Lindsay Lohan may have gotten away with it again ... she checked into a rehab facility that was NEVER approved by prosecutors and the judge seems like he's down with the change.

TMZ broke the story ... Lindsay checked into Morningside Recovery this morning in Newport Beach. As we previously reported ... prosecutors and Lindsay's lawyer, Mark Heller -- who wore a tie that could itself be a felony -- had agreed she would enroll in Seafield Center in Westhampton Beach, NY. Heller never gave prosecutors a heads-up that Lindsay was flying to CA last night to enroll in Morningside.

As we reported, Lindsay made the change because Seafield wouldn't let her smoke at the facility ... but smoking was permitted at Morningside.

A furious prosecutor -- Santa Monica City Attorney Terry White -- clearly felt blindsided by the change, saying he learned about it from the media yesterday. White also expressed misgivings about Morningside, saying he found 3 articles "condemning" the facility.

As for what prosecutor White was talking about ... in 2012 State investigators suspended Morningside's license for allegedly being careless with prescription drugs. And at least 9 families of patients reportedly sued the facility for failing to deliver treatment. At the time, a State official called Morningside, "a substantial threat" to the health and safety of the public.

But Judge Jim Dabney looked at some of the paperwork about Morningside and said on its face it seemed like the rehab joint was acceptable, but he's giving prosecutors a week from Friday to investigate.

Lindsay Lohan was fiending last night ... not for drugs or alcohol ... for expensive designer clothes -- so she hit up Chanel for a last-minute pre-rehab shopping spree.

Lohan -- accompanied by an entourage -- hit up the Chanel store in NYC last night, where she browsed the high-priced inventory ... before leaving with a bag full of new stuff.

As we previously reported, Lohan was SUPPOSED to enter Seafield Center rehab facility in Westhampton Beach, New York this morning ... but she's refusing and we're told she's en route to a different rehab facility in Newport Beach, CA.

Lindsay Lohan is in BIG TROUBLE ... She's thumbing her nose at prosecutors and flying to California tonight ... presumably to enter a rehab facility that is not part of her plea deal.

Sources familiar with the situation tell TMZ ... Lindsay is about to board a private jet in NYC.

TMZ broke the story ... Lindsay's lawyer and prosecutors agreed she would enter the Seafield Center rehab facility in Westhampton Beach, New York. She's required to show up by tomorrow morning.

But as we reported earlier, Lindsay was freaked out because Seafield won't allow her to smoke. We're told she may be headed for Morningside Recovery in Newport Beach, CA ... which does allow smoking.

Problem is .... prosecutors did NOT sign off on Morningside. What's more ... we've learned NO ONE from Lindsay's camp has contacted either the L.A. City Attorney or the Santa Monica City Attorney to get the change of plans approved.

In short ... by not entering Seafield ... Lindsay has violated her plea deal. Lindsay's lawyers are in court tomorrow along with prosecutors, where her attorneys are required to show proof of enrollment in Seafield. It's a good bet the judge is going to be pissed, and a better bet prosecutors will be pissed.

If the judge believes Lindsay has violated the deal, he can throw her in jail for 90 days.

Lindsay Lohan has less than 24 hours to hightail it to Seafield Center in New York ... but even as she packs her bags she's telling people she may bail on the rehab facility because they won't let her smoke.

Sources close to Lindsay tell TMZ ... she doesn't think she can hack not smoking for 90 days.

We're told Lindsay asked her lawyers to try and convince Seafield to make an exception and, failing that, find a facility that would let her puff away.

Sources say Seafield was unbending -- no smoking, no exceptions. So lawyers triggered Plan B -- we've learned they contacted Morningside Recovery in Newport Beach -- a place Lindsay once rehabbed at for a short time in 2010.

Morningside staff tells TMZ ... they DO allow smoking. Problem is ... we've learned the City Attorneys for L.A. and Santa Monica haven't signed off on Morningside. We're told prosecutors had no idea Lindsay is thinking of bailing on Seafield.

Lindsay is acting like she's going tomorrow ... She Instagrammed this photo of herself packing, saying, "90 days and 270 looks."

Lindsay's lawyer is supposed to appear in court tomorrow with proof of enrollment -- and the expectation is that she'll have enrolled at Seafield.

Tara Reid is no fan of Lindsay Lohan ... and Lindsay Lohan ain't too fond of Tara either ... so says the "American Pie" star.

Tara hosted "TMZ on TV" yesterday ... and told us she and LiLo have some serious issues, despite the fact they run in the same social circles.

"We don't really like each other that much," Reid said ... "If I get drunk, I'm a happy drunk. When she gets drunk, she's just mean."

Tara even gives examples.

Still, Reid believes Lohan will eventually get her life back on track ... because people keep giving her "chance after chance after chance after chance."

Straight out of the Ross Geller handbook ... Michael Lohan tells TMZ his secret love child was NOT the result of an affair ... claiming he and Dina Lohan were ON A BREAK when he inseminated another woman.

We broke the story ... DNA results proved Michael is the father of 17-year-old Ashley Horn -- who was born in 1995, while MiLo was still married to Dina.

But Michael tells TMZ ... he does NOT classify the relationship as "cheating" or "an affair" because ... "Dina and I were separated and living separately at the time for 8 months."

Michael is also calling BS on his other daughter Lindsay Lohan -- claiming there's no way she could have been in the dark about the love child because, "Dina has been telling our children that Ashley is my daughter for years, without even knowing the results. So how could this be news to our children?"

An argument outside BOA last night ... Michael Lohan claiming he was puked on ... a witness claiming MiLo was the one who did the puking.

According to Walters, Michael's car was slowly approaching a stoplight near the Director's Guild of America when the bus attempted to pass him ... and accidentally sideswiped Lohan's car.

Walters got out of his car and checked on Lohan -- who said, "Of course you're here when I get hit by a bus ... we exchanged information and everything is fine."

Walters says Lohan's car only appeared to have minor scratches and scrapes and Lohan was not injured.

Sources close to Lindsay tell TMZ, the actress has no plans whatsoever to become a Scientologist -- she hasn't taken any classes with the Church ... and hasn't even been asked to visit by current members.

We're told Lindsay has nothing against the Church -- but she was raised Catholic and plans to stay Catholic ... in fact, she remains an avid practitioner to this day.

Sources close to Lindsay tell us ... she had considered Lorne a mentor and a father figure -- and felt betrayed that he would let Miley mock her on TV -- so LiLo sent an email to let him know she was upset.

In case you missed the show -- Miley finished her opening monologue with a musical number which included the lyric, "I never stole a necklace or got a DUI .. never cheated on wife like that golfer guy ... so what if you can see a little boob from the side ... I'm sorry if I'm not perfect."

The mug shot was taken this morning after she was remanded into custody.

Lindsay Lohan will have a hard time staying clean and sober if she doesn't have a strong support group after rehab. That means she'll need to surround herself with an entirely new entourage -- who won't enable her addiction.

Just before entering rehab, our spies caught Lindsay "dining" with friends at Orso in Los Angeles. Lohan ordered a salad, and barely touched a leaf. When she ordered a cocktail and was asked to show her ID, Linds recoiled and asked for a water instead. Our spy then watched as her friends ordered drink after drink for her -- which Lohan consumed. After lunch, Lindsay jumped into her Mercedes convertible and sped off with the stereo blaring.

Amidst a flurry of paparazzi camera flashes, La Lohan made her way through L.A. yesterday proudly sporting a mysterious red chip with the words "90 Days" on it -- begging the question, what exactly does it mean?

It was a drama filled night Friday at Hyde, a Hollywood hotspot packed with celebrities. Sources inside the club tell TMZ there was a ton of trash talk between Lindsay Lohan and the Hilton sisters. At one point, sources say, Lindsay and Paris were literally face-to-face in a heated spat.

Paris' rep, Elliot Mintz, plays down the incident. "Inside the club," he says, "Paris was having a conversation with a couple friends. Lindsay approached her table and at that moment Paris felt she was being interrupted and didn't wish to speak with Lindsay. A couple of words were exchanged and Lindsay went back to her table. I can understand how other patrons in the club could have thought it had been a bigger deal then it actually was.
