Mel Gibson -- Domestic Violence Not on His Mind

Mel Gibson and his legal team were not trying to suppress evidence of domestic violence when they agreed to pay Oksana Grigorieva and Lucia approximately $15 million in return for the destruction of "evidence" -- they were trying to prevent the destruction of Gibson's image ... sources connected with the mediation tell TMZ.

Oksana's current legal team claims the mediation agreement is not binding because lawyers cannot agree to destroy evidence of a crime.

But here's the rub: Sources tell us the photograph of Oksana -- showing what appears to be either teeth or veneers missing -- was not part of the deal.

Sources tell us Mel and his lawyers never thought domestic violence was even an issue. As we first reported ... Mel's team claims Oksana and her lawyer made it clear -- the $15 million was a payout to keep the racial and other disgusting remarks Mel made on the tapes secret forever.

We've learned Oksana's lawyer said in the mediation that photographs of Oksana's mouth existed, but when it came time to define "evidence" that would be destroyed, the photos were not included. So the argument goes ... if Mel was trying to destroy evidence of domestic violence, why didn't he demand Oksana hand over the photos?

Mel & Robyn Gibson: Oops, We Didn't Think of That!

Mel Gibson and wife Robyn never thought in a million years that one of them would have a child during their marriage with another partner ... and that's why baby Lucia created a big problem.

Sources tell TMZ ... Mel and Robyn created the Icon Trust to provide financial security for their kids. But when the trust was drafted, it defined "issue" (a fancy name for children) as kids born from Mel or Robyn, not Mel and Robyn.

So then Mel goes and gets Oksana Grigorieva pregnant and baby Lucia is born. Lucia is automatically a beneficiary under the trust ... something that was never contemplated or intended. We're told Mel, Robyn and their 7 kids all love Lucia and want to provide for her, but including Lucia in the trust would create major tax issues.

So ... fast forward to the mediation between Mel and Oksana -- the very first term in the agreement states, "Oksana consents to amendment of Icon Trust to exclude Lucia." Oksana agreed, partly because under the mediation agreement, upon Mel's death, Lucia will receive "no less than $4.3 million ... in addition to the ... $2 million life insurance policy."

But ... if Oksana can successfully disavow the mediation deal, it could throw a major monkey wrench into the Icon Trust.

George Lopez Divorcing

George Lopez and his wife, Ann, are getting a divorce, TMZ has learned.

Sources say George and Ann have been working out details of the split "for a long time," but they've both made the decision to end the marriage.

The couple has been married for 17 years. They have a 14-year-old daughter, and we're told they both want to keep the divorce amicable for the sake of their kid.

UPDATE: A rep for George and Ann tells TMZ, "George and Ann Lopez have made the decision to end their 17 year marriage. The decision is amicable and by mutual agreement. They remain dedicated parents, and committed partners in business and their philanthropic organization, The Lopez Foundation."

Oksana's Lawyers: Mel Gibson Mediation Illegal

Sources connected with Oksana Grigorieva tell TMZ her lawyers will argue the mediation agreement Oksana signed with Mel Gibson was illegal, because it allegedly involved the destruction of evidence.

TMZ obtained the agreement Mel and Oksana signed on May 16, in which Mel promised to give Oksana and Lucia approximately $15 million in return for Oksana turning over all "evidence" and that "all evidence will be destroyed ..."

Oksana -- who disavowed the agreement after signing it -- claims she was bullied into signing the agreement by Mel's lawyers.

As for the claim that the agreement involves destruction of evidence, sources directly connected with the mediation tell TMZ ... the words "domestic violence" or "prosecution" were never mentioned in the mediation. Sources say there was never mention of destroying evidence of a crime.

As for the tapes, we're told only snippets were played to Mel's lawyers, and each snippet involved the racial and other slurs that would have ruined his career but not subjected him to prosecution. We're also told -- Oksana's lawyers never played the portion of the tape where Mel says, "You know what? You f**king deserved it."

As for Oksana's claim that Mel's lawyers bullied her into signing -- and threatened legal action and deportation if she didn't -- we've learned Mel's lawyers never had contact with Oksana during the two-day mediation. The only people Oksana had contact with during the mediation were the judges and her lawyer.

Michael Jackson's Son -- Healing the World

Michael Jackson's son Prince is taking after his father -- TMZ has learned the 13-year-old went on a field trip last Thursday ... but instead of going to a museum or an aquarium, dude packed food for starving children.

It was all part of a charity event organized by The Buckley School -- we're told Prince and his classmates stopped by an L.A. warehouse owned by the Children's Hunger Fund ... and assembled over 500 20-pound boxes for children in Peru.

According to sources, the boxes contained all kinds of food -- including canned goods, beans, rice, and pasta.

Yum.

Khloe & Kim -- 2 Kardashians, 1 Dress

Just three days after Khloe Kardashian attempted to wear this bandage dress to Katsuya in Hollywood, her big sister Kim Kardashian poured herself into the exact same dress to go to dinner at Nobu.

Unclear if the dresses are identical or if the sisters are so similar they can trade schmatas.

Child Custody Agreement Gives Mel Joint Custody

Oksana Grigorieva signed a "Child Custody" agreement in May which spelled it out as clearly as can be -- Mel Gibson was not only entitled to unsupervised contact with Lucia, he was getting joint legal and physical custody of the child.

The document, obtained by TMZ, was signed by Oksana and Mel on May 16 ... but disavowed by Oksana shortly thereafter. She claimed she did not know the agreement gave Mel unsupervised contact with the baby.

But the agreement laid out in almost painful detail the schedule for custody, down to the day and the hour. Mel immediately got joint legal custody of the baby. He also got significant unsupervised visitation, which turned into 50/50 custody when Lucia turned 3.

The agreement also provided, when Mel didn't have Lucia, the nanny would coordinate a Skype call between himself and the child.

The agreement spelled out who gets the kids on holidays. But these pages, which were initialed by both Mel and Oksana, were X'd out. We're told a similar schedule was later substituted for the one you see.

It was the Father's Day visitation that sent the case into family court, when Oksana refused to let Mel have the baby.

Oksana's lawyer, Dan Horowitz, had no comment.

Lindsay Lohan Chooses Rehab

TMZ has learned Lindsay Lohan is about to re-enter rehab ... and it's her decision.

Sources with direct and specific knowledge of the situation tell TMZ Lindsay will enter a live-in facility outside of Los Angeles within days. Lindsay is now agonizingly aware she has an addiction problem and also acknowledges the reality -- addicts often backslide before they get better.

We're told Lindsay is telling people she doesn't want this type of life anymore. She says she wants to get better and wants to do whatever it takes at this point ... irrespective of what Judge Elden Fox does to her.

Jermaine's Child Support Plea -- I'm Broke, No Joke

Jermaine Jackson claims he can't afford to pay child support because his business is failing and his career is in the tank -- in fact, according to new legal docs, MJ's bro can barely make ends meet.

Jermaine just filed new child support papers in L.A. County Superior Court -- obtained by TMZ -- grousing that he's expected to pay $3,000 a month in child support for sons Jaafar and Jermajesty ... even though his average monthly income for the last year has been under $1,100.

Jermaine is asking the judge to slash support payment to $215 a month.

According to the docs, Jermaine made a onetime appearance on "Big Brother" back in 2007, raking in a handsome $450,000 for his troubles -- but since then, Jermaine claims his business has floundered.

Jermaine claims his baby mama Alejandra not only earns more than him ... but she gets a free ride along with his kids at the Jackson compound, thanks to Katherine's generosity. Katherine has asked Alejandra to move her family into a nearby Jackson condo but Alejandra has refused and Katherine won't put her foot down.

Mel and Oksana -- Remember The Good Ol' Days

Mel Gibson may be best know for hurling four-letter words at baby mama Oksana Grigorieva, but back when they first met ... he proclaimed his love for her in an embarrassingly intimate love letter.

TMZ has obtained the handwritten letter in which Mel begins, "To my sweet beautiful little Russian." Sources connected to the couple tell us that Mel wrote this letter after spending a passionate week with Oksana in the beginning of their relationship.

Mel continues, "Firstly -- I LOVE YOU!!! ... I could never let you go ... I could derive more fulfillment from a mere thought of you than anyone could imagine."

The love letter is a glimpse into a time before protective orders and lawyer shopping -- when Mel seemed to care for Oksana unconditionally, writing "I'll have soul gasms and perhaps even orgasms thinking of you!"

The letter concludes with Mel stating that he feels like a "new man," and promising that "There is no way I will squander something so precious!"

Oksana to Mel: I Don't Want Your Money

Oksana Grigorieva signed an agreement with Mel Gibson a month before their January 6 blowout, stating she would not make any claim on Mel's money in the event they broke up -- but boy did that change.

According to the "Cohabitation Agreement" -- obtained by TMZ -- Oksana and Mel both acknowledge "...they have no right to the property of the other.... " The agreement states, "Neither party has promised the other to assist in funding any support for each other or the other party's children from other relationships."

The 22 page agreement, signed on December 8, 2009, lists Mel's net worth "in excess of $150 million" and "his annual gross income averaged in excess of $5 million during the past three years."

The agreement states in multiple ways that Mel owes Oksana nothing if they break up. Their earnings and assets remain separate. All Oksana got under the agreement was the right to live in Mel's Sherman Oaks home, but he had the right to throw her out at any time with 12 months written notice.

The agreement did give Oksana the right to keep a Dodge Charger that Mel bought for her ... but that's pretty much it.

But law enforcement sources tell TMZ ... a little more than a month after signing the Cohabitation Agreement -- and after the January 6 argument -- Oksana had buyer's remorse and began demanding money from Mel.

Sources say there were numerous emails and conversations between Oksana and Mel in which she demanded money, and her demands went into high gear after she secretly recorded Mel on February 18.

We broke the story ... during their mediation in May, Oksana demanded and got Mel to agree to pay her and Lucia a total of $15 million ... in return, Oksana agreed to turn over the audiotapes and other "evidence" to Mel.

As TMZ first reported ... there is a "serious" extortion investigation underway, to determine if Oksana used the tapes to squeeze money out of Mel -- and our law enforcement sources say the Cohabitation Agreement is something that investigators are looking at closely.

We asked Oksana's lawyer, Daniel Horowitz, why Oksana went from not wanting any money in December to asking for millions in May. Horowitz told TMZ, "When she signed the agreement in December she had no idea Mel would be treating her like a punching bag in January. She gave up her career for a man who started beating her."

Octomom Everything Must Go!

Deep in debt, facing foreclosure, and trying to feed her children ... Octomom did today what any responsible mother of 14 would do ... had a yard sale!

Nadya Suleman tossed her goodies on her lawn in La Habra, CA in an effort to make some scratch. As we first reported, Octo is behind about $7,500 on her mortgage payments -- plus she owes a whopping $450,000 balloon payment which is due October 9.

The big item today ... you can get your pic with Octomom for just $10. That's about $9 more than it's worth ... but it's for a good cause.

Oksana: Mel Threatened 'Brains All Over the Wall'

Oksana Grigorieva has told D.A. investigators ... Mel Gibson was so enraged the day he allegedly attacked her that he threatened that "There will be brains all over the wall" ... TMZ has learned.

Oksana went to the L.A. County District Attorney's Office Wednesday and told investigators the day of the nuclear argument, after allegedly striking her, Mel pulled out a gun, waived it around and threatened to kill her, the baby and himself, screaming, "There will be brains all over the wall."

Oksana says she fled the house with Lucia and her son Sacha.

As we previously reported -- Mel's domestic violence case is currently with the L.A. County District Attorney's Office for review.

It should be noted, claims that Mel threatened to kill himself, Oksana and the baby never came up during the mediation in May.

Lindsay Lohan -- In Custody, No Bail

Lindsay Lohan is in custody ... after Judge Elden Fox shockingly denied her bail ... and Lindsay could be sitting there until October 22. But LiLo's lawyer just told us, the judge was dead wrong.

Lindsay was in court because she failed two drug tests -- in one she tested positive for cocaine and the other for Adderall.

Judge Fox did not hear any arguments from the lawyers before making his ruling. Lindsay's lawyer, Shawn Chapman Holley, told TMZ on the way out of court ... the judge had no legal basis for denying her client bail.

Lindsay was handcuffed in court before being taken into custody.

It's shocking because the underlying offense is a misdemeanor, and people connected with the case were telling us the judge had to offer Lindsay bail.

As for Lindsay's reaction ... she was shocked when the judge remanded her into custody. Lindsay looked at her lawyer, Shawn Chapman Holley, before being taken out of the courtroom. She was taken from court in a single Sheriff's vehicle, covered by a blanket.

Lindsay Lohan fun fact: She was hauled off to jail in a pair of $1,195 Christian Louboutin shoes. Fancy!

UPDATE: Los Angeles County sheriff's spokesman Steve Whitmore told reporters Lindsay will be housed in "administrative segregation" because of her celebrity status for her safety and the safety of the jail system. He also said the only way she could be released before her probation hearing on Oct 22 is if the judge issues another order.

Katherine Jackson: Who Can Live on $26K a Month?

Katherine Jackson can't make it on a $26,000-a-month allowance ... so she's asking for more.

TMZ found a judge's order filed yesterday in the Michael Jackson Estate case, in which the judge notes, "Counsel will give notice of proposed action re: adjustment to family allowance for the benefit of Katherine Jackson."

TMZ has already reported Katherine pulls in a temp allowance of $26,804 a month.

The document does not say how much more Katherine wants, but it's pretty ironic since she's making a lot of money on the side.
