Part of Tom Cruise's lawsuit against two tabloids reads like one of his spy movies -- with Tom's publicity team accusing Katie Holmes of espionage ... as in working directly with the tabs to publish stories skewering Tom as a horrible father.

In emails to Tom's legal team ... his publicist Amanda Lundberg fingers specific people in Katie's camp -- including publicists and hair/makeup people -- for feeding stories to "In Touch."

Amanda accuses her #1 suspect of "speaking to the press constantly. She is the one saying -- K[atie] is disciplinarian and T[om] is spoiling and so on."

Amanda also directly accuses Katie's publicist, saying ... "leslee sloan [sic] calls the paparazzi every time K gets ready to leave the building as the doormen are always surprised how they suddenly show up when she is about to leave."

The emails were submitted as part of Tom's $50 million suit against the publisher of "In Touch" and "Life & Style" ... for allegedly defaming him with headlines about him abandoning Suri after the divorce.

Tom's publicist Amanda also emailed Katie's people directly, accusing them of remaining silent about a story that claimed Tom broke a promise to Suri. In the email, Amanda demands ... "Can you guys comment and deny this as we all know this is not true."

At the end of the email Amanda begs ... "Help?!!!"

In short, Tom's people are bitching that Katie's people play dirty pool ... allegedly planting negative stories ... or refusing to blunt the ones they know to be false.

Truth is ... this kinda thing happens every day behind the scenes in Hollywood.

Here's something you didn't know about Sum 41 singer Deryck Whibley -- he took Avril Lavigne's last name when he married her, and now ... 3 years after divorcing her he's finally sick of it ... because he's filed legal docs to drop it.

Deryck Jason Lavigne Whibley just filed in L.A. County Court to go back to his birth name ... sans Lavigne.

It's pretty crazy -- A) because he took her last name in the first place and NO ONE KNEW, and B) because it took him so long (FOUR YEARS) to switch it back.

Whibley and Lavigne got hitched in 2006 and divorced in 2010.

To review: Deryck ended up stuck with Avril's last name -- and Avril ended up ... stuck with Chad Kroger.

It's a toss up who got the worst end of that deal.

Brooke Mueller and Denise Richards were actually cordial with each other during a mandatory sit-down with a chief honcho from the L.A. County Dept. of Children and Family Services ... but the drama is far from over ... TMZ has learned.

As we first reported ... Denise and Brooke showed up at an L.A. courthouse today and met with DCFS Medical Director Dr. Charles Sophy. We're told Sophy also asked Charlie Sheen to attend the meeting, but Sheen declined.

Sources familiar with the situation tell TMZ ... although the 2 warring women were not openly hostile toward each other, their problems were NOT solved during the 4-hour session. We're told Denise is still waffling on whether she'll continue to serve as temporary guardian for twins Bob and Max.

Here's what our sources say happened in the meeting:

--- Sophy did a lot of clarifying as to what the goals were -- specifically, to gradually "reunify" Brooke with her kids

-- Sophy made it clear the goal is not for Denise to keep custodial control over the twins. Her role would diminish as Brooke became stronger and able to provide parenting. We're told this will be a slow process and Sophy established more specific guidelines as to how it will happen

-- There was an acknowledgment by all that Bob and Max have been significantly damaged psychologically by the turmoil in the family

-- There was also an acknowledgment ... there is no "magic bullet" to solve their emotional problems

-- Charlie is NOT being looked at as an option for custody

-- As for Denise, she still feels Brooke is interfering with the proper treatment of Bob and Max, and fears the twins will physically hurt her daughters

-- We're told there was no evidence Brooke has lapsed back into drug use

We're told no follow-up meetings are scheduled with Sophy and the women. We're told DCFS social workers will now take over. As for when Brooke gets full custody -- currently she's getting 2 overnights a week and 3 days. We're told the process of full custody will be fairly slow.

Lamar Odom seems to be waiving the white flag over his marriage -- at least that's the way it appeared when he was asked about Khloe Kardashian on his way out of lunch to celebrate his 34th birthday.

Lamar went to Casa Vega in the San Fernando Valley -- a place Kim, Khloe and the rest of the klan often go for good Mexican food.

TMZ broke the story ... Khloe plans to divorce Lamar, but she's made a decision NOT to prepare or file any legal docs, because she thinks it could be the last straw in his fragile life. On top of that, there's no pressing reason to pull the trigger on the marriage ... yet.

Brooke Mueller and Denise Richards are locked in a conference room right now ... as officials from the L.A. County Dept. of Children and Family Services try to force a truce in their war over Bob and Max ... but Charlie Sheen was a no-show.

Sources connected with the warring families tell TMZ -- Dr. Charles Sophy, the Medical Director for DCFS -- called the meeting and wants Denise, Brooke and Charlie to come face-to-face to deal with what has become a child-rearing crisis.

You may remember Dr. Sophy -- he's a highly-respected shrink who was a key player in the Michael Jackson molestation trial in 2005.

We're told Charlie was invited but didn't attend -- we don't know why.

The goal of the meeting -- to figure out a custody arrangement that keeps Denise in the picture and gives Brooke sufficient parental rights.

Khloe Kardashian and Lamar Odom are packing it in -- we've learned they are secretly selling their Tarzana mansion.

Real estate sources tell TMZ ... Khloe has given several San Fernando Valley realtors a pocket listing -- meaning the house will not appear in the multiple listing service. It's being done on the down low. Any prospective buyer must pre-qualify before seeing the house, meaning they must have the dough to buy the crib.

We're told Khloe and Lamar want a cool $4 mil for the house. They paid $3.95 million in 2009.

Our sources say Khloe is the driving force behind the sale, telling realtors she wants to "start fresh and move on."

Title to the house is held in both Khloe and Lamar's names.

Charlie Sheen is a fantastic father who dotes over his children and is always there for them ... this according to Denise Richards.

TMZ has obtained a document submitted to the L.A. County Dept. of Children and Family Services, written by Denise Richards. The title is "Visitation Log." Denise outlines Charlie's involvement with Sam and Lola -- the kids they had together, as well as Bob and Max -- the twins he had with Brooke Mueller.

The document -- which Denise was required to keep because she was Charlie's monitor when he visited the twins -- was included in her documents to show DCFS Charlie has been a capable, even excellent parent, whereas Brooke has been a disaster.

Here's the outline of Charlie's involvement:

-- Sept. 22 We all had dinner together. Charlie stayed until bedtime
-- Sept 25 Visit after school till after dinner
-- Sept. 29 We all went to watch our daughters ride, petting zoo, and dinner with friends
-- Oct 2 Boys and their dad and I took the girls to their dance class after school. Bob and Lola put on a dance show for all of us before bed. Their father stayed until bedtime
-- Oct 4 Boys field trip for school. We all went together. Spent the morning until 1:30 PM
-- Oct 6 Charlie was with us for the boys' drum lesson. Watched them play and went to play ball with boys. His friend and sons met us as well
-- Oct 9 I had friends and their children over for a dinner party. Charlie was with us. He left right after bedtime
-- Oct 16 The kids all came to my set at work. Charlie met us there. At my dinner break we all ate together
-- Oct 20 Charlie and his chef came over and she made brunch for us. Sam had a big project for school he spent time working on that. And also did art with boys
-- Oct 23 Dinner/homework with girls. Read stories to the kids
-- Oct 27 Spent late afternoon into evening with us
-- Oct 31 Went trick or treating with us, afterwards came back to my house to help me put everyone to bed

TMZ broke the story ... Denise has sent material to DCFS explaining how it has become impossible to care for Bob and Max -- she's the temporary guardian -- because of Brooke's interference.

Charlie Sheen was admonished by the judge in the war involving Bob and Max -- the twins at the center of the war between Charlie and Brooke Mueller -- if he opens his mouth again about the case, he's going to jail.

Here's the best part. We're told at one point the judge said, "Don't forget, I'm Italian!"

Sources connected with the case tell TMZ ... the judge issued a temporary restraining order against Charlie. The TRO re-instates the gag order, prohibiting them from talking about the case.

We're told the judge was upset with Charlie, who called the jurist a fatty and a douchebag on TMZ Live.

Under the TRO ... we're told Charlie is prohibited from going within 200 yards of Brooke. He's also not allowed to contact Brooke. To that we're told Charlie told the judge, "Thank you."

Brooke, who was in court as well, had her lawyers ask the judge to suspend his visitation rights with the twins, but the judge rejected her request. Sources tell us Brooke wants Denise Richards REMOVED as temporary guardian of the twins, but that didn't happen.

By the way ... Brooke's lawyer made a big deal about the pic of the birthday cake for Brooke with a grenade on top ... but the judge didn't make a big deal of it.

Goonies never say die ... except when it comes to marriage -- TMZ has learned, "Goonies" star Robert Davi's wife has filed for divorce.

Davi's wife Christine filed the docs in L.A. citing irreconcilable differences. The couple was married in 1990 and separated this week after 23 years. They have two minor children, 12-year-old twins.

According to the docs, Christine wants legal and physical custody of the kids. She wants Robert to get visitation.

In addition, she wants Robert -- who also starred in movies like "Die Hard," "Showgirls," and "License to Kill" -- to pay her attorney's fees as well as spousal support.

We reached out to Robert for comment, and he told us the couple has actually been amicably separated for years.

Denise Richards was armed with an email when she went to the L.A. County Dept. of Children and Family Services -- an email which she apparently believed would expose Brooke Mueller as a terrible parent.

The email -- obtained by TMZ -- was sent by Dr. Jay Gordon, an Assistant Professor of Pediatrics at UCLA Medical School. The email and documents obtained by TMZ make it clear ... Brooke is blocking psychological treatment for Bob and Max.

The email, dated August 23, 2013, reads:

-- "As we have discussed, because of recent events involving the boys' behavior I think that they need urgent evaluation. I am very concerned about their escalating violent actions; The apparent lack of understanding of the consequences and the safety of others is most worrisome. I would like them seen by Dr. Alessia Gottlieb for a complete developmental and behavioral assessment."

Charlie Sheen is using his dad's epic movie, "Apocalypse Now," to underscore his declaration of WAR against Brooke Mueller and the L.A. County Dept. of Children and Family Services.

Charlie tells TMZ ... he will not be muzzled by a gag order or any other admonition. He believes his twins Bob and Max have been grievously damaged by their mom, Brooke Mueller and he thinks DCFS is blindly protecting her at his kids' expense.

Charlie quotes Martin Sheen in the flick, "I am beyond their timid lying morality, therefore I am beyond caring" -- referring to what he considers the tepid actions of DCFS.

Charlie goes on: "What my family and I are forced to deal with in the last 4 years, lives outside the pale of any acceptable conduct or decency. I am battling an amorphous enemy that needs to be swiftly disempowered."

As we first reported, Brooke's people are gunning for Charlie for violating the gag order and going on TMZ Live, calling Brooke a "whore" and the world's worst parent. To that he says, "There is no force, no human, and no scenario in the known universe that will divert my course, my mission in this life."

As for the pictures TMZ posted, showing Bob allegedly before and after a visit with Brooke -- where it looks like his face was injured -- Charlie says he will stop at nothing to get DCFS to do the right thing:

-- "These crimes against my children will be exposed. These war criminals will be hanged at dusk to a cheering and jeering crowd, gathered together in love in support of all children who are mercilessly discarded like garbage by CPS. Which by the way stands for 'CAN'T PROTECT SHITE.'"

Charlie ends with an ominous threat: "The storm is brewing. Their roofs are leaking. I am the Tsunami your mommy warned you about your whole childhood. All of you renegade deplorable pigs are marked for slaughter."

Tom Cruise is declaring he's a damn good dad to Suri ... opening up for the first time about his divorce from Katie Holmes and how it affected his relationship with his daughter.

Cruise just filed docs in his $50 million lawsuit against the publisher of "Life & Style" and "In Touch" magazines for cover stories that claimed he "abandoned" Suri after divorcing Katie in June 2012.

In the docs, Cruise says ... "I have in no way cut Suri out of my life -- whether physically, emotionally, financially or otherwise."

He goes on to cite specific times he saw his daughter in person in the months following the divorce, and says ... "even during the times when I was working overseas and was not able to see Suri in person, we were (and continue to be) extremely close."

The docs are pretty revealing ... since Tom has said next to nothing publicly about the divorce from Katie.

Cruise admits he was busy shooting 2 movies when "In Touch" ran its headline, "Abandoned by Daddy" -- however he says, "As my numerous emails with Suri's mother during this time period demonstrate, I was a constant presence in Suri's life."

Tom's declaration continues ... "While I'm sure my daughter misses me when I am not with her (as I miss her), she is a very happy child, and we have a wonderful relationship and cheerful phone calls."

TMZ obtained these pics from sources connected with the L.A. County Dept. of Children and Family Services ... and they purportedly show 4-year-old Bob Sheen before and after a visit with Brooke Mueller ... we've learned Charlie Sheen believes it's proof she's NOT a fit parent.

DCFS sources tell TMZ, Denise Richards -- who has temporary guardianship of twins Bob and Max -- included the before/after shots in her letter to DCFS, claiming a photo was taken just before Bob was dropped off at Brooke's place on July 26 ... and the other taken after leaving Brooke's care.

Denise didn't say what the red mark was, but we're told Charlie believes it was a burn.

It appears Brooke told DCFS Bob's face was already red when Denise dropped him off.

As we reported, according to our DCFS sources ... Denise recently wrote the letter to DCFS in order to say she could no longer care for Charlie and Brooke's twins because they have become out of control and violent, hurting her animals and her daughters.

Denise Richards has informed the L.A. County Dept. of Children and Family Services she will NO LONGER care for the twins of Charlie Sheen and Brooke Mueller ... TMZ has learned.

Sources connected with DCFS tell TMZ ... Denise wrote a letter to the agency, saying the kids are violent and out of control, and she says it's ALL Brooke's fault.

DCFS sources say the letter details horrifying conduct. Denise says Bob and Max often go into a "zombie-like state" -- they repeatedly kick her dogs in the head and squeeze their heads with both hands while watching the dogs whimper in pain. She also says the kids will flip from sweetly petting the dog to strangling the animals and lifting them off the ground by the neck.

According to the letter, Denise would tell the kids they were hurting the dogs, and Bob and Max would reply that they wanted to hurt and kill the dogs.

According to the letter, the violence is not limited to animals. Denise says her daughters -- Sam, Lola and Eloise -- have been targets of the boys. She says her daughters have been strangled, kicked in the head and stomach, scratched, bit, slapped, punched in the face and head, and spit on by Bob and Max. Denise describes one incident which she seems to blame on Brooke -- after visiting Mueller, Bob threw a toy at Sam's face and she had to go to the doctor.

Denise says Bob and Max went to school in September and they have been problematic from the get-go. She says Bob in particular has harmed other kids and punched and slapped teachers in the face.

Denise says the kids have also thrown their own feces into the bathroom of one of her daughters.

In the letter, Denise connects the bad conduct to the time the kids spend at Brooke's home, claiming they act out violently when they are returned to Denise. She also says the kids have had horrible nightmares after returning from Brooke's home, where the kids would stay up with her til 4 AM.

Charlie Sheen is killing Brooke Mueller with kindness -- at least he really, really wants to -- because he just wished his ex-wife a happy birthday with a special piece of cake (topped with a grenade).

FYI, it's not actually Brooke's birthday (that's in August) but it didn't stop Charlie from writing this message on Twitter, "Happy Bday Brooke. When you're done sucking off the parking lot at Home Depot, why don't ya 'blow' out this candle?"

Oh yeah, if you recognize the cake ... that's because it's the same cake Charlie got for his recent "Anger Management" party.

Brooke Mueller is on the attack ... gunning for Charlie Sheen, who called her a whore, drug addict and terrible parent on TMZ -- and if she gets her way Charlie could end up in jail.

We just received a subpoena from Brooke's lawyers, ordering us to preserve the video and audio interviews we did with Charlie last Friday. Where to begin. Charlie said Brooke has damaged their twins emotionally, to the point they're on the verge of getting kicked out of school. He says every time the kids visit with Brooke, they come home completely freaked out and suffer from night terrors.

Our sources say Brooke's lawyers will go to court with our video and audio and argue Charlie has violated the gag order and should be punished -- possibly with jail -- and have his visitation curtailed.

Charlie told us the L.A. County Dept. of Children and Family Services cares more about protecting and rehabilitating Brooke than protecting the twins. He also calls the judge in the case "The Dishonorable Judge Douchebag." Charlie also called him fat.

The subpoena orders us to hand over the video and audio interviews we did with Charlie. What ... they don't watch TMZ Live?
