'Teen Mom' Amber Portwood Loses Primary Custody

Published | Updated

"Teen Mom" Amber Portwood just lost primary custody of her baby daughter ... TMZ has learned.

Custody was awarded to baby daddy Gary Shirley instead -- after an Indiana judge decided he was a more suitable parent ... at least for the time being.

But it wasn't because Amber's an unfit mother -- according to court testimony today, Child Protective Services recommended that Gary have primary custody because of recent vandalism to Amber's house and car.

CPS was nervous about Amber's living conditions -- so both parties agreed it would be best for baby Leah to stay with Gary until further notice.

Amber will have visitation rights -- but we're told, CPS hasn't come up with a schedule yet. So far, no word from Amber's camp.

Brittany Maggard claims Jenelle only got up the guts to fight Britany Truett -- the eventual ass-beat victim -- because Maggard, Maggard's sister, and their friend Nick had her back. Maggard says Nick had the video camera.

After the fight, Maggard claims she and Nick came up with the idea to sell the video -- and Jenelle not only thought it was a "good idea" ... but SHE called "someone she knows at a [photo] agency to purchase the video."

According to Maggard, they sold the vid for $5,000 -- and Jenelle wanted a bigger cut because, as she said, "You wouldn't get any money if I wasn't famous!"

Jenelle's attorney says he doesn't believe Maggard's accusations.

'Teen Mom' Pusher Arrested 2nd Time in a Week

After Brittany's arrest this week, the Department of Corrections of North Carolina set the wheels in motion to have her popped for violating probation -- which requires her to obey all laws.

Brittany is bitter, telling TMZ it's not fair she's in more trouble than the other girls in the fight and all she did was push Jenelle. She says she's "terrified."

Teen Mom Lawyer on Charges: It's a Set Up!

Published | Updated

The lawyer for "Teen Mom" star Jenelle Evans tells TMZ ... his client is the victim of a set up, and money is at the bottom of it all.

Dustin Sullivan, Jenelle's lawyer, tells us he has a "serious problem" with the fact that Brittany Maggard -- the woman who pushed Jenelle before the brawl -- and other parties involved were "paid substantially" for pictures and videos related to the incident.

Sullivan says it's suspicious that cameras were present when Jenelle arrived -- indeed, Sullivan says, multiple cameras were present capturing different angles of the impending brawl.

Sullivan is in the process of interviewing witnesses to determine if Britany Truett -- the woman who caught the beatdown -- pre-programmed the melee.

And, Sullivan says, it's "highly suspicious" Britany waited five days before calling the cops.

Sullivan says if there's proof of a set up, he will make that a centerpiece of the case when it goes before a jury.

Maggard continues, "Ya I instigated it, but what the hell are we supposed to do? I wanted to see them fight!"

And of course, the mugshot: "I'm just glad my mug didn't show my socks. My socks weren't matching. I had one Spider-Man sock and one green sock on."

And, clearly, Brittany is an expert in socks.
