The L.A. County Dept. of Children and Family Services barged into Brooke Mueller's home the night following her OD, and turned the place upside down looking for drugs ... this according to Brooke.

Brooke is telling friends, DCFS investigators showed up hours after she returned from the hospital December 7th -- as we reported, Brooke was unresponsive after taking way too much Adderall.

Brooke says investigators tore her house apart for six hours, searching for signs of drug use, but finding nothing except a lone cigarette butt on the floor of the master bathroom.

We're told DCFS grilled Brooke ... to find out if she smoked indoors with the children present. We're told Brooke told investigators she smokes in her bathroom with windows open, far from her kids.

We're told DCFS woke up her twin boys and asked them questions like, "Has mommy ever touched you?" They also checked the boys for signs of physical abuse ... again finding nothing.

As we first reported, the kids are now with Charlie's second ex-wife, Denise Richards, while Brooke's in rehab.

Charlie Sheen's 2nd ex-wife Denise Richards got an interesting early XMAS gift -- twins ... but they're not hers ... they're Brooke Mueller's.

Sources close to Charlie and his exes tell TMZ ... Brooke asked Denise to care for Bob and Max while she tries rehab for the 19th time, and Denise happily obliged.

As for why Charlie isn't caring for the 3-year-olds ... we're told he doesn't have the time because he's shooting "Anger Management."

Our sources tell us ... Denise will care for Bob and Max for "an indefinite period of time."

It's pretty interesting ... not only is Brooke confident the kids will be well cared for, but Charlie is also happy Denise is taking care of his entire brood.

And get this ... we've learned this isn't the first time Bob and Max have stayed with Denise. The last time Brooke went to rehab, the kids stayed with D.R..

Hey everyone, wanna hear a really nice Charlie Sheen story? Great ... 'cause the actor just cut a massive $75,000 to help a little girl fight cancer.

TMZ has learned ... Charlie was recently having a conversation with a Hermosa Beach police officer (don't worry he was not being arrested) and learned about a cop whose 10-year-old daughter Jasmine had been diagnosed with Childhood Rhabdomyosarcoma.

FYI -- CR is a nasty form of cancer that occurs in the muscle tissue and requires over a year of expensive medical treatments like chemo and radiation therapy.

We're told ... Charlie told the officer, "No parent should have to watch their kid go through that" ... and vowed to help.

The next day Charlie fired off a check for $75,000 to the Hermosa Beach Police Assoc. -- which had started a fund in Jasmine's honor.

And there's more ... Charlie's stunt-double Eddie Braun also chipped in --and cut a check for an additional $25,000 ... which is almost more impressive, since he doesn't even make a fraction of what Charlie makes.

We're told the family is extremely grateful for the donation and is hopeful his actions will inspire others to join the fight against CR.

While her mother and her sister battle it out for custody, 14-year-old Ariel Winter returned to the place where she's needed the most ... the "Modern Family" set.

Winter was spotted in L.A. a few days ago, taping a scene with castmate Sofia Vergara.

During the shoot, Winter was carrying a mystery cooler, Vergara was carrying an iPhone and the gay uncles probably were out doing something stereotypically flamboyant.

As we previously reported, Sofia ... just like Ariel's older sister Shanelle ... has posed for a few racy photos in her career, like the one below (taken last week).

Brooke Mueller's 3-year-old twins were NOT left to fend for themselves after Brooke was hospitalized on Friday ... in fact, we're told, they were being cared for by Brooke's live-in nanny.

We broke the story ... Brooke was rushed to the hospital yesterday morning after she passed out cold and was unresponsive. Her family believes the incident was drug related, but Brooke was adamant she was just reeeeallly tired.

Sources close to Brooke tell TMZ that while in the hospital, Brooke's nanny stayed with her boys at Brooke's house. We're told the nanny has been living with the family for years.

And despite having other "parental" options -- like Charlie Sheen (their dad), Denise Richards, or Brooke's mom -- we're told the kids will 100% stay put at Casa de Brooke, under their nanny's watchful eye.

Gabriel Aubry spent some long-awaited quality time with his daughter Nahla today ... for the first time since he and his baby mama Halle Berry called a truce.

As we previously reported, Halle agreed to drop the restraining order that prevented Gabriel from having any contact with his 4-year-old daughter.

Gabriel was still sporting shades during the meeting ... covering up the shiner he received at the hands of Halle's fiance Olivier Martinez during a Thanksgiving Day brawl at Halle's place.

Kelsey Grammer didn't need to say a word last night when we asked him about the whole "baby in the car seat" mess ... he simply held up his 4-month-old daughter ... who just happened to be in a car seat.

You'll remember ... Kelsey and wife Kayte caused quite a commotion when they pulled a Britney ... which in this case means they drove off with their baby NOT secured in a car seat.

The couple claimed the video didn't tell the whole story and the car carrying Kayte and the baby swung back to pick up Kelsey ... who had a car seat waiting.

But last night, Kelsey made sure the paparazzi knew Faith was riding in a car seat ... which he showed off right in front of Boa Steakhouse so everyone could see ... including a certain ex-wife.

Mel Gibson knows what women want ... or at least 10-year-old girls ... because he recently went on a play date with two young ladies as part of the charity he works for -- and bought them expensive custom dolls!!!

The charity's called Mending Kids International -- an organization that performs life-saving surgeries for children around the world ... in this case, a 10- and an 11-year-old girl from Honduras who required serious reconstructive face surgeries.

The surgeries were a success -- and Mel celebrated with the girls by taking them out for a stroll around The Grove in L.A., eating lunch, ice cream, window shopping ... and finally, taking them on a trip to the American Girl doll store, where Mel helped them assemble their own look-alike dolls.

FYI -- the store ain't cheap.

Mel -- who's also participating in the Mending Kids celeb poker tournament this weekend in West Hollywood at the London -- tells us, "It was really fun spending time with Karol and Sara ... They have been through so much and are just so inspirational to everyone who meets them."

Mel adds, "At home, these girls couldn't leave their homes for fear of being tormented. Now, they are walking through one of the most popular tourist areas of Los Angeles."

Kelsey Grammer claims he and his wife DID secure their baby in a car seat before they left LAX yesterday.

Grammer's rep tells TMZ ... at some point, before the family left the airport grounds, Kelsey loaded up a car seat and strapped baby Faith inside before they hit L.A. city streets.

Since the footage we posted earlier appears to show Kayte and the baby inside the vehicle WITHOUT a car seat, the rep may be insinuating that the car circled around the airport and picked up Kelsey, who eventually retrieved a car seat. It does appear ... after Kayte and the baby drove off, Kelsey went down to baggage claim and picked up the luggage that was checked.

As we previously reported, it's against CA car seat law to have a 4-month-old child inside of a moving vehicle without a car seat ... so even if the car JUST circled the airport, they still broke the law.

So, we gotta ask ...

Kelsey Grammer's 4-month-old baby doesn't just party at the Playboy mansion ... she also dangerously rides in vehicles WITHOUT A CAR SEAT ... and it was all caught on tape.

Kelsey and his wife Kayte arrived at LAX yesterday with their adorable (and fragile) baby daughter Faith ... when they were met by a waiting chauffeured SUV.

But as Kayte was about to enter the car with the kid, she realized there was no car seat in the SUV ... but she got in the car with the baby anyway.

Kayte seatbelted herself in the car, and with the baby cradled against her chest, the car took off ... a clear violation of the California car seat law.

We're assuming the baby made it home unfazed ... but according to various safety organizations, it's a STUPID risk to transport your newborn without a proper child safety seat ... considering car seats can significantly reduce the risk of injury in an accident.

Of course, Britney Spears took all sorts of heat when she drove around with her baby in her LAP several years ago.

Kelsey's rep, Stan Rosenfield, insists there was a car seat inside the vehicle ... though there's no evidence of that in this video.

Kourtney and her adorable four-month-old daughter were seen during a lunch outing in Fort Lauderdale the other day.

There is definitely a reality TV spinoff in Penelope's future.

Ex-NFL star Warren Sapp is desperate to lower his child support payments ... even though he struck a deal with one of his baby mamas to NEVER change the amount -- of course, that was before he went broke.

Sapp filed legal docs in Florida, requesting his child support to Angela Sanders be decreased from $2,500 per month ... because he's fallen on hard financial times since retiring from the NFL, a.k.a. he went bankrupt.

Problem is, back in 2001 -- when Sapp was a Tampa Bay Buccaneers cash-making superstar -- he and Sanders added a clause to their child support agreement that said ... neither party could "seek modification" based on changes in income.

Presumably, Sapp was trying to protect his millions.

Sanders tells TMZ she's "frustrated" by Sapp's request ... because she was fine sticking to the $2,500 a month while his pockets were getting fatter -- so it's unfair for him to lower it now.

According to the docs, Sapp is also trying to modify child-support payments for his 4 other baby mamas.

A judge has yet to rule.

Sometimes, but not often ... someone says no to the Kardashians -- just ask super mom-ager Kris Jenner who recently tried to hire "X Factor" finalists Emblem3, but the boys said no.

Sources close to the K-clan tell TMZ ... Kendall Jenner is obsessed with the Cali boy band and wanted them to play a gig at her recent 17th birthday bash. We're told her famous fam stepped in to help -- Khloe (who is hosting "X") got the band's contact info and Kris made the call. Problem is ... the boys declined.

According to our sources, since Wesley, Drew and Keaton are still competing on the show, they couldn't find the time in between rehearsals to do the party ... though we're told they would have loved to.

Despite the set-back, little Jenner still had a great time ... prolly 'cause her super rich parents turned their pool (ya know, at their giant mansion) ... into her own personal ice-skating rink.

One day after a mildly eventful Thanksgiving at home, Halle Berry took her daughter Nahla to see Yo Gabba Gabba at the Nokia Theater in Downtown L.A.

As TMZ first reported, Gabriel Aubry (Halle's baby daddy) was arrested Thanksgiving morning after a melee at Halle's house, which sent both Gabriel and Halle's fiance, Olivier Martinez, to the hospital.
