Sources close to the deal tell TMZ that the proposed Heidi sex tape would include footage from both before "The Hills" star had extensive work done and after. So in some of the footage she probably makes a lot of different facial expressions and in the rest ... not so much.

As we first reported ... Heidi's soon-to-be ex, Spencer Pratt, is shopping around a Heidi sex tape to Vivid Entertainment that supposedly "makes Kim Kardashian look like an amateur."

We're told Spencer has contacted the Rolls-Royce of porn -- Vivid Entertainment -- and is asking for a meeting.

As we first reported, Heidi has threatened to sue Spencer over a tell-all book -- but she has not made any mention of a sex tape. Unclear if the alleged sex tape with Heidi is pre or post-op.

Vivid honcho Steven Hirsch tells us, "I just got off the phone with Spencer Pratt about a sex tape with Heidi Montag."

He continues, "We are in early negotiations to possibly come to terms for a deal."

Spencer has told a friend that the alleged tape "makes Kim Kardashian look like an amateur."

We just spoke to Montag who tells us, "This is exactly why I left him ... Right now I'm looking into my legal options."

Spencer had told Us Weekly that he plans on spilling everything about his relationship with Heidi Montag -- including new details about her tormented relationship with her mother, Darlene Egelhoff.

TMZ has learned ... the divorce of Heidi and Spencer will become final on February 14, 2011.

Heidi's lawyer, Jodeane Farrell, tells TMZ she just received Spencer Pratt's signed acknowledgment that he's been served with divorce papers. Under California law, Heidi has to wait 6 months after Spence gets served before the divorce is final, and Spencer was served on August 13.

Fun fact: Heidi says she formally separated from Spencer on their first wedding anniversary.

Heidi Montag took the next big step to end her marriage to Spencer by authorizing service of divorce papers. We're told Spencer received and signed the papers last week, which means the divorce can become final exactly six months from the time Spencer got the docs.

Heidi's lawyer, Jodeane Farrell, tells TMZ ... "Both Heidi and Spencer are in agreement to settle their divorce as quickly as possible without the need of a court appearance."

The move comes just six weeks after Heidi filed for separation ... citing irreconcilable differences.

23-year-old Montag married 26-year-old Pratt in April 2009 -- right before she underwent one of the most intense plastic surgery runs we've ever seen.

According to court documents, Montag is asking the court to terminate Pratt's right to spousal support.

We've learned Heidi has picked Jodeane Farrell to handle her divorce and this lawyer isn't playing games ... she's already taking steps to get the quickest divorce possible in California.

Farrell -- who has practiced as a family law specialist for 24 years and currently handles divorce mediations -- will be setting up a meeting with Heidi and Spencer in approximately two weeks. We're told both Heidi and Spencer want the divorce mediated -- meaning the two will try and hash out a property settlement privately, wait the six months required by California law, and end their marriage.

Heidi wants Farrell to be the mediator, provided Spencer is down with it. Farrell has close family ties with the Montag family, but she tells TMZ she doesn't think there will be a problem in mediating the deal.

Farrell plans to meet with Heidi and Spencer together, and if he's on board she'll schedule a meeting with their accountant to go over assets and liabilities.

And Farrell says ... so far things are "very amicable" between Heidi and Spencer.

Heidi did not file divorce papers. The legal significance of legal separation is that her earnings will become her separate property from the date of separation. Heidi lists the date of separation as today, June 8.

Interesting ... under the section, "community assets and debts," Heidi wrote, "No such assets or debts." It's unclear if Heidi and Spencer have a prenup which keeps their assets separate, or if they're broke.

Heidi tried filing in Malibu -- of course -- but the Malibu courts don't do divorces.

Heidi filed the legal docs in her own handwriting. There's no evidence she has a lawyer.

Story developing...

It all has to do with the $5.5 million Malibu pad where Heidi and her friend Jen Bunney claimed they moved in to so Heidi could get away from Spencer.

But TMZ has learned the lease for the place was signed two days before Heidi's rep confirmed the split -- and neither Heidi nor Jen were named on the lease ... neither is Spencer. We're also told the lease is only three months long with an option to re-new for six months or a year.

So we have to ask the question ... did somebody KNOW the breakup was coming? Why would somebody else sign the lease unless they had something to gain ...somebody like a reality show producer?

TMZ obtained these pics of the bachelorette pad where Heidi and her pal Jennifer Bunney will be living/videotaping this summer.

The bearded & ring-clad 26-year-old told us Heidi is still his ideal mate -- but since she moved out ... he's gotta move on.

He also took a shot at Heidi's reality replacement partner -- Jennifer Bunny -- insinuating that she's using Montag to get famous.

TMZ broke the story ... Heidi separated from Spencer and is moving to Malibu with BFF Jennifer Bunney.

Bunney tells us Heidi felt an obligation to "The Hills"
to stick it out until the show wrapped. Curiously,
Bunney says she and Heidi will shoot a Malibu-based reality show this summer.

Heidi has not made up her mind on whether she'll
divorce her hubby, Bunney says.

As for why the marriage hit the skids, Spencer, Heidi says, was so controlling she lost her friends and family. And now, we're told, Heidi's mom wants to reconcile with her daughter. No word if Heidi will be receptive.

TMZ broke the story yesterday that Heidi has separated from Spence. We're told she has been complaining bitterly that Spencer is so controlling he isolated her from all her friends.

The final straw, however, was earlier this month, when Spencer called the cops on Heidi's mom when she came a callin'.

And, Heidi is saying, she wants to break into acting but says people in Hollywood don't want to work with her because she has "a loose cannon of a husband."

We're told Heidi will be renting a Malibu beach house with Jennifer Bunney (right), one of her best friends. As Heidi herself puts it, "I want more girl time."

Bunney tells TMZ ... "Heidi has spent so much time with Spencer and now she wants to be able to spend more time with herself and friendships."

And Bunney says ... she and Heidi will be doing their very own reality show which begins filming in July, which will focus on their relationship struggles and ... of course ... plastic surgery.

So we ask ...

Heidi's rep tells TMZ, "Heidi is looking to move out due to all the fake bad press that Spencer controls. She's tired of it and is looking for a place and wants to focus on her acting career."

We're told Heidi -- pictured above with Spencer in Malibu last Friday -- is looking for a new place to live ... in Malibu.

As TMZ first reported, Heidi and Spencer called the police on Heidi's mom a few weeks back ... so there's been plenty of turmoil.

A source close to Heidi and Spencer tells TMZ the tension in the relationship has been building for a while now ... "It wasn't just a sudden thing."

Now it makes sense ... On Tuesday, Heidi tweeted, "I am not Heidi Pratt, I am Heidi Montag."

Holly has been a staunch defender of her mother during the televised family feud with Heidi and Spencer Pratt on "The Hills."
