Halle Berry, Gabriel Split Custody in Limbo

Halle Berry and Gabriel Aubry have split, TMZ has confirmed, and she went to a divorce lawyer three weeks ago to find out about a custody arrangement ... but nothing long-term was agreed upon and no financial settlement has been struck.

Halle and Gabriel worked out a "very short-term custody arrangement," a very connected source tells TMZ. But when they worked out the arrangement they had not split, though they were clearly having problems. Neither Halle nor Gabriel have tried to make the arrangement permanent for 2-year-old Nahla.

Neither of them have gone to a lawyer to formalize any type of long-term agreement, so despite the fact they have split, there is no custody arrangement or property settlement agreement.

We are told, however, by sources close to the situation, that Halle and Gabriel are "working well together" and are handling parental duties without conflict.

We are told the long-term plan is to share custody but nothing has been formalized in writing.

UPDATE: We're told Halle and Gabriel have agreed to several short-term custody arrangements while they sort things out. They have renewed them each time they have expired and are still working under a short-term agreement but no permanent agreement has been struck.

Tito Ortiz, Jenna Jameson Take it Back

TMZ has learned former UFC champ Tito Ortiz and baby mama/former porn star Jenna Jameson are withdrawing allegations that led to Tito's felony domestic violence arrest earlier this week.

Jenna, who accused Tito of injuring her during an argument, now tells TMZ, "What actually happened has now been dramatically distorted and misinterpreted and remarks that both Tito and I made after the police arrived reflect the state of shock that we were both in." Translation -- he didn't hurt me.

As for Tito, we're told he's now backing off what he strongly insinuated ... that Jenna is an OxyContin addict. We're told Tito's position now is that he found two OxyContin pills and may have jumped to conclusions. Jenna says the pills were very old. And, as we first reported, Jenna tested negative for drugs this week.

Tito's lawyer, Chip Matthews, tells TMZ the whole thing was "a big misunderstanding."

One more thing ... Sources say Tito stands to lose $15 million if he's prosecuted for domestic violence -- the money accounts for his UFC contract as well as other businesses.

'Survivor' Star Accused of Battering a Woman

The horrible week for CBS reality stars continues -- TMZ has learned another "Survivor" star has been cited in Louisiana after cops say he battered a woman inside a bar restroom over the weekend.

Kenward "Boo" Bernis -- who competed on "Survivor: Fiji" back in 2007 -- is accused of walking into a ladies restroom at Bootleggers Bar in Lafayette, grabbing a woman by the upper arm and "forcibly move[ing] her."

As we've previously reported, another "Survivor" contestant -- Russell Hantz -- was also arrested in Lafayette on Friday for battering a woman. Hantz also co-owns the Bootleggers Bar where Bernis' alleged incident went down.

And over on "Big Brother" -- two dudes from Season 9 are in all sorts of trouble for allegedly operating an illegal prescription drug ring.

Attempts to reach Bernis were unsuccessful.

Sandra & Angelina -- The Adoption Connection

Sandra Bullock and Angelina Jolie share a very interesting connection -- and it all has to do with their adopted babies Louis Bardo and Maddox, respectively ... and the timing of their divorces.

Sandra told People Magazine she and Jesse James set the wheels in motion to adopt Louis Bardo together ... but divorce changed the plan. Sandra now says she's filing for single parent adoption.

TMZ has learned that's exactly what happened between Angelina Jolie and Billy Bob Thornton. Although this has not been reported, sources connected with their divorce in 2003 tell TMZ, Angie and B.B. were going to jointly adopt Maddox, but when they decided to divorce, the plan changed and Billy Bob backed out of the adoption.

Adoption experts we've spoken with say turning a husband/wife adoption into a single parent adoption can complicate the adoption process ... but it seems to have worked out for both Angelina and Sandra.

Sandra Bullock Files for Divorce in Austin, Texas

TMZ has learned Sandra Bullock filed for divorce in Travis County Court in Austin, Texas ... and the reason it didn't surface until now is because Sandra turned it into a puzzle.

The case was filed under Sandra's initials -- backwards ... B.A.S.

Jesse James was also identified by his initials -- J.J.G. Jesse's middle name is Gregory.

The document was filed April 23.

As for grounds of divorce, the petition says, "The marriage between Petitioner and Respondent has become insupportable because of discord or conflict of personalities that destroys the legitimate ends of the marriage relationship and prevents any reasonable expectations of reconciliation."

According to the docs, obtained by TMZ, "There is no child under eighteen years of age or otherwise entitled to support who was born or adopted of this marriage and none is expected."

According to the docs, Sandra is a resident of Texas. Jesse "is of legal age and agrees to proceed in Austin, Travis County, Texas."

According to the petition, the parties were married in 2005 "and have ceased to live together as husband and wife."

As for the firm Sandra hired -- Chaffe McCall -- she's used the firm in the past to litigate a tax issue. A lawyer in the firm claimed a man who set up fraudulent tax shelters had given Bullock advice, after her dad saw an ad for tax shelters in an in-flight airline magazine.

Sandra Bullock Files for Divorce, Adopts Baby

Sandra Bullock says she is divorcing Jesse James -- AND she's adopted a baby boy, according to People.

Sandra told People she has filed for divorce, adding "I'm sad and I am scared" -- though she does not reveal where the petition was filed. She says she had no idea about Jesse's infidelity.

She also reveals that she's adopted a 3 1/2 month old boy named Louis Bardo Bullock -- and though she and Jesse started the adoption process four years ago and brought the boy home together in January, she now plans to raise him as a single parent.

Of the baby, who was born in New Orleans and named after Louis Armstrong, Bullock says "He's just perfect, I can't even describe him any other way ... It's like he's always been a part of our lives."

Despite the messy split, she says of James, "I really don't know how our paths will intersect in the future, but the father I have known Jesse to be ... is one that I hope Louis can experience one day, no matter how Jesse and I go on with our lives."

Jesse tells the magazine "I know in my heart that I can be the best father possible to my four children and the mate Sandy deserves, and realize that this is an incredible mountain to climb. But believe the steps I have taken in the last 30 days are the foundation to making this happen."

Sandra and Jesse have been married for almost five years. He has three children from two previous marriages.

Jon and Kate Bury Hatchet -- For Now

TMZ has learned Jon Gosselin will drop his legal case against Kate Gosselin for custody and child support. Even more shocking ... they seem to be getting along.

Sources connected to the situation tell TMZ Jon never really believed Kate was an "absentee mom," as his fired lawyer alleged while she was on "Dancing with the Stars."

We're told Jon and Kate are trying to hash out a custody and child support agreement that is more up to date than the one that is currently in place. Fact is ... Kate is making serious money and Jon isn't. And, he's shown more of an interest in being with the kids than he did during the divorce proceedings.

Will Kate let Jon appear on her spin-off show? Well, memba the old saying, "Burn me once ...."

Michael Lohan: Dina Has 2 Weeks To Talk

Michael Lohan's issuing a deadline to his ex-wife Dina Lohan -- giving her just over two weeks to sit down and talk about Lindsay and Ali -- before he drags New York State into the war of the Lohans.

Michael tells TMZ he and Dina will meet face-to-face on May 13th for a deposition in their child support battle. That's when he wants to talk about 16-year-old Ali's welfare -- specifically, the fact that she's living in L.A. with Lindsay ... who's appeared less than stable lately.

Michael says if Dina dodges the convo on the 13th, he will get Child Protective Services of New York State involved in the situation. Presumably the agency has jurisdiction since Ali's permanent address is still in New York.

Michael claims he'll be quiet until the 'deadline.' We'll believe it when we see it.

Britney's Camp for Kids -- Desperate Times

The summer camp that Britney Spears created for under-privileged kids back in 1999 is in serious danger of going under -- unless they find some serious dough ASAP.

The camp -- a ten-day summer program for 250 "economicallydisadvantaged students" -- was originally named the "Britney SpearsCamp for the Performing Arts" until Brit bowed out in 2004. After that,the camp was renamed Summer Stars Camp and received generous donations from sponsorslike 50 Cent and the Jonas Brothers.

But now, the camp's executive director tells TMZ they've run out of money and can't seem to find any more celebrity sponsors this year -- the first time they've had money issues since the place was founded.

The director also claims that the camp is so desperate for the $250,000 it needs to stay afloat, they've entered a contest run by Pepsi in a last ditch effort to score a grant.

Attempts to reach Britney for comment were unsuccessful.

Bret Michaels -- 'Setback' in Recovery Process

Bret Michaels' reps confirm that the rocker suffered a "setback" in his recovery from a brain hemorrhage -- and he may now be at risk for seizures.

According to Bret's people -- test results show Bret is experiencing hyponatremia, a side effect from the subarachnoid hemorrhage which is caused by a lack of sodium in the body. The condition can often lead to seizures.

But despite the setback, doctors are still hopeful Bret will gradually improve, "as the blood surrounding the brain dissolves and is reabsorbed into his system, which can be a very painful recovery and take several weeks to months."

Bret's reps also report that the rocker "remains under 24-hour observation in the ICU and is in positive spirits. He is responding well to tests and treatments."

Bret was first hospitalized for the hemorrhage last Thursday night after complaining of a massive headache.

Michael Jackson's Mom Cleans House

TMZ has learned ... Katherine Jackson is downsizing the number of grandchildren in her San Fernando Valley mansion -- and the stun gun incident was the catalyst.

Sources with direct knowledge of the situation tell TMZ ... Katherine has told Alejandra Genevieve Oaziaza -- who is currently living at the estate, along with two of her kids by Randy Jackson and two others by Jermaine Jackson -- that she must take the kids and move out of the estate next week, because supervising seven children is just too much for the 79-year-old grandmother.

But don't think Katherine is heartless. It's the opposite. She's moving Alejandra, along with Jaafar, Jermajesty, Donte and Randy Jr. to a San Fernando Valley condo owned by the estate.

We're told the move was prompted by the stun gun incident last month. TMZ broke the story that 13-year-old Jaafar bought a stun gun online and fired it in the house. Sources say Jaafar pointed the gun at two of Michael's kids, but the family denies that.

The L.A. County Department of Children and Family Services came to the estate, took the gun and interviewed people in the home, and it became apparent seven kids were too much for Katherine to handle.

So as of next week, Prince, Paris and Blanket will have the run of the mansion, unobstructed.

Tito Ortiz Arrested for Domestic Violence

TMZ has learned Tito Ortiz was just arrested for felony domestic violence at the home he shares with Jenna Jameson.

We're told when cops arrived at the couple's home in Huntington Beach, CA -- Jenna Jameson had "visible injuries."

We're told someone called 911 today at 9:53 AM and reported a "disturbance."

Tito is currently in custody and on his way to a Huntington Beach jail in Orange County, CA.

Tito and Jenna are not married -- but they have twin boys together.

Jesse's Mistress to Sandra: So Sorry

TMZ has obtained a letter that Melissa Smith -- Jesse James mistress #2 -- faxed to Sandra Bullock's agent on Sunday, apologizing for her alleged affair with Jesse ... and it's pretty audacious.

Smith wrote to Sandra, "I felt I needed to reach out to you and tell you how deeply sorry I am for everything that you've been through."

Smith goes on ... "And I know nothing I can say in this letter is going to make the pain of my actions go away."

And the mea culpa continues: "... I am sorry for any hurt or pain that I have caused you. My actions of engaging with a married man are unforgivable. I never meant you any harm."

Smith continues, "I compromised my beliefs on several occasions and as a result will never forgive myself."

Melissa closes the letter, "Please contact me if you wish to discuss on the phone or in person."

Don't wait by the phone, honey.

'Two and a Half Men' -- All in the Family?

Should Charlie Sheen decide to leave "Two and a Half Men" -- and we sincerely doubt that will happen -- his uncle, Joe Estevez, knows who should replace him: Joe Estevez!

Ed Meyers, Estevez's rep, tells TMZ he will go to Chuck Lorre, creator of the show, and pitch him the idea of Estevez taking on the role. The idea would be that Charlie's character has gone missing or overseas (details on that part are sketchy) and Joe would play the role of his uncle. Hardly a stretch.

Meyers says that Estevez wants to save the show "for the good of the family." He's willing to take on the role for as long as Charlie is out -- which Joe thinks might be for good.

We doubt Joe will command Charlie's hefty salary, but it's worth a shot.

Michael Lohan's Weird Ultimatum to Lindsay

Michael Lohan tells TMZ tomorrow is D-day for Lindsay Lohan -- either meet with him or he's going to court. But the meeting now has a curious string attached.

Michael says he's been communicating with Lindsay since he went on TMZ Live last Thursday -- telling her he will not take legal action to protect Ali from Lindsay nor will he go to court for a Britney-like conservatorship IF she sits down with him face-to-face and hashes things out.

Here's the catch. On TMZ Live, Michael said he wanted to sit with Lindsay and Ali -- just the three of them ... no one else. Now he's telling us he wants to sit with Lindsay and his lawyer. BUZZKILL.

Last Michael told us, he was hiring attorney Lisa Bloom -- a very good, very smart lawyer, and daughter of Gloria Allred. Lisa also just happens to work for an entertainment TV show.

So why suddenly throw a high-profile lawyer in the middle of a father/daughter heart-to-heart? And where's Ali Lohan in all of this?

Will Lindsay meet with Michael? Will Michael go to the L.A. County Department of Children and Family Services to get Ali out of Lindsay's clutches? Will Michael try and become the 2010 version of Jamie Spears by becoming conservator/father of the year? Will Michael leave town? Will Michael go to Hyde tonight?

Kate Gosselin's 8 Kids -- Cleared for Spin-Off

Kate Gosselin's new TLC show "Kate Plus 8" is all systems go -- because the local Department of Labor says the kiddies have been cleared to continue their careers as reality TV stars.

A rep for the Pennsylvania Dept. of Labor and Industry tells TMZ the correct paperwork for the show was submitted and approved ... and said, "The proper steps have been taken and the kids are permitted for 'Kate Plus 8.'"

But according to the rep, nothing has been submitted for Kate's other TLC spin-off "Twist of Kate" -- which could mean the kiddies may not be joining Kate on that one.

That's probably a good thing ... because 5-year-olds shouldn't have to work two jobs.
