According to California law, the plaintiff in a medical malpractice, wrongful death suit must give 90 days notice before filing the case in court.

Brian Oxman, Joe Jackson's lawyer, tells TMZ the suit will ask punitive damages, economic support, loss of companionship and loss of consortium (deprivation of family relationship). It will seek an unspecified amount of money damages.

Oxman says the case will be filed in L.A. County Superior Court. So far, only Joe has signed up, but Oxman says he will add any family member who wants in as a plaintiff.

UPDATE: Ed Chernoff, Dr. Murray's lawyer, just reacted to Oxman's move by saying, "That's like throwing a bucket of water on a man drowning in the ocean." Translation -- good luck collecting anything.

TMZ has confirmed producers of "Two and a Half Men" have scuttled two of the last four episodes because Charlie Sheen's rehab derailed the production schedule.

But here's the deal. We're told Charlie has a right under his contract to 86 the last two episodes. Sources tell us Charlie is only contractually bound to do 22 episodes, which he will have done. He wasn't required to do 24 episodes this season, although that was the plan.

TMZ has learned a former high level, female executive with West Coast Choppers settled a sexual harassment lawsuit against Jesse James and West Coast Choppers for more than $700,000 in 2007, while he was married to Sandra Bullock ... according to documents.

The woman claimed between 2006 - 2007, Jesse James repeatedly made sexual advances, which allegedly included sexual acts.

The woman kept several suggestive emails from Jesse. In one email in 2007, which is included in the file, Jesse wrote to the woman, "Need anything before I split?" She responded, "Some Tums." Jesse replied, "I have some special fluid that you can drink and it makes it all better ...."

And, she claims after an oral encounter with Jesse, she kept a telltale Clintonesque T-shirt.

The woman quit in 2007 and hired Gloria Allred's law firm to represent her. No lawsuit was ever filed, but on September 27, 2007, the matter settled for $725,000.

In the settlement docs, Jesse neither admitted nor denied the allegations.

Haddon's Denver-based firm, Haddon, Morgan & Foreman, has handled a number of high-profile cases. Pamela Mackey, a partner in Haddon's firm, pummeled prosecutors in Kobe's sexual assault case until they threw in the towel and the judge dismissed the charges in 2004.

We've learned Haddon has told Charlie's team he would take the case and we're told he will "probably" get it, although not everyone on Charlie's team thinks it's the way to go -- partly because of the association with the Kobe case.

Haddon is a Colorado powerhouse who is not afraid to go to trial -- something that could actually prompt a plea bargain.

As we first reported, Charlie's current lawyers have begun negotiations with prosecutors. As we told you, the prosecutor agrees Charlie should not go to jail. The hangup is that the defense wants to plead to a misdemeanor but prosecutors want a felony plea.

The man leading the charge is Martin Silver -- the uber-millionaire behind Georgi Vodka. Silver claims he was sorely offended when he heard that Diddy took the mic in a NY nightclub last week and announced, "If you're not drinking Ciroc vodka, then you're drinking pee pee."

Silver says he's so outraged that he plans on dumping several liters of Diddy's drink into a "large toilet bowl" -- and will deliver the crapper to the rapper ... unless he gets an apology.

The pissing match will go down tomorrow afternoon ... if he's not too yellow to follow through with it.

People close to Diddy tell TMZ this is all just a "publicity stunt" that "shouldn't be dignified with a statement."

Scott "Scooter" Braun surrendered on two misdemeanor charges -- reckless endangerment and criminal nuisance -- stemming from an incident at a mall in November.

The incident which triggered the matter occurred last November at the Roosevelt Field mall when fans got out of control and at least one girl was hospitalized.

We're told cops asked Braun to Tweet that the event had been canceled but they say he refused to do so.

Braun faces one year in jail if convicted.

TMZ has obtained a cease and desist letter Michelle McGee's manager fired off to ShockMansion.com. The website used McGee for some raunchy video shoots.

In the letter, McGee's manager demands that all videos, photos, or "graphic representations" of McGee not be posted on the website or sold for republication.

McGee's manager is threatening legal action if the videos get out.

Sources close to the couple tell us Reggie had been in NYC in the days before the split, when he became upset with reports that he was hooking up with multiple chicks behind Kim's back. Bush hopped on a jet to Miami to set the record straight with Kim in person -- and that's when the two decided to have "the talk."

We're told the split was amicable -- but as for the task of staying friends post-relationship ... well, if the Saints can win a Super Bowl ...

Global Exec Aviation and ITAS Inc. have filed legal papers against the manufacturers -- Learjet and Bombardier -- claiming the plane had "unreasonably dangerous defects" which caused it to crash and burst into flames on September 19, 2008.

GEA and ITAS have already reached financial settlements with the survivors and families who lost loved ones in the crash -- but now the companies want a judge to make the manufacturers reimburse them for the settlements.

The companies are also looking for more than $1,000,000 in additional damages related to the crash.

An IMDb employee tells TMZ, in order to change the marital status on someone's profile, the change must be approved internally by IMDb.

We do not know who submitted the change.

Bullock's rep says, "This was never authorized by anyone related to her."

BTW, on Jesse James' IMDb page, his marital status is unchanged.

Whitney Port is not the driving force behind her own clothing line -- this according to the designer who claims she did most of the work ... but got a raw deal financially.

According to a lawsuit filed Friday in L.A. County Superior Court, "Whitney Eve" -- which is advertised as Whitney Port's clothing line -- is mostly the work of designer Adrienne Baravetto.

In the court documents, Baravetto claims she met with Whitney Port and her father in 2007 to create a clothing line for women called Eve & A.

According to the suit, Baravetto claims she never signed an official contract but there was an oral agreement between both parties -- and she was promised an $80,000 annual salary plus 25 percent of the company.

Once the line got positive media attention -- and was purchased by several high-end retailers like Fred Segal -- Baravetto claims Whitney and her dad changed the name to "Whitney Eve" and cut Baravetto out of the deal.

Baravetto wants everything she says she was promised, plus punitive damages.

UPDATE: According to Whitney's rep, Baravetto's lawsuit is "baseless and without merit."

TMZ has learned McGee starred in several fetish flicks for ChloeCreations.com in which she attempted to stimulate people who have a thing for giants ... and spiders ... and goo.

In one of the clips, Michelle smashes extremely tiny dolls with her toes. In another, she's filmed from a low angle in order to make Michelle look like a giant -- nothing sexual happens.

A third video -- by far the weirdest -- features Michelle and two other women getting stuck in some weird goo ... when a spider suddenly appears and scares them ... and that's it.

Suge Knight is a wanted man once again. The former Death Row Records head honcho allegedly beat and robbed rapper Yukmouth last night ... law enforcement sources tell TMZ.

Sources say it all went down at around 10 PM at a Ralph's supermarket in the San Fernando Valley.

According to a law enforcement source, Suge and roughly 10 members of his posse allegedly beat up Yukmouth and then took $92,000 worth of jewelry from him.

Sources say Suge and his entourage are suspects and cops want to question them.

We're also told there's a previous misdemeanor warrant out for Suge's arrest -- which makes it unlikely he'll visit the police department.

Michelle McGee -- Jesse James' alleged mistress -- also modeled for a second adult webcam site ... and for this one, she took it all the way.

The extremely graphic photos and video were just posted on a site called OnHerCam.com.

According to the site, McGee "started working here approximately 2 weeks after she first started seeing Jesse James" -- but her employment didn't last long because the site operators believed McGee "wasn't a good fit."

Kim Kardashian's security team allegedly attacked a paparazzi and the kops are now on the kase ... so says a source konnected to the Kardashians.

We're told as Kim, Kourtney and her baby got out of a car yesterday in Miami, the photog allegedly got way too close and Kim's security took care of business.

Our sources say last night cops came to the hotel room where Kim is staying, knocked at the door and asked to speak with her security people. The cops questioned the bodyguards and left.

We're told the photog filed a police report and wants to press charges.

The actor who plays the British Lieutenant in "Inglourious Basterds" allegedly broke his ex-girlfriend's nose after a night of heavy boozing ... and now she wants protection from a judge, and stat.

Michael Fassbender's ex -- Sunawin Andrews -- filed a petition for a restraining order against him earlier this month in L.A. County Superior Court.

In the documents, Andrews claims Michael hit the bottle hard during a film festival in July of 2009 -- and after he woke up in a puddle of his own urine, he became violent and "threw me over a chair breaking my nose."

Andrews also says Michael allegedly dragged her alongside their car one night after they had an argument about one of her ex-boyfriends ... causing her to twist her left ankle, blow out her left knee cap and burst an ovarian cyst.

Andrews says she fears for her life and wants to keep Michael 100 yards away from herself and her two children -- and wants over $20,000 to help her pay her medical bills from the injuries he allegedly caused.

Repeated attempts to reach Michael's agent were unsuccessful.
