Kim Kardashian Excused From First Day Of Divorce Trial
Kim Kardashian is not going to attend the first day of her divorce trial ... but it turns out she's not needed.
Kim has a commitment for an appearance in New York City for her perfume line on May 6, the opening day of her courtroom face-off with Kris Humphries.
Kim's lawyer filed legal docs asking the judge to move the trial up to May 3 so she could attend, but the judge wouldn't allow it because of a schedule conflict.
But sources say the solution is simple. Kris has the burden of proving fraud in his annulment request, so he's first up in calling witnesses, and Kim won't have to take the stand until day 2 or 3.
Bottom line -- she doesn't have to see Kris' face as much as she feared.

Porsha Williams is returning fire against her estranged husband Kordell Stewart ... filing an official response to Stewart's divorce docs, claiming she gave up her life to take care of Kordell's son from another woman ... and he needs to pay.
TMZ broke the story ... Stewart blindsided Williams with divorce papers this week, claiming Porsha doesn't deserve a dime in spousal support because she is capable of earning her own income.
But according to the new legal docs, filed by Porsha's attorney Randall Kessler, Porsha's marriage set her way back professionally ... because she quit her job for two years while they were married (and even sold her businesses) in order to care for Kordell's kid from another woman.
Porsha doesn't mention the fact that she's currently starring on "Real Housewives of Atlanta."
According to the docs, Porsha's not only demanding alimony from Stewart ... she also wants exclusive use of the family's Atlanta home.
Porsha's rep told us Porsha had held off on filing her own divorce papers because Kordell had promised to work on the marriage with her ... but now, the gloves are off.

The night before Kordell Stewart filed for divorce from his wife Porsha Williams, he was hanging out with another woman -- his baby mama -- and TMZ has the pic.
Kordell -- a former NFL star who spent years with the Pittsburgh Steelers -- spent Thursday March 21 at Dave & Busters video game arcade restaurant in Marietta, Georgia with former flame Tania Richardson and their son Syre.
Sources close to Kordell tell TMZ ... Stewart was initially booked to appear at the restaurant as part of an event for a local radio station where he works ... but thought Syre would enjoy the place, so he called up Tania and invited them over.
It's unclear if Kordell and Tania talked about the NFL player's marriage ... but witnesses inside the joint tell us the two appeared to be having a serious conversation and Kordell looked stressed out.
We broke the story ... Kordell filed for divorce the very next day -- and Williams (who stars on "Real Housewives of Atlanta") claims she was blindsided by Stewart's actions.
The two were married in 2011 -- and have no children of their own.

Porsha Williams says she learned that her husband Kordell Stewart filed for divorce this week when she read it on a website ... and says she's "disappointed" by his actions.
Porsha -- who stars on "Real Housewives of Atlanta" -- released a statement through her rep saying she is "disappointed about her husband's recent filing for divorce."
The rep says Porsha had held off on filing for divorce papers herself ... because she was committed to the marriage. She says Kordell had promised to work on the marriage with her.
Instead, Porsha's rep claims, "[Kordell] misled her and she found out about the filing in the media."
The rep says, "Mrs. Stewart hopes to resolve these personal issues privately with the support of her family, friends and strong faith."
As TMZ previously reported, Kordell filed for divorce in Georgia earlier this week. The couple married in 2011.

Kordell Stewart -- the former Pittsburgh Steelers star -- has filed for divorce from his reality star wife Porsha Williams ... TMZ has learned.
According to Fulton County Superior Court in Georgia, the 40-year-old NFL alum -- who went by the nickname "Slash" during his playing days -- filed for divorce on March 22.
Stewart and Williams were married on May 21, 2011 -- they have no children together. Stewart has a son from a previous relationship.
Williams currently stars on "Real Housewives of Atlanta."
The issue of children came up often on the reality show -- Porsha wanted to have kids AND a career in charity work ... but Kordell told her she had to choose.
2:10 PM PT -- Porsha says she was blindsided by Kordell's divorce filing, claiming she learned about it from a website.
7:49 AM PT -- According to the divorce docs, obtained by TMZ, Kordell says the marriage is "irretrievably broken" ... and claims the two are currently separated.
It seems Kordell also believes he shouldn't have to pay Porsha a single cent in spousal support ... claiming, "[She's] an able-bodied person, earning income and is capable of supporting herself."
Kordell also says there are no marital assets subject to division ... which suggests there is a prenuptial agreement in play.

"MADtv" star Aries Spears has willingly given up full custody of his 3-year-old son to his estranged wife ... after allegedly threatening her life with a baseball bat ... TMZ has learned.
TMZ broke the story ... Spears' wife Elisa Larregui filed for divorce February 7, citing irreconcilable differences. In the docs, Elisa demanded full custody of their 3-year-old son.
She didn't elaborate in the divorce docs ... but four days later, Elisa filed a request for a restraining order against Aries, claiming he swung a baseball bat at her and nearly killed her.
According to Elisa's restraining order docs, Aries was also a verbally abusive father ... and had been physically abusive with one of her children from a past relationship.
Elisa scored a temporary restraining order ... and Aries subsequently threw in the towel, agreeing to give Elisa full physical and legal custody of their son.
He also agreed to stay 100 yards clear of Elisa and their son unless there's a prearranged visit.
Oh yeah, Elisa's picking up and moving to Florida too ... and Aries has agreed to foot the moving bill.
Aries Spears' lawyer tells us, "The family is mending and for the moment, they have chosen to place some distance between themselves. Aries and Elisa have been communicating peaceably and have worked things out between themselves. Aries looks forward to spending quality time with his son."

In the divorce docs, Nicole -- who was married to Jones for 10 years -- asked for primary physical custody of their 9-year-old son AND to have the prenup voided.
Now, Andruw has fired back in his own docs ... claiming HE should get primary physical custody, and not only that ... he shouldn't have to pony up a dime in child support.
A judge has yet to rule.

TMZ has learned ... before getting back together, both Dennis and Kimberly signed the divorce documents and they are sitting on the judge's desk right now, but we're told the paperwork is going through the system and the judgment will become final.
As we first reported ... a source close to the couple told TMZ back in October, "Kimberly is fed up with Dennis' cheating and wants out of the marriage. He's not a good husband." She was gunning for primary physical custody of the twins, as well as spousal support.
It's not the couple's first change of heart. Back in March, 2012, Kimberly filed for divorce but withdrew the petition two months later.
Assuming the divorce becomes final, it's unclear if Dennis and Kimberly will remarry.

Kim Kardashian secretly sat for her deposition Tuesday in L.A. ... and she testified under oath that when she accepted Kris Humphries' proposal of marriage and when she said "I do," she really did love him.
TMZ has learned ... the deposition was taken at the offices of Kim's lawyer ... disso queen Laura Wasser (the pic was taken on their way in). It lasted 9 hours.
Kris Humphries' lawyer probed for evidence that Kim defrauded Kris and only married him to goose ratings for her reality show, but we're told Kris didn't make any headway. He's shooting for an annulment based on fraud, but sources say the depo didn't help his case.
Get this ... Kris did NOT show up for the depo. His lawyer made a big stink in court that Kris had a right to be there. He didn't even have a game on Tuesday.
As for the reality show ... we're told Kim testified it played no part in her decision to tie the knot. Other than that, we've learned Kris' lawyer, Lee Hutton, did not ask much at all about the reality show and whether it was staged. Hutton has made numerous threats that he would blow the lid off the reality show during the trial, so it's surprising he virtually ignored it in Kim's depo.
Kim has been gunning for a divorce for almost a year-and-a-half. The trial is set for May 6.
