Aguilera's move comes just weeks after her divorce from Jordan Bratman, and a week after her arrest for public intoxication.

Take a listen ... Christina's song clearly samples from a 1968 latin soul tune called "Hippy Skippy Moon Strut" (aka "I'll Be a Lucky Man) by Dave Cortez and the Moon People. Gotta love that name.

According to the federal lawsuit, filed in New York, TufAmerica purchased exclusive rights to 'Hippy Skippy' in 2004 ... however Sony Music -- Christina's label -- made a deal with Codigo Music and the Clyde Otis Music Group to use the song. Aguilera is not named as a defendant in the suit.

Cameras snapped away as Xtina -- sporting a bathrobe -- exited Smashbox Studios in Culver City, CA ... a popular place for photo shoots.

As TMZ first reported, Aguilera and her BF Matthew Rutler were arrested Tuesday morning when cops determined Rutler was driving under the influence .. and Xtina was too hammered to take care of herself.

As one source put it, "Maybe when she was married she was able to keep it under wraps, but it's out in the open now."

And we've learned ... Christina's drinking became an issue in her divorce. Jordan Bratman voiced concern about Christina's drinking when they hashed out their child custody agreement but they ultimately agreed on joint custody.

We're told Jordan has been mum since yesterday's arrest. It's unclear if he'll try and reopen the custody case.

We're told Christina has shut down all attempts to get her into rehab ... at least until yesterday.

No word if she's had a change of heart.

We've confirmed ... Aguilera and Matt Rutler had a late-night dinner date at Mario Batali's restaurant Osteria Mozza ... where they hung out in the private dining room past midnight.

We're told one of the restaurant patrons recognized Christina and asked the server to send her a drink ... but the server replied, "She's already drinking a bottle of wine... or two."

The patron sent over a dessert instead.

So far, no word on when Aguilera and her BF left the joint -- but sources who were at the restaurant tell us the couple got their entrees AFTER midnight ... when the place was closing down to the public.

As we first reported, Matt Rutler was arrested for DUI around 2:45 AM in West Hollywood.

Law enforcement tells us Matt blew a .09 on a breathalyzer ... just over the legal limit which is .08.

Shortly after Matt got out of jail his ride was also liberated -- he was spotted picking up his Mustang from the impound yard ... which we're told set him back $192.

TMZ broke the story ... Christina was popped for public intoxication and her BF Matt Rutler was arrested for DUI.

As we first reported, Christina was arrested for public intoxication at 2:45 AM this morning in West Hollywood -- and her boyfriend Matt Rutler was busted for DUI.

Law enforcement officials had said Christina was "not involved in any criminal activity" and would be released once she could "safely take care of herself."

Rutler is still in custody.

Cops say ... Aguilera was a passenger in a car driven by Matthew Rutler when officers noticed he was driving erratically around 2:45 AM ... so they pulled the vehicle over.

Officers determined Rutler was drunk and arrested him for misdemeanor DUI.

Cops say the deputies determined Aguilera was also "extremely intoxicated" ... and since she was unable to care for herself, Aguilera was taken into custody.

Aguilera was booked for public intoxication -- and according to the booking sheet, she was listed at 5'2" and 100 lbs.

According to the L.A. County Sheriff's Department, Rutler's bail was set at $5,000.

However, the source adds, "If the driver had NOT been arrested for DUI, [Christina] would have never been in trouble."

The photos in question were taken by Lyndon Chubbuck ... and scheduled to go on display at an art show later this week at Supperclub Los Angeles.

According to Lyndon, his works of art were nabbed somewhere between the printer and an art show last weekend.

Lyndon says he plans to file a police report tomorrow -- but strictly for insurance purposes because he believes, "The cops aren't really going to put a mad hunt out for my Eva photos."

Nude Eva? Something tells us police might be interested.

Sources close to Bieber tell us Justin called up a local florist on Wednesday hoping to "fill Selena's house with flowers" ... just because he felt like it.

We're told the florist needed EVERY SINGLE FLOWER in the shop to complete the order ... and had to use "multiple trucks" to pull off the love stunt.

Mars was in a Las Vegas courtroom with his lawyer, Blair Berk, when Mars pled guilty to felony cocaine possession, but if he stays out of trouble for 12 months, the charge will be dismissed -- as if it never happened.

Mars is also required to do 8 hours of private counseling and 200 hours of community service with a charitable organization. He must also pay a $2,000 fine -- which he's paying today ... because he has Bruno Mars money.

Berk tells TMZ, "We are very pleased that the prosecution has agreed to dismiss the charge."
