Lindsay Had Enough Cash For Jewelry Purchase

Lindsay Lohan had more than enough cash on hand when she took the $2,500 necklace out of an L.A. jewelry store ... sources tell TMZ.

TMZ broke the story ... the L.A. County District Attorney's Office will file felony grand theft charges against Lohan any day ... though we're told it won't be today.

Sources connected to the case tell us ... Lindsay had around $6,000 in cash with her because she had been eyeing a ring in the store, which was going for $3,400. Lindsay had gone to the store several times previously, debating whether to buy it.

Short story ... Lindsay had enough money to buy both the ring and the necklace on the day in question.

We've learned the surveillance video shows Lindsay walking out of the store wearing the necklace, without paying. In the video, the necklace is partially hidden by other jewelry Lindsay is wearing around her neck.

Halle Berry says it point blank ... her daughter is Black -- a direct message to her ex Gabriel Aubry who, according to sources, "went nuts" anytime someone called Nahla Black.

Halle says in an upcoming interview with EBONY magazine, "I feel she's Black. I'm Black and I'm her mother, and I believe in the one-drop theory." The one-drop rule was used during segregation to describe anyone who wasn't 100% Caucasian.

As TMZ first reported, sources connected with the former couple say Gabriel insists Nahla is White.

Dr. Murray's Defense: MJ Was In Failing Health

Michael Jackson was in such a weakened state before he died ... it's unfair to blame his death on Propofol ...and we've learned this is precisely what lawyers for Dr. Conrad Murray will argue to a jury.

Sources familiar with the case tell TMZ ... Dr. Murray's team will argue that at the time of his death, Jackson's body was failing him ... partly because he was "driven over the edge" by AEG to rehearse for his upcoming tour.

We're told Murray's lawyers will call witnesses to testify that Jackson was not showing up for rehearsals -- and when he did show, he was exhibiting "clear signs" of failing health.

The upshot of the defense ... even if jurors believe Dr. Murray administered the fatal dose of Propofol, Jackson was already in failing health.

But as TMZ has already reported ... Dr. Murray's lawyers will argue Jackson himself administered the fatal dose of Propofol to himself when Murray was out of the room.

The trial begins in April.

Lindsay Lohan -- Up for a Role in New 'Superman'

Look! Up in the sky! It's a bird, it's a plane, it's ... Lindsay Lohan?

Sources close to LiLo tell TMZ ... Lindsay's people have had multiple phone conversations within the last few weeks with the people behind the new "Superman" reboot. We're told Lindsay is up for a role in the flick -- and while it isn't Lois Lane, we hear it would be a "major character."

We're told Lindsay is supposed to meet personally with the "Superman" people soon -- but she might be a little busy with that felony grand theft charge thing.

According to our sources, Lindsay is "dying to show people again how talented she is" and is worried this latest run-in with the law (for which she maintains she's innocent) could ruin her shot at the movie.

Apparently that necklace she's accused of stealing is made out of kryptonite.

Reps for Warner Bros had no comment.

Mark Zuckerberg -- I Fear My Facebook Stalker

Mark Zuckerberg claims he's being stalked by a man who's been sending him creepy messages through Facebook and threatening his safety ... TMZ has learned.

Zuckerberg has obtained a restraining order against 31-year-old Pradeep Manukonda -- after Mark filed legal papers claiming the guy has tried to "follow, surveil and contact Mr. Zuckerberg using language threatening his personal safety" ... and the safety of his girlfriend and his sister.

Law enforcement sources tell us Pradeep had gone to several Facebook offices in Palo Alto attempting to contact Mark to ask for money for his financially-strapped family.

According to the legal docs, Facebook security also intercepted Pradeep at Mark's home on January 24 just as he was about to walk up the front steps.

Cops gave Pradeep a verbal warning -- but Mark claims the guy has continued to try to contact him through the mail ... even sending flowers to his home with a hand-written letter on January 28.

In one of his Facebook messages to Mark, Pradeep writes, "please help me, then I am ready to die for you." He continues, "Please understand my pain."

The judge has ordered Pradeep to stay at least 300 yards away from Mark, his sister Randi and his girlfriend Priscilla Chan pending a hearing later this month.

Michael Moore to Harvey Weinstein: You Screwed Me!

Michael Moore claims movie mogul Harvey Weinstein and brother Robert cheated him out of millions of dollars in profits for the movie, "Fahrenheit 9/11," by secretly diverting profits ... even using Michael's money to fly one of the Weinstein bros. to Europe by private jet.

In a lawsuit filed today in L.A. County Superior Court and obtained by TMZ, Moore's company, Westside Productions, claims Moore had a deal with the Weinsteins' company -- The Fellowship Adventure Group -- to split profits 50/50 for the flick.

In legal docs filed by Moore's celebrity lawyer, Larry Stein, he alleges the Weinsteins used "bogus accounting methods to hide the true amounts due Westside." Moore also claims the Weinsteins secretly diverted a fortune in profits to themselves.

"Fahrenheit 9/11" is the top-grossing documentary of all time, pulling in $222 million worldwide.

The lawsuit seeks in excess of $2.7 million.

UPDATE: Weinstein's lawyer, Bert Fields, tells TMZ, "Michael Moore has been paid over $20 million on this film. Under the contract he's not entitled to another dime. His claims are baloney and the timing is very suspicious."

TMZ spoke with sources connected to Mad Bull's Tavern in Sherman Oaks, CA -- who tell us, the actor has been hanging around a lot lately ... but, "Every time Shia comes to the bar, he's a problem and it's starting to get old."

We're told Shia was the instigator in another testosterone-fueled incident just a few weeks ago -- in which bar staff had to break up close to 15 people before an intense pushing match turned into an all-out brawl.

As for Shia's fight this weekend, Mad Bull's owner Richard Disisto tells us, "The boys were out drinking, boys had too much to drink, one guy comments to the other and the next thing you know someone gets punched. Whattya gonna do? It happens."

As we previously reported, cops arrived to the scene and put Shia in handcuffs -- but he was never arrested.

Palin Event Canceled Over 'Safety Concerns'

An event scheduled for May featuring Sarah Palin was canceled the day after it was announced, citing "personal attacks" against Palin and "safety concerns."

The Sharon K Pacheco Foundation announced the cancellation of their 2011 Patriots & Warriors Charity Gala and included a statement on their Facebook page. It reads, "Due to an onslaught of personal attacks against Governor Palin and others associated with her appearance, it is with deep sadness and disappointment that, in the best interest of all, we cancel the event for safety concerns."

The foundation went on to say no direct threats were made against Palin or anyone else involved with the event.

And we're told ... Lindsay is "extremely nervous" about the prospect of going back to jail. Although she refers to the possible penalty as jail, it's actually a lot worse ... State prison.

Lindsay is telling people, "Nothing is worth going back."

TMZ obtained a statement from Shawn Chapman Holley that reads, "We vehemently deny these allegations and, if charges are filed, we will fight them in court, not in the press."

Sources connected with Lindsay tell TMZ ... Lindsay says she'll fight the charge and she's sticking with her story that she took the jewelry on loan.

The case could also have a dramatic impact on her ongoing DUI case in Beverly Hills since she is currently on probation.
