Mel Gibson is taking a lunch break, after getting grilled himself in a deposition ... with Oksana Grigorieva as an active participant.

TMZ has learned ... Mel somehow got in the Century City office building where the deposition is taking place without being noticed. It went for three hours this morning, before everyone took a lunch break.

Sources say Oksana has been writing notes and speaking with her lawyers about questions they're firing at Mel.

It's the first time Mel and Oksana have been face-to-face since their custody war erupted.

Michael Jackson's Kids: It's Not Daddy's Voice!

The Michael Jackson album Sony is about to release is a fraud, according to members of Michael Jackson's family.

We've learned Sony is determined to release the album for Christmas, and believes the songs are all authentic. We're told MJ and his kids were in New Jersey when he recorded the tracks with producers in 2007.

Sources tell us Paris and Prince now believe some of the songs on the album are fakes -- not Michael's voice. Sony, we're told, is convinced all of the songs are the real deal. Howard Weitzman, lawyer for the estate, tells TMZ he had experts listen to the tracks and all of the experts concluded it's Michael's voice on all the tracks.

Other Jackson family members also believe some of the tracks are phony. There is a stalemate, although at this point no one is talking lawsuit.

Oksana Grigorieva ... Face-to-Face With Mel Gibson

TMZ has learned ...Oksana Grigorieva will be front and center at Mel Gibson's deposition Monday -- the first time Oksana and Mel have been face-to-face since the custody war erupted.

Oksana's lawyer, Daniel Horowitz, tells TMZ Oksana will be "an active participant" in the deposition and will even write out questions for Horowitz to ask.

Horowitz says Oksana will be very involved, taking notes and strategizing as the depo goes on.

The wild card -- will Mel keep his temper in check?

Mel Gibson could be forced during his deposition today to listen to his now infamous tirades that Oksana secretly taped -- if Oksana Grigorieva's legal team has its way ... TMZ has learned.

Sources connected with the case tell us Oksana's lawyers are "seriously considering" playing the tapes in front of Mel, partly to show that he physically abused Oksana and partly to prove he's an unfit parent. We're told the lawyers want to ask Mel about alleged domestic violence, the rants, the works.

This is the first time Mel will testify under oath in the custody case ... and we're told Oksana's lawyers are viewing it as a "no holds barred" deposition.

Sources say Oksana's legal team will use certain statements Mel has made about his conduct on January 6 -- the day of the blowout fight -- as well as other statements to challenge his credibility.

The defense believes if Mel asserts his Fifth Amendment right against self-incrimination during the depo, Oksana's team can use that against him by pointing to the earlier statements.

As for playing the tapes in the depo ... there are big hurdles. First, our sources say the judge has imposed ground rules requiring lawyers to stay away from the domestic violence issue. Nonetheless ... the defense believes it still has the right to ask the questions.

The bigger hurdle ... Oksana and her lawyers do not have the original recordings, and Mel's lawyers will almost certainly object to a bootlegged copy being played.

We're told the depo will "definitely" last longer than a day.

Charlie Sheen's Manager: 'Death' Report Is a Lie

Charlie Sheen's manager, who minutes ago left Charlie's home, tells TMZ reports that Charlie could die this week are "reckless lies."

Mark Burg tells us ... after reports surfaced that Charlie was coked out of his mind, cavorting with hookers and in a fast death spiral ... he went to Charlie's house, entered a side door and saw Charlie sitting on the couch eating a turkey sandwich, saying, "Way to knock, dude."

Burg says he asked Charlie about the report he was at death's door and "Charlie looked at me like I was nuts."

Burg says Charlie plans on handing out lots of Halloween candy ... because his neighborhood gets besieged by trick-or-treaters.

Burg added, "He looked as normal as he's looked in a long time."

Burg says Charlie not only said he'd be on the set Tuesday for "Two and a Half Men," he impatiently asked when he was going to get a copy of the script.

What Oksana and Mel Are Really Fighting Over

The real fight between Oksana Grigorieva and Mel Gibson may not be about child custody at all ... we've learned the various lawyers who have been repping Oksana have been focused on a legal document created long before Lucia was born.

TMZ was first to report the problem with the Icon Trust -- created by Mel and Robyn to provide for their seven children. The trust defines "issue" (aka children) as kids born from Mel or Robyn. When it was drafted, no one thought Mel or Robyn would have a child outside the marriage. Enter Oksana.

Sources connected with Mel and Robyn say no one in their family wants to screw Lucia out of her inheritance, but if she becomes a beneficiary in Mel's trust it would create some complicated tax issues.

So when Oksana and Mel broke up and struck a settlement deal during the mediation in May, the very first term reads, "Oksana consents to amendment of Icon Trust to exclude Lucia."

In return for excluding Lucia, Mel agreed to provide a financial package for the baby worth more than $8 million.

Sounds like a sweet deal. So why did Oksana disavow the mediation she signed? We're told the lawyers Oksana hooked up with after the mediation believed Lucia got royally screwed by giving up an interest in the trust. They told Oksana that Lucia would stand to get around $50 million under the trust agreement ... which they believe represents 1/8 the value of a $400,000,000 trust.

Sources connected with Gibson tell us the money in the trust is not even in the universe of $400,000,000 ... not remotely close.

But here's the deal. If Oksana's lawyers persist and Mel settles out of court, the attorney would get a percentage of the settlement. So they've convinced Oksana there's something in it for her ... and there's something in it for them.

Capri Anderson -- I Will Sue Charlie Sheen

Capri Anderson is getting ready to drop a legal bomb on Charlie Sheen -- TMZ has learned the porn star is planning to sue Charlie for the events that went down during his hotel meltdown in NYC.

Sources close to Anderson tell TMZ ... she believes Charlie was acting so crazy in his hotel room at The Plaza Hotel on Tuesday morning -- that she felt her life was in danger ... and she also felt like she was being held in the room against her will.

As we previously reported, Charlie tore the room apart -- busting a chair and causing damage to several hotel items. Capri ended up locking herself in the bathroom and calling hotel security.

Capri claims Charlie also threatened her in the hotel room, although she made no mention of this to NYC cops when they interviewed her about the incident.

FYI -- law enforcement sources tell us officials have no plans to file charges against Charlie.

T.I.'s Wife -- Charged with Possession of Ecstasy

TMZ has learned the L.A. County District Attorney has charged T.I.'s wife -- Tameka Cottle -- for possessing the drug ecstasy when the couple was arrested on Sunset Strip last month.

If convicted, Tameka could face up to a year behind bars.

As we previously reported, the D.A. has elected not to prosecute T.I. for charges stemming from the incident, noting that the rapper will already be serving time in Georgia for a probation violation stemming from the L.A. arrest.

Capri Anderson -- Sheen Drama Is Good for Business

Capri Anderson's XXX stock has gone through the roof ever since she locked herself in a bathroom in Charlie Sheen's hotel room this week -- TMZ has learned the job offers are pouring in.

Sources close to Anderson tell us she's been hit up with several serious offers ever since TMZ revealed her identity ... most of the offers are "adult" in nature, but since she is a porn star -- nothing's off the table.

In fact, this morning Anderson received a $50,000 offer to appear in "multiple live adult chat sessions" for a company called iP4Play.

The company claims that, "Due to her recent notoriety, Capri Anderson would be a huge hit among fans of our service."

So far, we're told Capri hasn't made any decisions on her next career move.

Oksana Under Oath ... Again

Oksana Grigorieva is about to raise her right hand for the fourth time and sit for a deposition ... TMZ has learned.

As we first reported ... Oksana's lawyers tried to delay this deposition until Mel sat for his ... which is scheduled for Monday. The judge would have none of it, so Oksana must show up today.

The depo will cover custody issues, but we're told Oksana's statements to PEOPLE will also be hot topics.

Charlie Sheen's Boozy Dinner -- The Photos

You are looking at the martini and wine fueled prelude to the crazy Charlie Sheen incident at The Plaza Hotel in NYC Tuesday morning.

TMZ has obtained pics of Sheen and Capri Anderson at Daniel restaurant in NYC on Monday night ... when Charlie pulled out all the stops and bought/drank some ridiculously expensive wine.

The pictures clearly show Charlie and Capri connecting -- with the help of some good ol' fashioned alcohol.

And the booze didn't come cheap -- Charlie sprung for two bottles of Grand Vin de Château Latour 1959 ... which go for $5,900 a pop.

Then again, when you're in the middle of a $98 million TV deal ... Grand Vin only hurts your pocket like a bottle of Two-Buck Chuck.

Mel Gibson Can't See Lucia on Her Birthday

TMZ has learned ... Mel Gibson won't be able to spend a second with baby Lucia tomorrow on her first birthday, after being shut down by the judge.

Mel gets Lucia today but is supposed to return her to Oksana in the PM. Problem is ... Mel's primary nanny -- the one who takes the baby back and forth -- is sick, so Mel asked the judge for permission to return the kid on Saturday morning.

But team Oksana objected, arguing Mel has another nanny who is perfectly capable of transporting Lucia. And Oksana claimed in her legal papers she feels Mel already has too much visitation.

In the end, the judge kept the status quo, which means Mel must return Lucia tonight.

Howard K. Stern -- Guilty of Conspiracy

Howard K. Stern was just found guilty on two counts of conspiracy for obtaining medications for Anna Nicole Smith in his own name.

Stern was acquitted of seven other charges involving Smith. Stern is free pending an appeal.

Stern placed his face in his hands right before the verdict was read ... but had a stone-faced reaction once he learned his fate.

Stern is due back in court January 6 for sentencing.

After the hearing, Stern said, "Everything related to the
appropriateness of the medication, I was acquitted of."

Another Oksana Lawyer Bites the Dust

Oksana Grigorieva has lost another lawyer in the family law case -- Lisa Bloom is substituting out, TMZ has learned.

We don't know exactly why Bloom left the case -- but we're told there were some conflicts between Bloom and Oksana's remaining legal team. Specifically, we're told over the weekend, Daniel Horowitz was working with Oksana at her home. Bloom came by and left looking pretty mad.

Bloom tells TMZ, "I still represent her and I have not quit," adding she is just temporarily out of the family law case while she is in Europe speaking at the Climate Change Convention at the House of Commons in London.

Other sources say Bloom is out of the family law case ... period.

Charlie Sheen's Watch ... Still MIA

As we first reported ... Charlie went nuclear in the room and accused Capri Anderson, aka Christina Walsh, of stealing it.

Sources connected with Charlie tell us the missing watch is worth $100,000.

Charlie is a watch nut whose collection is valued at $5.6 mil.

Lindsay Lohan: There's No 3-Way Sex Tape!

Facebook is buzzing with news of a Lindsay Lohan three-way sex tape -- news that we've learned is patently untrue ... at least that's what Lindsay is telling her closest friends.

We're told Lindsay just became aware of a Facebook page teasing, "Lindsey [sic] Lohan Just Leaked Having a THREEWAY on Camera."

A message on the page continues, "Don't ask how i got this ... NO ONE ELSE HAS SEEN THIS VIDEO."

But sources close to Lindsay tell us the actress is adamant that no 3-way sex tape exists. Sorry guys .. and some ladies.
