Birdman Accused of Using Lil' Wayne in Scheme

Fool a concert promoter once, shame on you. Allegedly fool a concert promoter three times -- you're getting sued.

Birdman -- the guy who runs Cash Money records -- is being sued for allegedly taking $275,000 to put on a Lil' Wayne concert in Miami ... and then backing out over and over again. Now the promoter wants his money back.

But the best part of the suit, filed today in L.A. Superior Court, is that Birdman is accused of backing out of one of the shows because "the weather was too cold." In Miami.

Meanwhile, Birdman was photographed giving Lil Wayne a briefcase filled with a million dollars in cash last week. Makes ya wonder...

Our spies say Khloe Kardashian will visit a morgue today ... not for her show and not for makeup tips. It's one of the strings attached to that whole DUI thing, and a dead celeb will be there to get the point across.

Brad Stewart -- former bassist for Marilyn Manson -- died last Thursday of an apparent drug overdose, and his body is lying at the morgue Khloe will visit.

We're told Khloe took a red-eye from NYC to L.A. to make her 8:30 AM appointment. The coroner's office tells us there are 20-30 bodies there -- and Brad's will be one of them.

Recovering DJ AM to be Jay-Hova's Witness

DJ AM is officially spinning back into control -- by way of a brand new concert tour with the Jigga Man himself, Jay-Z.

TMZ has confirmed the recovering DJ -- real name Adam Goldstein -- will make his triumphant return to the stage, along with Hova Jay-Z, during the reopening of the Palladium Theater in Hollywood tomorrow night.

The show will also serve as a launching point for Jay-Z's multi-state tour -- it's unclear how many dates DJ AM is planning to join him on.

The show is AM's first gig since the devastating plane crash that claimed four lives last month.

So there's a rumor out there that Kim Kardashian may be back on "Dancing with the Stars" after Misty May tapped out with an Achilles tendon injury.

Here's what we know. Kim is flying back from New Orleans tomorrow. Our source in the know says she's coming home "to meet with ABC execs about her future with the show."

Here's the weird part: We're told KK's partner, Mark Ballas, has not been contacted about coming back.

Judge to Khloe K -- Stop Dragging Ass

The other Kardashian sister was in court today for a progress hearing on her DUI -- and nearly blew it when the judge learned she hadn't completed her required drug and alcohol classes by today's scheduled appearance.

The judge scolded the reality star this morning for missing more than one of her classes -- but Kimmy's sis says it wasn't her fault. KK blamed holidays that fell on scheduled class dates (they were closed) and over booked sessions (not enough seats) kept her from fulfilling her obligation -- but the judge wasn't having it.

The "Celebrity Apprentice" wannabe was still given until November 17 to complete her last class and is required to fly back from NYC this month to do a day's work in an L.A. morgue.

Goodyear Breaks Silence on Crash

Goodyear -- the maker of the tire that may have blown out before Friday night's plane crash -- tells TMZ they have gotten the call from the NTSB, and they'll be working with investigators.

In a statement, Goodyear says, "We have been contacted by the NTSB and will cooperate fully with its investigation. Our thoughts and prayers are with the families of the victims of this accident."

The NTSB said the black box recording revealed the plane's crew said a tire might have blown before the Learjet overran the runway and crashed into an embankment. Four people were killed; Travis Barker and DJ AM remain in critical condition, but are expected to make a full recovery.

Audrina Sp-Hills the Beans

Audrina Patridge is not necessarily known for her wits, so when the whole moving out of L.C's pad came to light, sources close to Audrina tell TMZ that she pissed off the people at a major gossip rag.

We're told the magazine was paying for the exclusive story of Audrina's move -- but the news came out prematurely because Patridge couldn't keep her yapper closed.

Sources say the mag bit the bullet, and a story that everyone already knows will be on newsstands as soon as next week -- and Audrina gets to keep the cash.

Somewhere, someone is giving Audrina a serious case of the stinkface.

Condition Update -- Barker and DJ AM

TMZ has learned Travis Barker has been burned from the waist down, but he is expected to survive the plane crash. DJ AM's face was severely burned and is being tended to right now.

We're also told the tragedy is all the worse because one of the passengers who died, Chris Baker, Travis' assistant on "Meet the Barkers," was married recently and has a new baby.

Sources close to Audrina tell TMZ a spin-off show starring Audrina is "in the works." And it's all happening fast -- moving trucks are in front of the house she shares with Lauren Conrad and Lauren Bosworth right now.

The spin-off news comes on the same day it was announced she'll be starring in a horror movie called "Sorority Row." We smell an Oscar!

Memphis Takes "Big Brother" for a Ride

Memphis, the "Big Brother" contestant who won a 1969 Camaro the show didn't even own, has decided he doesn't want the car anyway.

After setting up a test-drive to see if he wanted the classic car -- which "Big Bro" would've had to purchase from the rightful owner -- Memphis realized the gas-guzzler wasn't for him and chose to pocket an undisclosed amount of greenbacks instead.

"Big Brother" is in a little doo doo this AM.

In the first episode of BB10, Memphis won a sweet 1969 Camaro in a car-pulling contest (don't ask). Small problem -- "Big Brother" couldn't give the car away because the show didn't own it. We're told someone else actually held the title. In fact, the car had already been returned to the owner almost immediately after the contest.

Memphis the Mixologist was none the wiser because no one told him about the snag while he was inside the house. But on Tuesday, Memphis gained his freedom, losing to Dan, and learned the car he had come to treasure wasn't really his. Another problem -- the car has been repainted since it was on the show.

We're told producers are now scrambling to buy the car from the real owner. Sources say the real owner will turn the keys over for $24,000. A '69 Camaro online sell for anywhere between 7 and as much as 80 grand. Fact is, Big Bro doesn't have a lot of bargaining power, so they are more SOL than HOH.

We made several calls to "Big Brother" -- so far, no comment.

Josh Waring, the son of Lauri Waring from "The Real Housewives of Orange County," was sentenced Monday to 240 days in the pokey for possession of heroin and ecstasy and an intent to sell.

But here's the rub: Josh was actually turned in by his own mother! Apparently Lauri showed up to her condo where Josh was living, and found drugs on the premises. She contacted the cops, even telling them where her son's hangout spots were and he was busted the next day.

Guess that's OC tough love!

It happened in Bev Hills, when Kim was going from "Dancing With the Stars" rehearsal to her home to shoot the even lamer "Keeping Up with the Kardashians." She took it like a man, not even arguing with the officer who cited her for speeding as well as driving with tinted windows.
