindsay Clancy's fate remains unsettled, after the judge ruled the holdout juror will remain on the case.

Clancy's lawyer, Kevin Reddington, was clearly upset, challenging the judge that he was not considering the concern of 11 jurors that the holdout is violating the law by not properly considering reasonable doubt. The judge fired back ... he has sufficiently probed and believes the holdout is fit to serve.

When the jurors walked in, and the judge was speaking to them about following the law, the female jurors were nodding their heads in agreement. The male jurors were not nodding.

Update

12:32 PM PT -- Lindsay Clancy's attorney, Kevin Reddington, asked the judge to remove a juror who "refuses to listen to the law" regarding reasonable doubt. According to Reddington -- who is citing the foreperson -- only one person is dissenting in the jury. Redding also made his displeasure with the way the judge handled the issue known in court.

The judge refused to remove the juror despite Reddington's objection.

12:29 PM PT -- A bizarre moment in court ... the judge brought the jury back in as a group after speaking to each of them as individuals -- before providing a thorough definition of what "beyond a reasonable doubt" means. The judge did not read the note the jury sent into the courtroom.

He then sent the jury back to deliberate more. They've been discussing the case for nearly 36 hours at this point.

The jury has given the judge a note and the participants in the courtroom are back inside.

Lindsay Clancy's lawyer, Kevin Reddington, is very upset and just slammed papers down on the table ... we do not know if there is a mistrial. We will let you know as it comes in.

The argument between Reddington and the judge has gotten more intense. Reddington is visibly upset and is arguing very heatedly at the trial judge. The judge is raising his voice. They are going back and forth waving their hands. Prosecutors looked close to tears during the sidebar.

DONT STOP DELIBERATING

Jurors in the Lindsay Clancy murder case told the Judge Tuesday morning that they can't reach a unanimous verdict on any of the counts, but the judge isn't ready to throw in the towel.

The jurors deliberated for 18 hours before they threw their hands up in the air. Jurors are trying to decide if Clancy is guilty of murder, manslaughter, or not guilty by lack of criminal responsibility. The lack of criminal responsibility is essentially an insanity defense.

It's clear some of the jurors were entertaining the lack of criminal responsibility defense when they asked to see the knife she allegedly used to slash herself and the pill bottles.

The jury has gone back to deliberate.

As we previously reported ... Clancy’s defense attorney, Kevin Reddington, has argued she was suffering from postpartum psychosis when her three children -- Cora, Dawson and Callan -- died at the family's Massachusetts home in January 2023.

Prosecutors maintain Lindsay was criminally responsible.

Lindsay has pleaded not guilty ... however, she acknowledges killing the children. Her ex-husband Patrick Clancy has already taken the witness stand, describing the devastating discovery of his children and his call to 911 which was played in court.

Now, by order of the judge, Lindsay's fate still remains in the hands of the jury ... if they can ever come to an unanimous agreement.

Lindsay Clancy Scared ... But I'm Optimistic!!! As Jury Deliberates

Lindsay Clancy is "scared" and "nervous" as the jury deliberates her case ... at least according to her lawyer.

Kevin Reddington said on Thursday Lindsay is worried as the jury entered their first day of deliberations ... but he remains optimistic.

As he left court, he stated ... "I think that they have to weigh all of this evidence, and I believe that the government ultimately has not proven their case."

The jury began deliberating earlier in the day about whether or not Lindsay is criminally responsible for the deaths of her 3 kids.
