Jake Gyllenhaal has more important things to do today than Reese Witherspoon -- he's a prospective juror in a misdemeanor battery case in an L.A. courtroom.
Jake is in there right now.
This morning Jake was sitting in a corner in the jury assembly room with his head down, wearing a solid dark ball cap, a blue jacket and a backpack ... not realizing he's way too famous to go incognito.
So far, he hasn't been picked. We're there. We'll let you know.
Jake was just told to take his hat off inside the courtroom.
UPDATE: Jake has finally been excused for the day -- but he hasn't been excused from the case.
While inside the courtroom, Jake was allowed to go through voir dire (the juror questioning process) in a private room.
He'll be back today to find out if he's been selected as a juror.

"CSI" Guy: Stupid Me For Boxing a Thief!
He bravely fought off a real life attacker on the NY subway, but "CSI" dude Gerald McCullouch wishes he wussed out, admitting he was "stupid" for fighting off his attacker.
McCullouch -- who plays Bobby Dawson on the show -- used moves he learned from boxing to square off with an 6-foot-3-inch, 240 lb man who tried stealing his laptop. The large criminal responded by trying to stab McCullouch with a 10-inch kitchen knife....the leather jacket McCullouch is wearing saved his life.

Will "Runway" Judge "Resort" to Anything?
Michael Kors will resort to stealing from the dead -- according to a new lawsuit.
TMZ has obtained a Federal lawsuit filed Monday by a famous designer's company, claiming the "Project Runway" judge brazenly ripped off designs for a clothing line.
Here's what's interesting -- the company was owned by acclaimed designer Tony Duquette, who died in 1999. According to the suit, last year Kors unveiled his Resort Collection, which allegedly is a direct rip on Duquette's work. Even worse, the suit claims Kors had the audacity to refer to the Collection publicly as the "Duquette Collection."
The suit seeks all sorts of damages from Kors.
Mayer Tape Recovered -- Unusual Girth Exposed
He's good enough, and he's smart enough ... but did John Mayer carefully check his junky VCR before tossing it out of his NY apt. last week? We're definitely not sayin' that's where this "self-help" video came from, but....
Who knew John was so into daily affirmations? Jen probably did, because Mayer definitely took a shot at her ex-hubby's new movie.
By the way, the video was shot inside Mayer's cool NY digs.

Cancer Survivor Drops Lawsuit Against CBS
The man who filed a lawsuit against CBS claiming he was unjustly fired from the "Dr. Phil" show because of his prostate cancer has just dropped the suit....it appears the case settled.
Martin Barsnack -- who used to work on the "Dr. Phil" show -- claimed in September of '07 he was diagnosed with prostate cancer and told his supervisor he was taking a leave of absence to get treated. Martin claimed when he came back in April of '08 -- there was no job available for him.
The suit was dismissed on Jan. 22. A notice of settlement has been filed, but the terms are not disclosed.

"Million Dollar" D-Bag's Alleged Jade Heist
Josh Flagg -- the death profiteer from "Million Dollar Listing" -- could get away with allegedly ... you guessed it ... profiting off another dead person.
The estate of Marcia Israel -- who created Judy's clothing stores -- is suing Flagg for allegedly obtaining a bunch of extremely expensive paintings and Jade sculptures that were supposed to be reserved for the Marcia Israel Foundation.
Flagg allegedly got hold of the goods after they mysteriously disappeared from Israel's L.A. mansion -- when Israel's husband temporarily was staying there in 2004 after her death, according to the docs.
A private investigator claims to have snapped photos of the missing goods through the window of Flagg's home.
Here's the kicker: Flagg's lawyers claim Israel's estate has no case against him now because the statute of limitations has run out.
Flagg is being sued for damages for the alleged "wrongful taking of personal property."

PR Chick Shagged By Golden Globe Red Carpet
Turns out heinous dresses are not the only thing women have to worry about on red carpets.
A lady who runs a PR company has filed suit against everyone under the sun because she bit it on the red carpet at the Golden Globes.
Monica Matulich, who runs a PR company, claims there was a missing section of the carpet, which was covered by a "fabric flooring which appeared to be suitable for walking but was defective, unsuitable and dangerous."
Matulich says she fell on the missing red carpet area and badly hurt herself.
In the lawsuit filed in L.A. County Superior Court, she's suing the Beverly Hilton Hotel, AOL Time Warner, Time Inc., In Style Magazine, Tom Ford Design and American Turf and Carpet. Why Tom Ford, you ask. She claims T.F. was hired by In Style to design something in connection with the event. In other words, she's suing everyone.

Travolta Extortion Plot -- Caught on Tape?
TMZ has learned Bahamian police have recordings of conversations in the alleged plot to extort millions from John Travolta.
We've learned Bahamian police are using the recordings in the investigation of Obie Wilchcombe, Pleasant Bridgewater and Tarino Lightbourne. As we first reported, the plotters haggled with Travolta's reps -- initially demanding $25 mil and then reducing their demand to the mid-teens. Some of those conversations were recorded.

Hot Maxim cover girl Monica Hansen is suing a plastic surgeon for using pictures of her to advertise on his website. According to the lawsuit, Hansen claims her doc, Dr. Leonard M. Hochstein, splashed pictures of her all across his website without her permission.
We did a quick check of his site, www.lhochsteinmd.com ... no pictures of Hansen in sight anymore.
Truth be told ... the suit doesn't say if Dr. Hochstein did work on Hansen or whether she had a boob job at all. But here's our guess....

King to Milken: He Madoff With My Money!
Larry King, who lost more than a million bucks in the Bernie Madoff scam, had breakfast this morning with someone who certainly understands the situation: Junk bond felon Michael Milken.
Milken, who was the poster child for Wall Street greed in the 1980's, noshed with King at Nate 'n Al in Bev Hills. Larry did a lot of listening during the meal as Michael spoke almost nonstop.
Milken served 22 months in federal prison for securities fraud in the late 80's.
Demi's Daughter Not a Good Scout
UPDATE: 2:23 PT: We've now confirmed Demi's scofflaw daughter is 17-year-old Scout. Her offense -- illegal U turn.
Demi Moore has just shown up at the Santa Monica Courthouse with one of her daughters.
Demi and one of the girls are in line at Juvenile Traffic Court -- yes, there is such a thing.
Someone in line is cackling, "Hey, there's G.I. Jane!"
In this court, a parent must accompany a minor child.
Demi looks hot with sunglasses on her head. She's wearing a black top and showing some cleavage -- which should help the case.
Fun Fact -- If Demi thought this was a good day to slip into court, she didn't know there's an epic custody case going on there today involving Kelly Rutherford.
UPDATE: Court is now in session and everyone inside -- including Demi -- is being forced to watch a 30-minute video on reckless driving -- which is still better than watching "Striptease."
UPDATE: Demi and her daughter have just left the courthouse and gotten into a Mercedes. We're told they left in the middle of the video. We don't know the dispo of the case.
Erin Brockovich Goes Small Time
The real Erin Brockovich is downscaling. She's gone from saving the environment to battling over rent.
The same woman who helped take down the Pacific Gas and Electric Company was in Bev Hills small claims court yesterday, repping her daughter who was in a raging rent dispute with her roommate.
The roommate must have been intimidated ... she was a no show so Erin scored a default judgment.

Panettiere Pleads No Contest to Battery Charge
Hayden Panettiere's dad, Alan, has pled no contest to misdemeanor battery.
Alan faced a judge in a Bev Hills courtroom on Tuesday, stemming from an altercation he had with his wife back in August.
He received 24 months probation, $400 in fines and must attend 52 weeks of domestic violence counseling.
A protective order against him remains in place.

Birkhead and Stern Reunite -- In Lawsuit
Howard K. Stern and Larry Birkhead have just filed sworn declarations, expressing outrage at various accusations, including suggestions that Stern drugged Anna Nicole Smith.
Stern has sued Mark Speer, a former associate of Birkhead's former lawyer, Debra Opri. Stern claims Speer was funneling false info to Rita Cosby in her so-called tell-all book.
In Stern's declaration, he says Speer told a pack of lies.
- Item: Stern says he was not criminally involved in Daniel Smith's death.
- Item: Stern says he never drugged Anna Nicole
- Item: He says he never told Birkhead, "I will give you your baby, if you leave me as executor of Anna's estate."
Birkhead also filed a declaration in support of Stern, also taking issue with what Speer allegedly told Cosby.
- Item: Birkhead says he never told Bahamian cops Stern stole millions of bucks from Anna Nicole.
- Item: Birkhead denies he was on a "mission" to get Stern investigated for the death of Daniel.
- Item: Birkhead denies he and Stern horse-traded Dannielynn in return for Howard becoming executor.
BTW, in case you're wondering, the fight over J. Howard Marshall and who gets his money is still locked up in the courts, with no end in sight.

EMT Goes Nuts Over Travolta Case
We just spoke with the manager of Emergency Services for the hospital where Jett Travolta died, and she went ballistic over reports that one of her workers took pics of the dying boy and used them to allegedly extort money from John Travolta.
She screamed, "No. We do not have a picture of Jett Travolta. No one took a picture. What are you trying to get people fired?!"
Obviously, a sore subject.
