TMZ has learned Merilee Gerth -- who settled a sexual harassment case against Jesse and WCC for $725,000 back in 2007 -- has arrived at the courthouse in Orange County and is set to take the stand.

We're told Jesse's ex-wife Janine Lindemulder -- who's trying to stop Jesse from taking their daughter Sunny to Texas -- believes Merilee knows intimate details about Jesse, Sunny, Sandra and WCC that are very important to Janine's case.

Stay tuned ... it's about to get ugly.

UPDATE: Score one for Jesse ... the judge shot down Janine's attempt to get Merilee on the stand!

Grammer is claiming various other separate property assets, but "Frasier" is the big ticket item specifically mentioned in the legal docs obtained by TMZ.

Grammer is also asking the judge not to award Camille spousal support.

And Grammer is asking for joint legal custody of the couple's two kids.

Moments ago in an Orange County courtroom, Janine was being questioned about Jesse's recent move to Texas -- and his attempt to have 6-year-old Sunny live with him permanently in the Lonestar state ... miles from where Sandra Bullock owns a home.

Janine argued that she doesn't think Sunny to go -- and stated, "I believe I'm being replaced by Sandra Bullock."

TMZ has obtained a copy of the email, sent by Janine Lindemulder to Jesse last month. In the email, Janine says, "I believe you are a good man and with all that has happened you are now much wiser and if given the chance with your wife again, you would not screw it up."

Janine not only gives Jesse permission to move with their daughter to Austin, she says she'll follow along.

And, Janine says, "Sunny talked about 'Louie' [sic] yesterday, she told me he doesn't like baths. She loves and misses her baby brother."

Attorney Richard Masson tells TMZ .... the blowup occurred while Jesse was in rehab earlier this year. Janine called her daughter's cell, and Sandra answered.

Masson would not reveal what Sandra said to his client, but he claims it wasn't the first time Sandy expressed harsh feelings toward Janine.

During today's custody hearing, a teacher from Sunny's school testified that Sandra made derogatory comments about Janine in front of Sunny. According to Masson, Sandra told the teacher, "Quite frankly, I'm glad Janine is in jail. She can go ruin someone else's life."

Jesse has been testifying on the stand this morning, but hasn't mentioned the allegation ... so far.

As we previously reported, Jesse bought a house in Austin and wants to take Sunny there so she can be closer to Sandra Bullock ... who developed a close relationship with Sunny before her divorce from Jesse.

But Janine filed documents trying to stop the move -- saying the Sandra excuse is BS because if she really cared about Jesse's kids ... she would have stayed in California.

According to documents filed last week in L.A. County Superior Court, Kelly -- who was pregnant when she filed for divorce in December of last year -- was officially deemed a free woman as of June 6.

In the docs, it also shows Kelly's last name was changed back to Rutherford from Giersch.

Sources tell TMZ the Sheriff's Department investigation will last approximately 2 more weeks.

And sources say Mel's lawyer has made arrangements to make "a presentation" to Sheriff's investigators and that Mel "might be made available at a future date."

We're told the case will be referred to the L.A. County D.A.'s Office for felony review.

In the photos -- taken during the last week of June -- Mel shot a bothered look at the camera as a group of "fans" who recognized the star at the restaurant swarm him. Mel was at the restaurant because it's near the set of a movie he was shooting ... and really, who can resist their signature babyback ribs?

We're told Mel was "being really nice at first" ... but then "started to get a little annoyed" after several autograph and photo requests.

Days after these photos were taken, news broke that baby mama Oksana Grigoieva had secret recordings which allegedly captured Mel spewing racial and sexist hate towards her.

Both sides filed petitions to dismiss their divorce papers yesterday. They seem to do everything in tandem. Both Shawn and Larry filed their divorce papers within an hour of each other on April 14.

The judge needs to sign the papers to dismiss the divorce petitions, but that's just a formality.

Sources familiar with the settlement tell us the agreement was supposed to be finalized by the end of last week but there is still one document that is being negotiated.

As for the property settlement, TMZ broke the story Elin will get right around $100 million, somewhere between 1/5 and 1/6 of Tiger's net worth.

The 3,296 sq. ft. home in a swanky planned community has two bedrooms and two baths -- and based on our calculations, that means one bedroom for Zack ... and one bedroom for his wife.

According to the deed transfer docs -- obtained by TMZ -- Gosselaar and his estranged lady-partner signed over the deed to another couple back in March ... three months before the actor filed for divorce.

As one source with direct knowledge of the terms of the divorce tells TMZ, "She'll be getting close to $100,000,000."

There have been reports Elin would score $750 million, but we have confirmed that figure is wrong. Indeed, as we first reported, Tiger is not even worth $750 million. We're told his net worth is somewhere between $500 and $600 million.

The $100 million is way more than Elin would have received under the prenup.

Sources say Elin will receive child support, but we do not know the specific amount.

As for the $100 million figure ... this is not speculation ... it comes from sources with direct knowledge of the property settlement agreement.

To put this in some perspective, Elin will be getting 10 times what Rachel Uchitel scored from Tiger.

TMZ broke the story ... Camille Grammer filed for divorce yesterday, citing "irreconcilable differences."

Sources connected with the couple tell TMZ ... the 13-year marriage started crumbling when Kelsey moved to New York earlier this year to star in "La Cage Aux Folles" on Broadway.

Camille stayed with their two kids in L.A. and flew back and forth to visit him, but sources say it became apparent "Kelsey loved New York, his friends and his freedom more than his marriage."

We're told the tipping point for Camille was Father's Day, when Kelsey was 2,475 air miles away from his family and didn't call his kids.

The tapes were secretly recorded by Oksana in the midst of their nuclear breakup and custody battle.

We've also confirmed Mel is heard on tape calling Oksana a "whore" and a "c**t."

The tapes have been submitted to the judge in their custody battle and are under seal. Sources say the tapes were recorded prior to May, when Mel and Oksana reached a custody agreement with a mediator.

And TMZ has learned ... Mel sent Oksana a number of incendiary emails that she kept.

TMZ broke the story in 2006 when Mel went nuts on a cop after being busted for DUI, saying, "F**king Jews ... The Jews are responsible for all the wars in the world."

UPDATE: Mel's rep just told TMZ he could not confirm the credibility or accuracy of the tapes. TMZ, however, has confirmed that the tapes are the real deal.
