The suspect in the Planet Fitness Peeping Tom case is still walking the streets ... and it's all because of a technicality in California state law.

Jeremy Burns -- a spokesperson for the Arroyo Grande PD -- tells TMZ ... police haven't been able to arrest Kyle L. Combs yet because his alleged crimes are considered misdemeanors in California.

According to Burns, officers can only make a misdemeanor arrest when they witness the offense firsthand ... the alleged evidence in the case isn't enough.

TMZ obtained court documents showing Tigger's wife, Alicia Brown, was granted a temporary protective order Wednesday after asking a Fulton County judge for protection.

In her petition, Brown claims the former "Rap City" host -- legal name Darian Morgan -- slammed her head into a door during a May altercation that allegedly left her needing stitches.

Cops say a Peeping Tom filmed dozens of women without their knowledge at a Planet Fitness in California ... and now police are putting the suspect on blast.

The Arroyo Grande Police Department identified the suspect in the "electronic peeping" case as 40-year-old Grover Beach man Kyle L. Combs.

Multiple outlets report cops were able to ID him from surveillance video and witness reports.

TMZ obtained the radio host's smug mug shot ... showing him sporting a slight grin.

As we previously reported ... according to police records, the longtime radio personality and former host of BET's iconic "Rap City" was booked into the Fulton County Jail Saturday morning, but bonded out later in the day.

Officials with the jail tell us Tigger was released after posting surety bonds totaling $10,000 ... including a $9,000 bond tied to the aggravated battery charge and a $1,000 bond related to the cruelty-to-children charge.

According to documents, the incident traces back to a dispute in May between Tigger and his wife, Alicia Brown, at their Sandy Springs home.

Brown told investigators the argument erupted over text messages Tigger allegedly exchanged with a female co-worker over several weeks ... according to local outlet WSB-TV.
