Problem is ... it's not all bulls**t. TMZ published a recent letter from Kelsey's lawyer to Camille's lawyer -- in which Kelsey proposes taking primary custody of their son ... while Camille takes primary custody of their daughter.

Melissa Binzer filed the divorce docs in L.A. County Superior Court recently -- citing irreconcilable differences.

But here's the interesting part -- they share a 7-year-old son, who has type 1 diabetes. Melissa claims Shifty has no idea how to take care of a diabetic child, so she's demanding full legal and physical custody.

On top of that, Melissa claims Shifty has struggled with drug and alcohol addictions for a long time, and she fears he "would not create a suitable environment" for their son.

TMZ obtained the latest docs in the Grammers' epic legal war. Kelsey wanted his eldest daughter, 27-year-old Spencer and her new husband to vacation at the Grammers' posh Hawaii estate, beginning today.

Camille's lawyer, Neal Hersh went to court yesterday to block Spencer from using the house, and now we know why. According to Camille's declaration, she's the one who has been spending a lot of time at the house with their 2 young kids, and Kelsey hasn't been there for a long, long time.

Camille believes if Spencer and her hubby use the house, they would have access to a lot of personal stuff related to the divorce and might just steal it.

Camille seems particularly bitter because Kelsey has banned her from their Bridgehampton estate. Such rich people problems.

The judge ruled the only way third parties could use any of the Grammers' various homes is if both Kelsey and Camille signed off.

The couple announced the split in a joint statement -- saying, "In honor of that time shared, we are throwing a divorce party."

The big post-marital bash -- which will feature "dancing, photos, memories and drinks with alcohol in them" -- takes place tonight in Nashville.

The 35-year-old rocker married Elson -- also a musician -- in 2005. They have two children.

Kelsey and Camille have homes in the Hamptons, Hawaii and other places. Camille's lawyer, Neal Hersh, told the judge he had concerns about privacy for the kids, thus the need to keep others from living and snooping in the vacation homes.

The judge ruled the only way third parties can live in the vacation homes is with the written consent of both Kelsey and Camille.

Kelsey's lawyer, Lance Spiegel, has requested that the judge speed up the process of having Kelsey, Camille and their two kids interviewed by a child evaluator so the custody trial can begin.

According to the docs, filed last week in L.A. County Superior Court, the split seems pretty amicable -- both Schaech and Kramer (right) waived their rights to spousal support.

Their marriage was a whirlwind failure -- Kramer filed for divorce in August last year, less than two months after they got married.

And get this ... the couple was only married for TWELVE DAYS before they separated.

Of course, this ain't Schaech's first rodeo -- he went through the whole divorce thing with Christina Applegate back in 2007.

J.Lo just scored a restraining order against Claudia Vasquez -- the current girlfriend of her ex-husband Ojani Noa ... the same ex-husband who filmed the honeymoon footage back in 1997 and has been dogging her ever since.

We're told Claudia now owns the tape and was trying to take it to market ... but the judge temporarily blocked her bid, on grounds it can't be released without Jennifer's sign off.

Faith tells TMZ, the divorce proceedings haven't changed a thing -- "Todd is going to be my manager still. I have a lot of personal things going on right now. My main focus is [my daughter] Chyna graduating from high school next week."

As we previously reported, Faith filed for divorce last month -- citing irreconcilable differences.

TMZ broke the story ... Camille Grammer wanted custody of the former couple's 2 kids because Kelsey wanted to split them up. Kelsey's lawyer told us her story was "inaccurate." But we've obtained a letter Kelsey's lawyer sent to Camille's attorney which says exactly what Camille claims.

The letter, dated April 29, 2011, says "Kelsey proposes ... Kelsey shall have primary physical custody of Jude and Camille shall have primary physical custody of Mason." The letter says Kelsey wants to enroll 6-year-old Jude in a Chicago school.

The letter also outlines very specific terms of the custody agreement, including when each parent gets the kids on holidays.

Camille filed for primary physical custody yesterday ... and we've learned she wants custody so the kids aren't separated from each other.

As for Kelsey, his rep, Stan Rosenfield, tells TMZ, "Despite the fact that those connected with Camille Grammer seem to be hand delivering confidential documents to TMZ and other media outlets, we will continue not to make public statements about their private matters which can and apparently does beg for misinterpretation."

In the documents, obtained by TMZ, Kelsey's lawyer, Lance Spiegel, notes that a child custody expert is evaluating Kelsey, Camille and their 2 kids, to determine how custody should be parceled out.

Once the evaluation is in, Kelsey wants a trial ... so it looks like he doesn't hold out hope he can strike a deal with his ex.

Our sources say Camille claims Kelsey only wants his 6-year-old son, Jude, to come live with him in New York City and not 9-year-old Mason.

In the docs, Camille's lawyers Neal Hersh and Judy Bogen grouse that Kelsey made a "bad faith" media play when he asked the judge last month for primary custody of Mason and Jude.

The lawyers note that the kids live in California and have needs that will go unfulfilled if they leave the state. According to the public documents, Camille is particularly pissed off that Kelsey wants to take the kids out of California for part of the summer, since Jude has had learning problems, repeating kindergarten twice, and Mason wants to go to a local camp.

Sources connected with the case tell TMZ ... Brooke's lawyer, Lori Howe, and Charlie's attorney, Mark Gross, went into the chambers of Judge Hank Goldberg this afternoon and presented hizzoner with the agreement. We're told Howe and Gross told Judge Goldberg the only thing left to be done is getting Brooke and Charlie's John Hancock.

Sources tell us ... the agreement calls for joint legal and physical custody of twins Bob and Max. We're told Brooke will get substantially more face time with the kids than Charlie.

The signed agreement will not be filed with the court, in order to keep it completely confidential. The case has been taken off the court's calendar.

Sources tell TMZ ... Kaufman's already been in touch with Maria's attorney, Laura Wasser -- and we're told they are "moving forward" with divorce negotiations.

The 37-year-old "Saved By the Bell" star married Russell back in 1996. They have two children together.

According to documents filed with the city of Malibu ... Jamie asked for city approval to begin construction at her sprawling beachfront mansion.

McCourt wants to expand an existing pool -- and needed permission to excavate 105 cubic yards of earth material. McCourt also wants to expand her wood deck, replace pool equipment and convert a guest room into a pool cabana.

The city approved Jamie's request -- under the condition she doesn't install any lighting systems that will be visible from the beach.

Jamie is VERY serious about her time in the pool -- as TMZ previously reported, she went to war with her estranged husband Frank McCourt over "exclusive rights to the family swimming pool" at her other home in the Hollywood Hills.
