Mel and Oksana's Dogfight Over Money

Mel Gibson and Oksana Grigorieva have been locked in a mega-court battle over exactly how much money Mel makes, and how much he should fork over to Oksana ... this according to court documents obtained by TMZ.

Mel claims in the period of August, 2009 - August 2010, he made $7.2 million.

Oksana claims in her legal docs that Mel told her he made $40 million in 2009.

As for how much Mel spends, according to court documents -- $700,889 a month.

But the good news for Mel, according to the docs, "The petitioner [Mel] does not indicate any debt." And, he lists real estate and personal property assets "in excess of $50,000,000."

According to Judge Gordon's order, Oksana wanted between $50,000 and $60,000 a month from Mel. Mel felt $4,088 plus housing was more appropriate.

Judge Gordon called Mel out for minimizing the effect Mel's wealth should have on the child support order: "Although petitioner argues at length about what the needs of the minor child might be, Petitioner avoids the issue of his station in life and how his extraordinary high income might affect the reasonable needs of the minor child."

In the end, Judge Gordon ordered that Mel pay $20,000 a month in child support, plus housing.

Akon: Will.i.am Is WRONG About MJ Album

Akon not only disagrees with Will I.Am's criticism that the release of the new MJ album is "disrespectful" ... Akon believes Michael would have WANTED it to come out.

Akon was at LAX yesterday ... and told us that working with Michael on the song "Hold My Hand" was a "dream come true ... it was epic."

As for Will's comments, Akon says he "honestly disagrees" ... adding, "I don't see anything disrespectful about it ... these albums would have come out if [MJ] was alive or dead so I think this helps to keep his legacy alive."

Based on all the fans who rated the song a 10-out-of-10 on our poll ... we think the public agrees with Akon.

Dina Lohan: My Son Will Act Like a Heroin User

Dina Lohan's production company is getting ready to shoot a feature film about a group of heroin-addicted kids -- and her son will play the lead. Wait ... Dina Lohan has a production company?

Turns out she does -- something called Defiant Pictures is set to start production on a movie called "Growing Defiant." The film will start shooting in early 2011 and will star Michael Lohan Jr.

According to the company, the movie "tells the story of three life long friends from upper middle class Long Island, who delve into the underworlds of heroin." We're told Dina is "really excited to tell this story."

Oksana Loses Lawyer 41, Hires Lawyer 42

Oksana Grigorieva is Guinness Book material, because she's just parted company with lawyer #41, and she's already hired lawyer #42.

Steve Jaffe, Oksana's PR guy, tells TMZ Alan Shifman, her family law attorney, has left the case by mutual decision.

Shifman is the latest in an army of lawyers who have come and gone since May.

We're told Oksana has already hired a new family law attorney -- #42 -- Ronald A. Litz. Litz tells TMZ, "I will try my best to resolve this matter expeditiously and hopefully in a mutually agreeable manner." Litz adds, "I would like to bring some peace to the situation so the child doesn't suffer."

Mel Claims Oksana Self-Mutilated

Oksana Grigorieva claims Mel Gibson scratched and bruised her during their January 6 fight, but Mel has an alternate explanation ... Oksana did it to herself.

TMZ has obtained a declaration from Mady Shany, Oksana's facialist. Shany says on January 12, Oksana came in for a facial, and she noted, "I noticed that there were scratches and bruises around her eyes and on her forehead."

Shany says Oksana told her Mel "punched her and threw her on the bed while she had the baby in her arms."

But TMZ has also obtained a declaration from Mel, in which he claims, "...Oksana is emotionally unstable and suffers from Trichotillomania, an impulse control disorder characterized by the repeated urge to pull, and pulling, out ones own hair, eyelashes, eyebrows and other body hair."

In the declaration, Mel says, "During our relationship Oksana often had scratches and bald spots on the side of her head as a result of this disorder (scratches she is now, apparently, attempting to blame on me!)."

Oksana's lawyer, Dan Horowitz, tells TMZ, "I've spent over 100 hours with Oksana and I have never seen her pick her hair or scratch her skin. She just acts like a totally normal person."

Oksana to Mel: 'Too Much Evidence, My Dear'

TMZ has obtained emails Oksana Grigorieva sent Mel Gibson just before their mediation, which Mel's lawyers believe are proof of extortion. Oksana claims she has "Too much evidence, my dear."

According to court documents, Oksana sent the emails on May 2, two weeks before she and Mel went into mediation which resulted in a $15 million package for Oksana and Lucia.

In the email, Oksana accuses Mel and his family of leaking stories to the media about their breakup -- specifically "...they claim that you dumped me."

Mel's lawyers believe the emails show Oksana as a manipulator who was not fearful of Mel at all, but rather someone who was scheming to extort millions.

Oksana writes, "Does your family think that my modesty and class could pass for stupidity?" She adds, "Do they think, i will let them carry on with ruining my reputation, which was unblemished before i ever layed eyes on you?"

Then Oksana gets serious: "The facts are stubborn things, the information is power, you told me so yourself."

Then, far from being scared, it seems Oksana wanted Mel back, writing, "Untill this morning I was still missing you so much and secretly wanted and hoped for us to be together again."

Oksana accuses his wife, Robyn, and daughter, Hannah, of waging a "silent war" against her, complaining, "Are you a little boy, or are you a man? Why are you so easily influence by your mommy Robyn?"

Mel Gibson Admits Slapping, Not Hitting Oksana

TMZ has obtained Mel Gibson's sworn declaration in the custody war with Oksana Grigorieva, in which Mel admits slapping Oksana because he says she was so hysterical she was endangering the baby ... but he denies hitting her.

Mel is referring to the explosive argument between the two on the night of January 6, 2010, which triggered the L.A. County Sheriff's Department domestic violence investigation. Oksana claims Mel punched her in the temple and in the mouth, knocking out two teeth.

But Mel tells a very different story. According to his declaration, dated June 23, 2010 and filed with the court, Mel says he and Oksana were having one of their frequent arguments at his Malibu home, when Oksana grabbed Lucia out her of bassinet, brought her right in the middle of the argument and screamed, "Stop yelling or you will make her into a retarded brain damaged idiot!"

Mel says Oksana then "spun around," ran into her older son's room and then out into the backyard. Mel says the yard is dangerous at night, set on different levels and dimly lit. Mel says Oksana ran across the various levels for about 75 yards, near thorny trees.

Mel says he implored Oksana to bring Lucia back inside, and that's when Oksana ran back into her older son's room, and "started swinging Lucia erratically in her arms, jerking her body from side to side to keep Lucia out of my reach."

Mel adds Oksana was "hysterical" and her "rapid movements were causing Lucia's little body to be flung from one side to the other, her head shaking violently." Mel says he feared Shaken Baby Syndrome.

As she refused to hand the baby over and continued with "rough and erratic movements," Mel says, "I slapped Oksana one time with an open hand in an attempt to bring her back to reality. I did not slap her hard, I was just trying to shock her so that she would stop screaming, continuing shaking Lucia back and forth."

Mel's story could establish a defense to a domestic violence charge -- using reasonable force to protect a child from injury.

As for Oksana, Mel says, "I did not hit Oksana with a closed fist, as she alleges. I did not ever punch her in the face or in the temple or anywhere else, not then or at any other time."

Mel admits, "While I do not believe I handled the situation as well as I should have, I was worried about the rough way Oksana was shaking and tossing Lucia around," adding, "My hand never touched any part of Lucia." As we've already reported, the pediatrician who examined Lucia the next day saw no evidence of injury.

And Mel says, "There was never any blood on Oksana and none of her teeth were 'broken,' although one of the false veneers from a tooth apparently did come off, I did not see that occur at the time."

Oksana Grigorieva Defies Judge with Larry King

Oksana Grigorieva has defied the judge in her custody war with Mel Gibson by taping an interview with Larry King Saturday night, TMZ has learned ... and it's Oksana's opening salvo in "speaking out on behalf of battered women."

Oksana did the interview (which was supposed to only last a half-hour but ended up an hour) along with one of her lawyers, Marty Garbus -- this despite Judge Scott Gordon telling Oksana that if she did media, she might pay when it comes to awarding custody ... this according to Oksana's team.

Sources connected with Oksana tell TMZ she did the interview because "she feels she's been silent too long and feels bad for other battered women if she stays silent." Sources tell TMZ Oksana is now working with a group called Peace Over Violence -- an L.A.-based battered women's group -- and she's planning a number of news conferences in the near future.

We're told Larry King played portions of a number of the tapes Oksana secretly recorded, in which Mel goes crazy. King asks for her reaction to the various tapes.

And we're told Oksana repeats over and over that she believes Mel is a great father, but he needs therapy to deal with his issues so he can safely be around Lucia.

Oksana is also working with a lobbying group in Sacramento -- California Partnership to End Domestic Violence -- on battered women legislation.

Lindsay Lohan Tells Daddy Michael to Beat It

Lindsay Lohan just demanded security officers at her apartment building remove her father, Michael Lohan ... TMZ has learned.

Sources close to Lindsay tell us Michael showed up -- unannounced -- in the lobby of Lindsay's apartment building moments ago. When security called Lilo -- who's only back in L.A. for the day -- she told them to send Michael packing.

We're told Michael left without a fuss, but the damage is done -- Lilo is upset Dad showed up on her doorstep.

Someone in Michael's camp claims he was just trying to bring her some Chinese food for dinner.

So much for that warm fuzzy reunion.

Kourtney K -- I'm Not a Lawyer But I'll Play One on TV!

Kourtney Kardashian is becoming a lawyer -- not in real life, because that would require school and studying and reading and stuff -- but TMZ has learned she'll soon portray one on television.

Kourtney announced earlier this week she'll be filming a guest role on the soap "One Life to Live" ... and sources tell us she'll play a sexy attorney who develops a love/hate relationship with a "dark-haired guy" on the show.

We're told the role will also require a bit of physical work -- because on her eps, scheduled to air in March, she's supposed to kiss AND punch one of the dudes. Saucy.

Mel Gibson The 'Communist' Love-Letters

Mel Gibson had a pet name for Oksana Grigorieva -- his "dark eyed beautiful little communist" ... this according to love letters entered into court and obtained by TMZ.

Oksana saved dozens of love notes from Mel throughout their relationship -- chock full of passion, cheesiness, obsession -- and a warning about what could trigger him to become "irrational."

Here are some of the highlights:

Will.i.am -- New MJ Album 'Disrespectful' to Michael

Black Eyed Peas front man Will.i.am wants no part of the new Michael Jackson album -- because he feels the entire thing goes against everything Michael stood for.

Will.i.am tells EW, "Whoever put it out and is profiting off of it, I want to see how cold they are ... He just wasn't any ordinary artist. He was a hands-on person. To me it's disrespectful. There's no honoring."

His biggest issue, it seems, is using unfinished MJ tracks -- something he feels the King of Pop never would have stood for: "Michael Jackson songs are finished when Michael says they’re finished ... Maybe if I never worked with him I wouldn’t have this perspective. He was very particular about how he wanted his vocals, the reverb he used ... he was that hands-on."

It's worth noting ... the album is put out by Sony, through Michael's estate. So Michael's kids are the ones who stand to make money off this.

Oksana Never Told Doctor Mel Injured Lucia

TMZ has learned the pediatrician who examined the child of Mel Gibson and Oksana Grigorieva the day after their explosive blowout never saw any evidence the baby was injured, contrary to Oksana's claim.

We've obtained a declaration from Dr. Linda Nussbaum, who says Oksana brought Lucia in for an examination on January 7, 2010, the day after the January 6 showdown.

According to the declaration, Oksana brought Lucia in to check on a protrusion on Lucia's belly button, but never mentioned an injury to the baby's chin, which she now claims Mel inflicted.

Dr. Nussbaum says, "...I did not see any symptoms of trauma, abuse, bruising, redness or injury on her face, head or elsewhere on her body."

Oksana is alleging Mel struck and injured the child during the argument, but Dr. Nussbaum says, "Ms. Grigorieva did not state to me that Lucia had suffered any trauma, abuse or injury of any kind."

We're told Mel's side believes a photo Oksana is using in the custody case -- showing a mark on the baby's chin -- was doctored.
