TMZ broke the story ... Cruz cut a deal with the prosecutors. He pled no contest to solicitation of murder.

Sentencing is set for December 13. Cruz's wife, Jennifer Campbell, wants to address the court before sentencing.

As TMZ first reported, Cruz has agreed to accept 9 years in prison. Ultimately, however, it's in the hands of the judge.

Also, when Cruz exited the courtroom he blew a kiss to his wife and both had a big smile on their face.

The accident happened last week, and in the lawsuit -- just filed in L.A. Superior Court -- Roman Gasparyan claims he was in the median, waiting to make a left turn when Eva ... driving in the opposite direction ... "made a sudden lane change into the median lane" and collided with him.

According to the suit, both Eva and Roman were driving BMW X5s -- his a 2002, hers a 2010. In addition to the SUV damage, he claims he suffered mental and physical suffering -- and he's suing for unspecified damages.

By the way, Tony Parker was not involved in the accident, but the three-time NBA champ is the registered owner of the BMW. Eva, through her rep, says, "There is absolutely no truth to this claim, and any indications to the contrary are completely false and untrue."

Cruz -- who allegedly hired three homeless guys to kill wife Jennifer Campbell -- is scheduled to appear this morning for his preliminary hearing on attempted murder charges. But our sources say that hearing will not happen. Instead, lawyers for both sides will announce the plea deal.

We're told Cruz will plead guilty to solicitation of murder. He will agree to 9 years in prison, less time served. Cruz has been in jail since May. But it's a lot better than attempted murder, which carries a life sentence.

The backstory is pretty incredible. TMZ broke the story ... Campbell was suicidal because she couldn't have kids, but could not take her own life because of her religious beliefs. Authorities believe Cruz was going to have his wife killed as an act of mercy and then take his own life.

The "Modern Family" star drove her BF Nick Loeb out to Madeo last night ... where the guy who suffered a severe broken leg back in August was crutchin' along like a pro.

As TMZ first reported, the other driver in the accident has lawyered up and says he plans on suing Longoria -- claiming the accident was completely her fault.

But a rep for Longoria tells TMZ: "According to the police report, the other driver was clearly at fault AND admitted to fault at the scene of the accident. Longoria’s eyes were NOT red and bloodshot."

We've learned Christina's lawyer, disso-queen Laura Wasser, filed legal docs disqualifying the assigned judge from hearing the case.

L.A. County Superior Court Judge Elia Weinbach ... fairly new on the divorce circuit ... won't be hearing the case, but we're guessing it's nothing personal.

Wasser's firm has a pretty ironclad rule to handle high-profile divorces with private judges. Translation -- they're usually handled behind closed doors.

The two kicked it at the grand opening of the Arkadia at the Fontainebleau Hotel on Saturday night to attend Drake's 24th birthday party.

Spies inside the club tell us both A-Rod and LeBron partied until 1:00 AM -- and were each seen drinking Grey Goose La Poire vodka.

Attorney Sanjay Sobti tells TMZ he's been retained by Roman Gasparyan (aka the other driver) claiming his client was stopped in the middle lane on Hollywood Blvd., waiting to turn.

Sobti says Longoria made a sudden turn in the middle lane and smashed into Gasparyan, crossing the median and nearly hitting another driver. Sobti claims an eye witnesses says Longoria's eyes "were red and bloodshot."

He says his client suffered back and neck pain, severe headaches, anxiety and blood pressure complications. Sobti says he'll file a civil suit this week.

But our law enforcement sources tell a radically different story ... that the other driver stopped suddenly and Eva was unable to avoid impact.

A rep for Longoria had no comment.

As TMZ first reported, Aguilera filed for divorce from Jordan Bratman last week after nearly five years of marriage. But despite the fact they've been separated since September 11, neither has moved out of their Bev Hills home.

Our sources say it's so uncomfortable for Christina, she's been staying in a hotel.

There were reports insinuating there may have been domestic violence between Christina and Jordan Bratman, since Christina busted her lip the very same day she filed for divorce.

But as we first reported, there was no domestic violence. Christina just fell on her own.

Stories are circulating suggesting Christina and hubby Jordan Bratman may have gotten into a domestic squabble and that's why her lip was cut. But sources directly connected with the couple tell us it was not DV.

According to law enforcement sources, the "Desperate Housewives" hottie was driving on busy Hollywood Blvd when someone suddenly turned in front of her. Eva was unable to avoid the car and collided with it.

We're told both Eva and the other driver had very minor injuries -- no one went to the hospital -- and the accident is under investigation ... however the early indication is Eva won't be on the hook for the damage.

Eva's restaurant, Beso, isn't far from where the accident happened. Calls to her rep were not immediately returned.

For years, A-Rod has habitually rolled over to the famous Serafina Restaurant in NYC to stuff his face with a special off-the-menu item that the chef specially prepares for him before a big game. In fact, during last year's World Series run, A-Rod was photographed at the spot almost every day.

But this year, our restaurant spies tell us A-Rod has not had a pregame meal at Serafina since the playoffs began.
