Mischa's Idea of a Good Time -- Pot and Pills?

A West Hollywood police source tells TMZ that when she was arrested, Mischa Barton blew a .12 on her breathalyzer test, admitted to smoking marijuana earlier that day (which cops found in her car) and had what cops say looked like prescription drugs in her car -- in an unlabeled bottle. What's the problem, officer?

Barton was popped at 2:45 AM Thursday in West Hollywood. Cops pulled her over after they witnessed her "straddling two lanes of traffic and failed to signal when making a turn."

She was arrested on suspicion of DUI, possession of narcotics and driving on a suspended license. Barton was taken to the West Hollywood Sheriff's station and was released on $10,000 bail.

TMZ has obtained both police reports taken by the Port Authority at JFK airport, filed by Kim Kardashian and her sister, Kourtney. As TMZ first reported, a Cartier watch, laptop, digital camera and almost $50,000 in diamond jewelry are among the items listed. No surprise here!

By the way, for all those who were curious, faking a police report for publicity is illegal. It is a misdemeanor that carries a maximum sentence up to one year in jail. Don't think any part of Kim is fake!

Joe Says Prosecutor's Gone Wild

Famed attorney Roy Black filed a prosecutorial misconduct motion today against Bay County, Fla. State Attorney Steve Meadows, claiming Meadows exhibited a "pattern of blatant abuse" in his prosecution of "Girls Gone Wild" creator Joe Francis. Black is asking that the case against Francis be dismissed.

The 62-page Motion To Dismiss claims Meadows violated Florida's professional code of conduct and infringed on Mr. Francis' Sixth Amendment U.S. Constitutional right to a fair trial. The motion says Meadows has a "conscious and brazen disregard for its professional and ethical obligations and the Constitutional rights of the [Francis]."

Girls Gone Contrite -- Fla. Floozies Apologize to Joe

The two girls who sued "Girls Gone Wild" sexecutive Joe Francis for using their footage without their consent, but then had their stories refuted by video evidence, have dropped their suit against Francis and his company.

TMZ has learned that Brooke Patsolic and Christina Brose have issued a statement saying that they've "agreed to dismiss our lawsuit" and say that "Girls Gone Wild and Joe Francis have suffered as a result of this law suit [sic] and our actions." The women also make it clear that Francis and Mantra Films haven't paid them a penny.

As TMZ reported last month, the women had their claims publicly slammed when video showing them consenting to being filmed was released on the Internet. "I am prepared to fight back, and I will defend myself against all baseless accusations," says Francis in a statement to TMZ.

Simpson is probably headed to the golf course today after three days in jail and hopping the first flight out of Nevada last night, Joe Francis -- waiting to face trial on tax evasion charges -- is still cooling his heels in a jail near Reno, with no end to his incarceration in sight. Yes, he's still there.

To help bring his plight to light, Francis has launched MeetJoeFrancis.com -- from inside the clink -- and it's launching today. He tells the long and sordid story of his legal woes -- ten long pages of it -- and even claims that he signed a settlement in his cell (above) with seven women who had filed suit against him for filming them while they were minors. He signed "under duress" from a judge he believed would set him free for doing so. Not true.

DeVito Gets First Crack at Makin' Whoopi on "View"

TMZ has exclusively learned that the first guest on the season premiere of "The View" will be none other than that limoncello-swillin' fluffer-lover himself, Danny DeVito.

DeVito will be visiting the new "View" on Sept. 4, which will also be Whoopi Goldberg's first day in the moderator's seat. His last appearance, of course, followed a night of boozy debauchery (and seven limoncellos) with pal George Clooney, and led to one of the more classically nonsensical talk-show-guest appearances in recent history, full of Three Stooges references and plenty of bleeped-out banter.

Of course, DeVito made out pretty well after his limonization -- he ended up starting his own line of limoncellos this year, called Danny DeVito's Premium Limoncello. No word on whether the green room will be stocked with the tart beverage.

We're also told that "The View's" first week will include appearances by Clive Owen, Regis Philbin, Larry David, and Rachael Ray.

Francis Named in Sexual Harassment Suit

A former employee of Mantra Films and Girls Gone Wild has filed a lawsuit against the two companies -- along with Joe Francis and another individual -- claiming sexual harassment, sexual battery and various unfair business practices. Employers gone wild?!

Tranae Hammond claims that shortly after she began working for Mantra Films and Girls Gone Wild, she was the victim of repeated acts of sexual harassment by a supervisor named Ron (she doesn't know his last name). According to court papers filed today, those acts included touching and massaging of her shoulders and arms, frequent conversations about sex in front of her, and on at least one occasion, Ron allegedly "tapped [Hammond's] buttocks with a clipboard."

Hammond alleges that after she made claims of sexual harassment, she was subjected to a "hostile environment" and was eventually terminated.

I returned to my cell the other day after a leisurely walk through the Washoe County Detention Center yard and received a message from Deputy Keast, the Public Information Officer, that you had called. To be honest, I was hoping that my penpal, Candy Spelling, had written me again, but to my dismay I was told that you just wanted to know how I felt about Paris being released from jail early. I was then handed a TMZ.com article titled "American I-Cons". I just thought since I seem to have some extra time on my hands these days that I would like to take a moment to set the record straight.

The "American I-Cons" title is a very clever play on words, but unlike in Paris's current situation, the title does not apply to me. I am not in jail because I have been CONvicted of a crime, but am merely awaiting a chance to vindicate myself.

Joe Francis to Candy: Back Off!!!

Joe Francis has fired back at Candy Spelling for the open letter posted this morning on TMZ. Francis is currently in Federal custody. Spelling's letter was read to Francis this morning by phone. Francis tells TMZ he wrote the response himself.

Dear Candy:

I don't know you, I have never met you and I don't know anything about you. After reading your letter posted on the internet, my mental picture of you is of a lonely old woman living in a mansion in Holmby Hills with let's say 300 cats jumping around, some in their own feces.

I have tried to think to myself what would compel a woman such as yourself to write a letter to someone they have never met? Even worse, you are making up your mind based on headlines. I can understand you writing Paris Hilton a letter out of care because as you said in your letter, you have known her most of her life. Then again, it's sad and pathetic you had the audacity to post that letter on the internet instead of just sending it to Paris personally.

Candy, you don't know any of the facts concerning my situation. I am a hardworking, compassionate and honest person. I will prevail just as I have in the past because overcoming adversity is not only a part of the entrepreneurial experience but a part of life. You should appreciate this and know this more than anyone and I am ashamed of you for forgetting how hard it is to make it in this world and the people who would love to tear you down because you have. Sadly, it appears you have become one of those people.

Contrary to what you have said in your letter, my world has not changed. My business Girls Gone Wild is thriving and posted record sales last month. Most important, my friends and my family (I love you guys....) have stood by me. This whole situation will be over soon and I will be standing strong.

I have never played a victim but I have always been a fighter. I will ultimately prevail in the matters at hand but I am concerned that you will die a lonely and unfulfilled person playing with those cats and posting open letters to people you have never met on the internet.

Francis Yanked at 4:00 AM -- Nevada Bound?

TMZ has learned that Joe Francis was taken from the county jail in Marianna, Fla., this morning at 4:00 AM by U.S. Marshals. It's unclear where he was headed -- though he's probably being sent to Nevada to face federal tax evasion charges. Sources tell TMZ that Francis could be in Nevada in a "few days."

Whatever happens to Francis in Nevada, he's expected to be back in Florida for a July court date to face charges of using minors in a sexual performance, as Judge Dee Dee Costello stipulated in Panama City yesterday. Bay County prosecutors wanted to keep Francis in Panama City, but lost their bid to do so in Federal court yesterday.

Francis in Florida -- New Jail, Happier Joe

Looks like Joe Francis' new digs -- another Florida prison -- are turning his frowns into smiles, if this exclusive mugshot is any indication.

TMZ has learned that Francis was moved last night from his cell in Bay County Jail -- which was making him cry "every day," sources told us -- to a facility in nearby Jackson County, all under the watchful eye of US Marshals. The federal government, according to sources, is planning to take Francis to Nevada in the next day or so to face tax evasion charges there.

Francis was a no-show in Judge Dee Dee Costello's courtroom this morning, even though he was scheduled to face criminal charges today -- of using minors in a sexual performance. An official in the Florida State's Attorney's office tells TMZ that his office has filed a motion with federal judge Richard Smoak to prevent Francis from leaving the state.

Joe Francis Charged in Sex Case

TMZ has learned that "Girls Gone Wild" mogul Joe Francis has just been charged with one count of misdemeanor sexual battery. The charge was filed by the L.A. City Attorney.

L.A. City Attorney spokesperson Frank Mateljan tells TMZ that Francis was at a birthday party in Los Angeles this past January when he allegedly touched an 18-year-old girl on the breast, buttocks and inner thigh. The woman allegedly repeatedly asked Francis to stop.

Francis will be arraigned May 22. If convicted, he faces a maximum six months in jail and a $2,000 fine.

Francis has a world of legal woes. He's currently in a Florida jail serving 35 days for contempt of court. He faces other charges as well.
