Kelly Rutherford just lost big in court, and her kids are now on their way to the airport to return to Monaco.

A judge just enforced a court order giving Daniel the right to keep the 2 children in Monaco, while he works out his residency issues with the U.S.

Kelly had refused to return the children after having them for 2 months this summer, arguing the U.S. courts had no authority to order their return. But today a judge disagreed.

We're told Daniel Giersch's mom took the 2 children from the NYC courthouse and they are on their way to the airport to return to Monaco.

There's a hearing on Sept. 3rd in Monaco regarding custody.

8:58 AM PT -- The couple's kids have arrived at court.

Kelly Rutherford defiantly showed up for the court hearing where she's supposed to surrender her children to her ex-husband -- but she did NOT bring the kids.

TMZ broke the story ... Kelly was ordered to appear before a NY judge because Daniel Giersch is demanding Kelly return their two kids to him in Monaco. Kelly's visitation period ended last week, but she's refusing to send them back to Daniel.

He insists Kelly's basically a child abductor now. The judge specified Kelly needed to bring them to court today, but it looks like she's not willing to give in ... not yet.

Giersch is not in court, but his mother is there ... hoping, we guess, to take custody of her grandchildren.

TMZ has learned, a New York judge just made the order at the behest of ex-hubby Daniel Giersch, who claims Kelly is a child abductor who has no right to keep the kids beyond the visitation period which ended last week.

Kelly says she's been to court in L.A. and New York and the judges in both states have said they have no jurisdiction over the case, therefore no one can order her to return the kids.

Giersch begs to differ, claiming he has a custody order that's legally binding on her, so she's now nothing more than a criminal.

The judge has said Kelly needs to be notified by 3 PM today about tomorrow's hearing, but service can be accomplished by email or a secured message to Facebook.

It's all fun and games ... until a train almost kills a kid 'cuase they were playing too close to the tracks.

According to our sources, Brown plans to file an opposition to Nia Guzman's request for full custody ... countering her claims that he's a bad father. Guzman has cited several issues with Chris' parenting and lifestyle, but we're told he has a comeback for each one.

First off, we're told Chris will argue he never puts his daughter in harm's way and has increased security at his home since the recent break-in.

Secondly, our sources says Chris will say he has never done drugs around Royalty.

Lastly, we're told Chris will argue he has never allowed "gang bangers" to be around his daughter.

Chris has filed his own docs to establish paternity so he can fight for joint custody, but so far a judge has not ruled.

Chris Brown's baby mama fears for the safety of their daughter when she's alone with him ... so she's asking a judge to ONLY allow him to see 1-year-old Royalty when someone else is around.

We're told Nia Guzman just filed the legal docs for supervised visitation. Chris has filed his own docs to establish paternity so he can fight for joint custody, but so far the judge has not ruled.

We're told Guzman wants full custody because she thinks Chris is simply too irresponsible to care for a kid on his own and she believes he and his friends all have substance abuse issues. He thinks it's all just a ploy to get more child support.

Charlize Theron's family has grown by one ... TMZ has learned she's adopted a second child.

We're told Theron worked with an adoption agency for 6 months to seal the deal. The child, an African-American girl, was born in the United States. Charlize took custody of the newborn in July.

The baby's name is August ... just like now.

Jason “Jace” Alexander spent a decade directing "Law & Order" but Wednesday he was living out an episode when he was popped on child pornography charges.

Alexander was charged with two felonies -- possessing and sharing illegal and obscene performances of sexual conduct by children under the age of 17.

He was nabbed after an investigator downloaded child pornography off the internet and traced the file’s IP address back to Alexander’s address in New York.

Cops searched Alexander’s home and say they found computers and external hard drives stocked with files of minors engaged in child pornography.

His bail is set at $10k. He faces 7 years if convicted.

Carmelo Anthony's son is a BEAST on the court -- and he's only 8 years old ... with his youth team crushing it in a 3rd grade national tournament ... despite the fact they're only 2nd graders.

Kourtney Kardashian has calmed down since her split from Scott Disick, and she's not only willing to share custody with Scott ... she wants it that way.

Kardashian sources tell us, Kourtney believes 5-year-old Mason, 3-year-old Penelope and 7-month-old Reign need to have a real, meaningful relationship with their dad. So she wants to hammer out a formal custody agreement which not only gives them joint custody ... each will spend a substantial amount of time with the kids.

Our Kardashian sources confirm Kourtney met with disso-queen Laura Wasser last Monday. It's significant because Wasser is known in divorce lawyer circles as an attorney who always pushes for joint custody.
