Lindsay Clancy murder case is heading back to court ... and TMZ is streaming live.
Clancy's defense team and the prosecution are going before Judge William Sullivan, with the state now requesting another trial -- and a new hearing has been scheduled for Nov. 2.
Prosecutors are fighting Clancy's request to be found not guilty for lack of criminal responsibility, arguing there was enough evidence for a jury to find her criminally responsible for killing her three children.
Clancy's attorneyKevin Reddington, meanwhile,is claiming she never admitted to doing anything and says there's no evidence suggesting she killed her children -- it's a completely different argument from the original trial.
The woman who claims she was drugged and gang-raped by seven Cornell students inside a frat house texted with one of the men she named in her lawsuit two days after the alleged encounter ... he apologized, and she told him the "sexual stuff" wasn't illegal.
CBS News New York obtained screenshots of a text message conversation between the woman and one of the seven men she sued ... and he apologized for "how things went down."
The frat bro says he should have "shut it down and kick people out before it got way out of hand."
The woman told him her memory was "super clouded too" and said, "non[e] of the sexual stuff was illegal."

We're told Dennis ended up in an assisted living facility -- and multiple sources tell us he was suffering from Parkinson's disease. His official cause and manner of death have not been disclosed.
Quinones tells us ... Dennis didn't want anyone to know that he was suffering from his illnesses, so he wouldn't return phone calls and text messages from Quinones and his friends, who were asking him how he was doing.

The Mercury News reports that Jonathan McKinsey was fatally shot Saturday in a parking lot at a sports complex in Dublin, CA.
Police arrested McKinsey's elderly in-laws, Shouyong Zhang and Shili Chen -- both 77 -- on suspicion of murder and other charges.
Citing court documents, the outlet reports that McKinsey filed a restraining order in response to his estranged wife, Candice Jang, filing her own restraining order against him in 2025.
Dennis Haskins, best known for playing Principal Richard Belding on "Saved by the Bell," has died ... TMZ has confirmed.
His agent Jay Schachter tells TMZ ... "It's a tragic loss. Everyone loved Mr. Belding and those of us who got to know Dennis, loved him even more. He was a great person, and he loved, I mean absolutely LOVED his fans."
His cause of death is currently not yet known.
He continued ... "He always had time for them, no matter what. He was my client and dear friend for over 20 years, and I will miss him terribly."
He became a familiar face to TV viewers in the late 1980s and 1990s as Principal Belding on the hit teen sitcom "Saved by the Bell."
His character was constantly trying to keep Zack Morris and the rest of the Bayside High students in line, often delivering his signature catchphrase, "Hey, hey, hey, what is going on here?"
Haskins reprised the role in several "Saved by the Bell" spinoffs, including "Saved by the Bell: The College Years" and "Saved by the Bell: The New Class."
