TMZ has learned that Paris Hilton has not only had her sentence cut short, she is already out of jail!

Unimpeachable sources tell TMZ the deal was sealed yesterday, and that Hilton made her exit early early this morning.

She was originally sentenced to 45 days in jail, but that was reduced to 23. She served a total of five days -- the normal stay for a violation of this kind. Her five days began Sunday night and concluded early Thursday morning.

The L.A. County Sheriff's Department will hold a news conference in an hour to discuss what went down.

LA County Sheriff's spokesman Steve Whitmore says that Paris Hilton has been fitted for an ankle bracelet and put under house arrest for the next 40 days, after authorities decided to release Paris from jail due to medical reasons. She got out of jail just after 2:00 AM.

Whitmore says he cannot release details about Paris' "medical issue" due to confidentiality, but said that medical officials "constantly examined" her while she was in jail.

Paris will be under house confinement in her West Hollywood home for 40 days. After the 40 days are up, Whitmore says she will have "fulfilled her debt to society."

Whitmore made it clear that Paris was not released early -- she was reassigned. She is technically still in custody.

Hilton in Custody and Doing Time

TMZ was there when Paris Hilton turned herself in to Sheriff's authorities Sunday night.

It didn't go down at the jail. Paris' mega-lawyer, Richard Hutton, picked her up at her parents' house at 10:30 PM. Hilton, Hutton, mom Kathy and sister Nicky then drove to the Men's Central Jail in downtown Los Angeles -- commonly referred to as the Twin Towers -- where Paris officially surrendered to the L.A. County Sheriff to begin her 23-day sentence.

The Sheriff devised the plan of surrendering miles away from the actual site where Paris will be doing time, because the crush of paparazzi at the jail created a potential safety hazard.

Paris was then driven to the jail in Lynwood, where she is now serving her sentence.

Earlier in the evening, Hilton left her house for the MTV Movie Awards. After appearing on the red carpet, Hilton went to her parents' house for a brief time, then left with her lawyer to face the music.

Law enforcement officials tell TMZ the plans for Paris have changed. Although they had pre-screened a woman who was designated her cell mate, for the time being, Hilton will be in solitary 23 out of 24 hours every day. The one hour that she's out, she's not really out. Hilton will be allowed to shower, use a phone and watch TV in a small pod adjacent to her cell.

Paris' lawyer just released a statement to TMZ from Hilton: "I am ready to face the consequences of violating probation. During the past few weeks, I have had a lot of time to think and have come to realize I made some mistakes."

Hilton added, "This is an important point in my life and I need to take responsibility for my actions.
In the future, I plan on taking more of an active role in the decisions I make. I want to thank my family, friends and fans for their continued support. Although I am scared, I am ready to begin my jail sentence."

Lindsay in Lockdown Movie Role on Hold

A source connected to Lindsay Lohan's next movie says the actress' rehab will not get in the way of her performance, but TMZ knows differently.

The production source told TMZ that arrangements had been made to shuttle Lohan back and forth from Promises in Malibu while Lindsay shoots the new Shirley MacLaine movie, "Poor Things," right down the road in Santa Monica. Lohan was scheduled to be on the set next week.

A well-connected source tells TMZ that this "absolutely is not going to happen." The first time she'll be available to work on the film will be when she's an outpatient -- probably a month from now. And, we're told, Lilo's focus is on getting better, not on the movie -- Shirley MacLaine or no Shirley MacLaine.

Mischa Barton Hospitalized

TMZ has learned that actress Mischa Barton was rushed to the hospital this evening after suffering an adverse reaction to medication.

Sources tell TMZ that the former "OC" star was at a friend's Memorial Day BBQ enjoying a few holiday cocktails when she began to feel extremely ill. Mischa, who has been quite sick with bronchitis since traveling to Cannes, London and Paris the past several weeks, apparently didn't get the memo -- you can't drink alcohol while taking antibiotics!

The 21-year-old celeb was rushed to an undisclosed medical facility in Los Angeles, where we are told she is "resting comfortably."

A rep for Barton tells TMZ that the starlet is with family and "feeling much better."

Lohan Busted on Suspicion of DUI

Lindsay Lohan was cited for investigation of driving under the influence Saturday and was slightly injured when her Mercedes struck a curb, police told the Associated Press.

Lohan, 20, and two other passengers were in her 2005 Mercedes SL-65 convertible when it crashed at about 5:30 AM into a curb on Sunset Blvd., Sgt. Mike Foxen told the AP.

"She was cited and released because she has been admitted to a local hospital for minor injuries," Foxen said.

No one else was hurt and no other cars were involved, Foxen said. He did not have other details. Officers went to the scene after receiving a 911 call about the accident, Foxen said. He went on to say that Lohan will have to appear in court to answer the citation.

Calls to Lohan's rep were not immediately returned.

Hasselhoff Gets Custody!

After the famous hamburger incident, David Hasselhoff has emerged victorious in court! He has won temporary custody of his two kids.

The court hearing today was closed -- secret. Hasselhoff went into court stripped of his right to visit with his children in the wake of the burger video. But we're told the judge was stunned by the evidence presented by the court-appointed expert who performed psychological evaluations on the family.

We're told the expert said Pamela Bach, Hasselhoff's ex, was abusive to her kids -- especially Hayley, the younger of the two. The expert also noted that Bach refused drug testing, among many other things.

Bach's lawyer was on the defensive today, unsuccessfully attacking the expert.

Sources say the judge gave David full custody for two weeks, until the next hearing is held. Until then, the kids will live with him.

UPDATE: A source tells TMZ that David Hasselhoff had his custody rights restored after agreeing to alcohol testing. This person did not mention the fact that the judge temporarily stripped Pamela of her custody rights.

Stallone Pleads Guilty to Hormone-Import Charge

Sylvester Stallone pleaded guilty this morning in a Sydney court to bringing banned muscle-building hormones into Australia, and will be sentenced next week.

The actor didn't appear in court, but said in a letter to Sydney's Downing Center Local Court that he had "made a terrible mistake" because he was "ignorant" about local laws, according to the AP. Stallone was accused of bringing the restricted growth hormones into Oz when a customs search in February turned up 48 vials of Jintropin, a human growth hormone. Then, said a prosecutor yesterday, Stallone threw four vials of the male hormone testosterone out of his hotel room when customs officials searched it.

The maximum penalty for Stallone's offense could be 5 years in prison and $91,500 in fines, but Stallone will face up to $18,500 for each charge because his case is being heard in local (not federal) court.

Paris Ordered to Serve 45 Days in Jail

A Los Angeles County Superior Court judge has sentenced Paris Hilton to 45 days in L.A. County jail for violating her probation in a reckless driving case. Judge Michael T. Sauer handed down the harsh sentence, telling Paris she will not be allowed work release, furloughs, use of an alternative jail or electronic monitoring in lieu of jail. She must do the time!

An emotional Paris, with tears welling up in her eyes, told the judge moments before the decision "I'm sorry, I'm sorry." Witnesses inside the courtroom say that Paris' parents, Rick and Kathy Hilton, were both visibly upset as the sentence was handed down. Kathy, we're told, was especially distraught.

The judge called out her rep Elliot Mintz in court, describing his testimony as "completely worthless." He also told Paris that he did not believe that she was unaware of her license suspension, adding that she had paperwork in her car stating that her license was suspended.

Shortly after the punishment was handed out, defense attorney Howard Weitzman said he would appeal. "I'm shocked, I'm surprised and really disheartened in the system that I've worked in for close to 40 years," Weitzman said, adding that the sentence was "uncalled for, inappropriate and bordered on the ludicrous. I think she's singled out because of who she is."

Paris will serve her sentence at the Century Regional Detention Facility (CRDF). She will begin her sentence on June 5. If Hilton fails to report on the scheduled date, her sentence will be doubled.

Sanjaya's Mom Popped for Growing Piles of Pot

Maybe that's why Sanjaya's always got that goofy grin on his face! Turns out that Sanjy's mom, Jillian Blith, used to be a pot-growing potentate -- and that his sister Shyamali was no stranger to the art of toking herself.

The Momjaya was pinched by the Pierce County Sheriff's Department in February 2005 in Pierce County, Wash. after they found 310 marijuana plants -- and the Sis-jaya keeping watch with a bag of weed and "smoking devices" -- in the Malakar family garage, as the National Enquirer first smoked out today.

But -- buzzkill -- Shyamali, who was arrested for possession, directed the cops to another green-growing facility nearby, where they arrested Blith and her husband, Charles Quist (Sanjaya's stepdad). Quist's mugshot, obtained by TMZ, bears a striking resemblance to Gary Sinise, a very blitzed Gary Sinise. (We're told there's a mugshot of Shyamali, but it can't be made public because she was only 17 at the time of the bust.)

Blith could've gone to jail for up to five years after pleading guilty to one felony count of unlawful manufacturing of a controlled substance, but got off with a relatively mellow 30-day sentence.

Just one word more: Ganja-ya!

Beyonce Accused of a Musical Cover-Up

Beyoncé Knowles is going to war with a pop star from the past who claims the former Destiny's Child star covered her song, but didn't cover her ass.

According to a lawsuit filed yesterday in Manhattan Federal Court by music administators, Beyoncé allegedly never obtained proper clearance to cover a song called "I'm Kissing You," originally co-written by a singer named Des'ree -- famous for her 1994 smash hit, "You Gotta Be." Des'ree's version was used in Baz Luhrmann's 1996 film "Romeo and Juliet," Beyoncé's version can be found on the re-release of her album, "B'Day."

In the lawsuit, Des'ree and her reps claim that Beyoncé, along with her record company people, originally tried to work out a deal to use the song. When they weren't satisfied with the proposed terms -- which included not being able to change the title or make a music video for the song -- Beyoncé allegedly blew off copyright law completely, and recorded the song and video without permission. The song was eventually released on Beyoncé's album, "B'Day - Deluxe Edition" on April 3, 2007, with the title "Still in Love (Kissing You)."

Des'ree is suing to halt distribution of the song, video and album and seeking at least $150,000 in damages.

Lawyers for Beyoncé and Des'ree couldn't be reached for comment.

Anna Nicole Smith Judge Popped for Dope

A judge in the Anna Nicole Smith case has been busted!

TMZ has learned Hollywood, Florida Judge Lawrence Korda, who heard evidence on the DNA paternity test, was busted on charges of possessing marijuana.

We're told Judge Korda was at Stanley Goldman Park in Hollywood, Florida at 2:00 PM yesterday. Two officers smelled marijuana in the air, which led them to Judge Korda sitting on a bench, allegedly smoking weed.

Judge Korda was given a notice to appear in court.

The offense is punishable by a maximum of 60 days in jail and a $500 fine.

Stallone Charged with Importing Steroids Down Under

Just moments ago, Sylvester Stallone was officially charged with illegally importing performance and image enhancing drugs in a Sydney courtroom, according to the Sydney Morning Herald.

According to Australian authorities, the 60-year-old action star, who did not appear in court, was caught at Sydney Airport with several vials of a steroid known as hGH (human growth hormone), during a random baggage check. Customs officials claim they found a total of 48 vials of the steroid after they raided Stallone's Sydney hotel room, limousine and private jet.

Stallone will be required to enter a plea on April 24. If found guilty, he faces a maximum fine of $22,000 Austrailian.

According to steroid.com, "Bodybuilders may illicitly self-administer hGH to improve size and strength, usually by subcutaneous injection into the lower abdomen." HGH has also "become a popular but expensive medication prescribed in anti-aging therapies."

Stallone was visiting Australia in February to promote his latest film "Rocky Balboa. Calls to Sly's rep were not immediately returned.

Reps for Stallone had no comment.

P. Diddy Investigated for Assault & Battery

TMZ has learned Sean "P. Diddy" Combs is being investigated by the Los Angeles Police Department for allegedly attacking a man at a Hollywood Oscar party.

Gerard Rechnitzer was at a post-Oscar bash Sunday night with his fiancee at Teddy's at the Roosevelt Hotel in Hollywood. At around 2 AM Monday morning, the 27-year-old Rechnitzer was on his way to the parking lot when he made a pit stop in the bathroom. When he walked out, he noticed his fiancee was surrounded by six men, including Combs. We're told the 5'7", 140 lb. Rechnitzer watched as Combs chatted up his girl for about five minutes, and then asked his fiancee to leave with him.

At that point, Combs allegedly told the woman he was having a party and invited her to come. Rechnitzer persisted and asked his fiancee again to leave with him. Combs then allegedly socked Rechnitzer in the jaw.

Rechnitzer, a real estate broker, called 911. The LAPD came out and took a report, but Combs had left before the cops arrived. An ambulance came but Rechnitzer declined treatment.

We're told the LAPD contacted Rechnitzer yesterday, and as many as five witnesses who observed the incident.

Britney Back in Rehab

Update: TMZ has learned that Britney has checked into Promises, a treatment facility in Malibu.

TMZ has learned Britney Spears is back in rehab. Sources say the singer has checked into an in-patient facility in Los Angeles. We're told the move came after family members, including her mom, pressed her to check in.

Spears entered the facility today. After TMZ posted the news, a rep for the singer told PEOPLE "Britney Spears has voluntarily checked herself into an undisclosed rehab facility today. We ask that the media respect her privacy as well as those of her family and friends at this time."

Last week, Spears checked herself into a rehab facility in Antigua but checked out less than 24 hours later.

Britney Checks Into Rehab Out a Day Later

TMZ has learned that while Britney Spears checked-in to rehab, she refused to stay and checked out -- less than twenty-four hours later!

As "EXTRA" first reported, the pop star entered a rehab facility two days ago. Now TMZ has learned that the center was located outside of the country, and she refused to stay. PEOPLE confirms that Brit was at Eric Clapton's Crossroads rehab facility in Antigua.

TMZ is told that Britney checked in at the urging of riends and family, after being seen intoxicated in public places and was so "exhausted" on New Year's Eve she collapsed.

According to TMZ sources, Britney is on her way back to Los Angeles.

A rep for Britney could not immediately be reached for comment.

Anna Nicole Smith is Dead

Former Playboy Playmate and TRIMSPA spokesperson Anna Nicole Smith died Thursday afternoon after she was discovered unconscious in her hotel room at the Seminole Hard Rock Hotel and Casino in Hollywood, Florida. She was 39.

Cops say Smith's private nurse called a hotel operator at 1:38 PM EST. Before paramedics arrived on scene, Smith's bodyguard performed CPR. One of the first paramedics to arrive claimed that she was dead when he got there. Smith was rushed to Memorial Regional Hospital in Hollywood. An autopsy is scheduled for tomorrow.
