Famous Jockey Has Serious Race Issues

One of the world's most famous jockeys is more pissed than a race horse -- claiming he's been saddled with an unfair suspension for allegedly trying to screw up a race.

Corey Nakatani was suspended for three days after a January 15th race at Santa Anita in which he allegedly "failed to put forth his best effort to maintain a straight course" -- in other words, he's accused of intentionally trying to cut off another horse.

Now, Nakatani has filed a lawsuit against the California Horse Racing Board claiming the ruling is total horse s**t -- and that his suspension is "illegal, erroneous, not in the best interest of racing, and violates [Nakatani's] right to pursue his livelihood."

Nakatani is asking the court to issue a stay of the board's ruling, pending a hearing, so Nakatani may continue to race. His suspension is scheduled to begin Friday -- this might be a photo finish.

Michelle Pfeiffer, Diane Keaton, Mandy Moore and Sandra Bullock have joined forces to upload a legal ass-whoopin' on some major computer companies.

The quartet claims CompUSA, TigerDirect, Global Computers and others have used their images online to hawk their products, without their permission.

What we especially like about the lawsuit, filed yesterday in L.A. County Superior Court, is that the lawyers basically regurgitate the actresses' IMDb pages to show how famous they are.

What we don't understand -- why would anyone buy a computer because Sandra Bullock has one? On the other hand, she did star in "The Net" back in 1995.

"Gossip Girl" Didn't Pamper Her Kid -- Allegedly

Here's how nasty the Kelly Rutherford/Daniel Giersch divorce has gotten -- they're bickering over who doesn't wipe their kid.

In legal papers filed today, Giersch claims he tried to potty train their son, Hermes, early on but Rutherford took his mini-toilet seat away and hid it and did not "encourage him to use the toilet."

Giersch adds, "I have witnessed that she does not always keep his bottom clean."

And there's more. Giersch says it is not "reasonable or appropriate for [Rutherford] to be breast feeding when he is nearly 2 1/2 years old."

As if to punctuate his point, Giersch says the kid is old enough to be fluent in German.

TMZ has learned the most famous pilot on the planet made his first public appearance in D.C. last night, at a low-key dinner with some members of his heroic flight crew and several passengers from Flight 1549. The name of the restaurant -- Hudson... Seriously.

Sully was a rockstar, shaking hands with a steady flow of admirers in the restaurant -- which by the way, is great.

Now the best part: As if to take revenge on the birds that brought down his jet, Sully dined on buttermilk fried chicken.

Milano Makes Legal Move Against Obsessed Fan

Alyssa Milano has dropped her L.A. case against an obsessed fan who she claims has put her life in extreme danger. But not to worry -- she's fully protected.

We've learned less than an hour ago, the court was notified Milano was dropping the permanent injunction case against Jeff Turner. Milano claimed Turner "has repeatedly shown up to my place of residence ... hiking miles through the hills to reach my property," adding, "I fear for my personal safety, and that of my family and friends."

But here's the deal. Milano's primary residence is in neighboring Ventura County and last month (December 23) a judge in Ventura County issued a permanent injunction against Turner, prohibiting him from having any contact with Milano or her peeps for three years. The injunction can be enforced anywhere in the state, so the L.A. case became irrelevant.

We're told Turner was a no show for last month's hearing and he has not attempted to contact Milano since.

"Gossip Girl" Divorce Gets Even Nastier

Kelly Rutherford, who plays Lily van der Woodsen on "Gossip Girl," claims her husband is ominous, violent and bad news for their kid.

Rutherford filed legal papers that the judge will consider tomorrow in a showdown hearing. Rutherford's estranged husband, Daniel Giersch, wants the judge to prohibit his soon-to-be ex-wife from taking two-year-old Hermes to NYC to film the show.

Rutherford claims Giersch has gotten into blowout arguments with her, in one case allegedly coming at her. She says he's an avid boxer and kickboxer and she is "intimidated by him."

She also says he's threatened to teach her a lesson by taking the child. She says it's gotten so bad she called the cops twice and he's been forced to leave.

Giersch has claimed the kid is totally stressed out around Rutherford and that she can't be a real mom because her shooting schedule is insane. She says it's just not true.

Piven's Fish Line Doesn't Fly with Producers

TMZ has learned Jeremy Piven's mercury-poisoning story isn't holding water with the producers of his show -- and they've filed an official grievance with Actors' Equity, the union that handles Broadway stars.

In a statement, one of the the show's producers, Jeffrey Richards, announced, "The producers of SPEED-THE-PLOW have officially filed a grievance with Actors' Equity re: Jeremy Piven's departure. A date for these proceedings is to be determined."

As we first reported, Piv ditched the show two months early, claiming he was suffering from a sushi-induced "mercury poisoning."

We know he was examined by another set of doctors for a second opinion. The results of that exam aren't yet known.

UPDATE -- Jeremy's rep tells TMZ, "The claims made by the producers of Speed-the-Plow are absurd and outrageous. Mr. Piven's serious medical condition has been well documented by multiple physicians. He withdrew from the play due to medical necessity on the advice of his doctors, after he was hospitalized and warned by his physicians that enforced rest was necessary in order to avoid serious medical problems, including a heart attack.

"His symptoms included extreme fatigue, spacial problems, difficulty remembering his lines, difficulty maintaining his balance, and an alarmingly low resting heart rate. Mr. Piven followed his doctors' advice, although his forced withdrawal from the show was an enormous personal disappointment since it was a life-long dream to perform on Broadway."

Lindsay Violates Probation -- Technical Foul

Lindsay Lohan went under the radar in Bev Hills court yesterday for a progress report in her DUI case. We've learned she didn't follow all the terms of her probation ... and one of those terms says something about her relationship with Sam Ronson.

Lindsay has moved out of Sam's house officially. We've already reported that, but now we've learned the move has had an impact on her criminal case. Lindsay has changed her address (from Sam's house) and was supposed to re-enroll for her alcohol education course at her new address. The deadline for re-enrolling was January 2, but Linds was 10 days late.

Ultimately, it was no harm, no foul and her lawyer Blair Berk squared everything away with the judge.

PS -- interesting that Lindsay goes to alcohol education courses by day, and bars by night.

If "American Idol" wannabe Emily Wynne-Hughes manages to stick around for a while, you might get to see the first contestant perform with an alcohol monitoring bracelet!

Turns out Emily -- the same tattooed chick who can't seem to keep her pants on -- is smack in the middle of a DUI fiasco, and she has been ordered to wear a SCRAM bracelet.

The whole thing is over an arrest back in July, where cops busted her for allegedly driving drunk in West Hollywood. Emily copped a plea to a lesser charge of reckless driving.

In addition to the bracelet, Emily was placed on 3 years probation.

We've learned there may be another hearing and the judge could back down on the SCRAM bracelet -- but for now the order stands.

Serena's mom on "Gossip Girl" could face an untimely death unless a judge lets her fly.

Kelly Rutheford (Lily van der Woodsen) has a big problem. We've learned she went to court last week and pleaded with the judge in her divorce case to let her go to NYC with her two-year-old, Hermes. The judge shut Kelly down, telling her he'll take the issue up a week from today.

Kelly's going through a mega-nasty divorce with her hubby of 2+ years, Daniel Giersch.

Now here's the problemo. Sources on "Gossip Girl" tell us Kelly is supposed to be in New York to shoot by January 27. If the judge shuts her down next week that's not going to happen. Producers could deal with a small delay and shoot her out of sequence, but if the delay is longer they could just shoot her -- as in her character.

Kelly is pregnant with their second kid. Giersch doesn't want Hermes to travel to NYC because he claims Kelly works insane hours and gets totally stressed out when she's shooting.
