Bruce Jenner has lawyered up in the wake of Saturday's fatal car crash, in an investigation that will make its way to the L.A. County District Attorney's Office ... TMZ has learned.

Bruce was leaving the West Hollywood law offices of Blair Berk, a top criminal defense lawyer who has repped an untold number of celebs.

We've learned once the L.A. County Sheriff's Dept. finishes its investigation, they will send the case to the L.A. County D.A. for review. A law enforcement source says it's SOP to refer such a case to prosecutors when a driver breaks the law and someone dies.

Law enforcement sources tell TMZ ... they now believe Bruce was not texting and driving. But cops think Bruce was following too closely which is a traffic violation, and such a violation that results in the death of another motorist could theoretically be grounds for misdemeanor vehicular manslaughter.

Bruce Jenner has volunteered all of his cell phone info to the L.A. County Sheriff's Dept. to prove he was not texting at the time of Saturday's fatal car crash.

Law enforcement sources tell TMZ ... Jenner has authorized Sheriff's detectives to get all the necessary data from Jenner's cell phone carrier, thus making a search warrant unnecessary.

We're told Jenner's promise was verbal but the Dept. needs it in writing in order to gain access to the info.

As we reported, an independent photo agency was at the scene immediately before the crash and snapped a pic of Jenner holding a cigarette and not a cell phone.

Bruce Jenner may not be the driver who caused a woman to die on PCH Saturday ... because law enforcement tells TMZ they now believe the Prius that led the pack made a sudden stop, causing the Lexus to crash into it ... BEFORE Bruce hit the Lexus.

As TMZ first reported ... Sheriff's deputies were suspicious of the story the Prius driver told. She said she was stopped at a red light, but she was 300 feet from the light. When cops asked her if there was a line of cars in front of her she was vague. Deputies think she might have been making an illegal U-turn.

So the current scenario is this ... the Prius came to a sudden, possibly illegal stop on the highway. The Lexus hit the Prius and then Bruce slammed on his brakes, swerved right but was unable to stop, slamming into the Lexus. The Lexus then went into oncoming traffic and hit the Hummer, killing the Lexus driver.

It appears there is no criminal liability on Bruce's part. As for civil liability, there is a law that you cannot follow too close and need to prepare for sudden events. But if the Prius stopped without warning ... that driver could be at the very least partly responsible for the accident.

6:00 PM PST -- Jenner released a statement about the crash saying, "My heartfelt and deepest sympathies go out to the family and loved ones, and to all of those who were involved or injured in this terrible accident."

Bruce adds, "It is a devastating tragedy and I cannot pretend to imagine what this family is going through at this time. I am praying for them. I will continue to cooperate in every way possible.”

The shooting in Hollywood that left one person dead Saturday night had no connection to Supperclub ... law enforcement sources tell TMZ.

We're told detectives have determined the victim and the shooter who were fighting before shots rang out just happened to be on the same street as Supperclub.

The club's management also says they checked the surveillance video and neither the shooter nor the victim were ever inside the club Saturday night.

Bruce Jenner will not get in trouble with the law as a result of his deadly car crash ... at least that's the way it appears based on a new photo.

The picture was taken by an independent photo agency just before Bruce slammed into a Lexus Saturday on Pacific Coast Highway in Malibu, sending that driver into oncoming traffic where she was killed after colliding with a Hummer.

It was unclear what, if anything, Bruce was holding in his left hand seconds before the crash. But the new photo shows Bruce clutching a cigarette, not a cell phone. The photo (above) is the first in a sequence shot by the agency, just before the Lexus comes into frame.

TMZ broke the story, the L.A. County Sheriff's Department was getting a search warrant to determine if Bruce was texting at the time of the collision ... but this picture would seem to make that unnecessary.

It's illegal to text while driving and motorists who do can be prosecuted for vehicular manslaughter if someone dies as a result.

The L.A. County Sheriff's Dept. will get a search warrant to determine if Bruce Jenner was texting at the time he slammed into a car, causing the driver to die ... TMZ has learned.

Law enforcement sources tell TMZ, they will get warrants for both Bruce's phone records and the cellphone itself. It's illegal to text while driving in California and if Bruce was texting Saturday when he struck a car on PCH in Malibu, authorities could charge him with vehicular manslaughter.

The photos we posted showing Bruce in the car immediately before impact do not reveal what if anything he's holding. It appears he might be clutching something in his left hand but it's unclear.

Even if he was texting, our sources say proving he was doing it at exactly the moment of the crash could be difficult or even impossible.

Our law enforcement sources also tell us they're positive Bruce tried to avoid the accident. The tires on his trailer produced significant skid marks and at the last minute Bruce veered to the right, causing the Lexus to swing left into oncoming traffic. A Hummer struck the Lexus, killing the Lexus driver.

We're told cops are skeptical about the story of the Prius driver, who was hit from the rear by the Lexus in the chain reaction. The Prius driver says she was stopped at a red light, but she was about 300 feet from the light itself. Cops don't know if there was a long line of cars in front of her or if she stopped before the light to make an illegal U-turn. They tell us her story is "vague."

We're told cops didn't check Bruce's phone at the accident scene. As one law enforcement source put it, "We were more interested in his sobriety." Bruce passed the sobriety test.

Someone was shot to death near a pre-Grammy party Saturday night.

It happened next door to Supperclub in Hollywood, and the joint was filled with rappers, including DJ Paul and based on social media it looks like Snoop Dogg, Schoolboy Q and Wiz Khalifa were also there.

Two guys got into an argument near the club, shots rang out and one person lay mortally wounded in the street. The man was shot in the head and died at the hospital.

Cops tell us it looks like both men involved in the fight were affiliated with gangs. At this point, there's no evidence that the suspect or victim were patrons of Supperclub.

3:45 PM PT Law enforcement sources tell TMZ ... Bruce volunteered to go to the hospital to have his blood drawn for blood alcohol testing. He was taken in a Sheriff's cruiser. We've also learned the woman who was killed in the white car was coming to a stop at a red light when Bruce hit her. We're told law enforcement has already determined Bruce was not speeding.

And we're told there was a 4th car involved in the accident. The woman in the white car hit a Prius in front of her before moving into oncoming traffic.

Bruce Jenner was involved in a horrific car accident on Pacific Coast Highway in Malibu at around noon Saturday, one person is dead, and it looks like Bruce caused the accident ... TMZ has learned.

Law enforcement sources tell us ... there were 4 vehicles involved in the crash. We're told there were 8 people involved and all sustained some sort of injury ... but one person died at the scene.

Eyewitnesses say Bruce rear ended the white car and that car went into oncoming traffic and was struck by the Hummer. You can see the impact in the pics below. The woman driving the white car died.

One law enforcement source said Bruce seems to be ok, but again, we're told the 7 survivors sustained some injuries, ranging from minor to moderate.

Jenner family sources tell TMZ Bruce was being chased by as many as 5 paparazzi at the time of the crash. Bruce told cops he wasn't drinking and passed a field sobriety test.

We're told Bruce had picked up his Polaris UTV after loaning it to a wounded veterans group.

"Modern Family" star Jesse Tyler Ferguson's husband slammed into another driver and killed him after what the victim's family calls an illegal move -- but he WON'T be prosecuted ... TMZ has learned.

Justin Mikita was driving his Audi in L.A. last November when he crossed over a double yellow line into oncoming traffic ... attempting to turn left.

23-year-old Nick Trela was riding his Honda motorcycle in the opposite direction and slammed into Mikita's car as it was turning left. Trela died from his injuries.

The L.A. City Attorney has just decided it will not prosecute Mikita for vehicular manslaughter, because authorities determined Trela was partly to blame because he was speeding.

In addition, sources connected to Mikita's legal team say there are several witnesses who say Mikita made a legal left turn through a break in the double yellow.

Although Mikita won't be prosecuted, he's being sued by Trela's family.

Mikita tells TMZ ... "This is a horrible tragedy. I want to respect the family and the process, so I am not going to discuss any details of the accident or the complaint at this time."

Bobbi Kristina's friend who is now accused of being a drug dealer is lashing out, saying he's being smeared -- that he's a savior, not a pusher.

Max Lomas claims through his lawyer ... he's a witness in the Bobbi Kristina tragedy, not a suspect. As TMZ reported, cops initially believed drugs were involved and family sources tell us police actually found drugs during the second search of her home.

But Lomas' lawyer says authorities have not pointed the finger at his client and he is fully cooperating with the investigation.

Former Power Ranger Ricardo Medina Jr. allegedly stabbed his roommate to death during a fight over Medina's girlfriend -- but it wasn't about sex ... just personal space.

TMZ broke the story ... the "Power Rangers Samurai" star was arrested for allegedly murdering his roommate, Joshua Sutter, with a sword. Medina claims Sutter burst into his bedroom during the brawl ... and that's when he stabbed him in the abdomen.

Law enforcement sources tell us the argument started because Sutter was pissed Medina's girlfriend was hanging out at their place when Medina wasn't home. The verbal spat eventually escalated into a physical fight.

Robin Williams' widow is fighting his 3 children over property the kids say is clearly theirs ... and the dispute is so bad it has ended up in court.

Susan Schneider has filed legal docs complaining someone came into the house days after Robin's death and took some of the actor's belongings. But the kids tell a very different story.

Zak, Zelda and Cody Williams claim Susan is essentially attempting a money grab by ignoring the plain language of his will and trust and trying to redefine it to benefit her.

Sources connected with the kids tell TMZ ... Susan refused to let them in the house after Robin died. We're told before Robin met Susan -- he was very clear in the trust he created ... he left his personal effects, including his Oscar for the movie "Good Will Hunting", movie memorabilia, action figures, graphic novels, theater masks and other items to his 3 children.

Susan -- who was only married to Robin for 3 years -- acknowledges she has no right to items related to his acting career, such as his suspenders from "Mork and Mindy," but she wants other items like the tux from his wedding and other "knickknacks."

Sources connected with the children say Susan can absolutely keep the items she accumulated with Robin while they were married, but they say she has gone way further. For example, they're indignant she is apparently trying to redefine the word "jewelry." We're told the kids are supposed to get all of it, but she's saying "jewelry" does not include his watch collection.

And people who were extremely close to Robin say he would be heartsick that this was not worked out between family ... privately.

Melissa Rivers has just filed a huge lawsuit against the clinic where Joan Rivers' heart stopped beating ... and Melissa's lawyer says the doctors acted like a bunch of groupies and not medical professionals.

The lawsuit -- obtained by TMZ -- claims gross medical malpractice, alleging during the 20 minutes doctors tried to bring Joan back to life, they didn't think to perform a tracheotomy, which facilitates breathing.

Melissa says, "The level of medical mismanagement, incompetency, disrespect and outrageous behavior is shocking and frankly, almost incomprehensible," adding, "Not only did my mother deserve better, every patient deserves better."

In addition to suing the clinic, Melissa has sued Joan's personal doctor, Gwen Korovin. According to the lawsuit, she should not have been permitted in the room where the procedure was being performed, yet she jumped in and announced, "I'll go first."

The suit claims another doctor took cellphone pics of Rivers before the emergency, while she was under sedation, with Korovin in the photos, saying Joan "will like to see these in the recovery area."

According to the lawsuit, Korovin left the room in the middle of the emergency and the allegation is that she left because she knew she wasn't supposed to be there in the first place and "wanted to avoid getting caught." The suit says Korovin simply abandoned Joan.

And get this. According to the suit, in the middle of the emergency, another doctor took issue with a colleague who wanted to scope the affected area, saying, "Renuka, you're such a curious cat. You always want to know what's going on." The suit says the doctor refused to authorize the scope.

Melissa's lawyer spoke to The NY Daily News, which broke the story, and quotes lawyer Jeffrey Bloom who says, "Had doctors acted as physicians for Joan Rivers instead of groupies, Joan Rivers would have been doing 'Fashion Police' last week."

Bravo star Greg Plitt's favorite energy drink will not give you superpowers ... so says the company that makes WheyUP -- the product Plitt was plugging when he was hit by a train.

The pre-workout drink contains protein and caffeine, but Shadow Beverages and Snacks wants to stress what should be obvious -- it would never give anyone the ability to outrun a train.

Even though a bunch of empty WheyUp bottles were found near the tracks ... a company rep tells us Plitt wasn't drinking all of them -- he was crushing most of them with a hammer for the promo shoot.

Plitt was a co-owner of WheyUp, and the rep says he had full creative control when it came to his video shoots.

San Antonio Spurs star Danny Green has been given the green light to rock a special pair of sneakers dedicated to Stuart Scott for TONIGHT'S GAME ... the NBA tells TMZ Sports.

Green had approached custom shoe designer Jake Danklefs and ordered up a special pair to pay tribute to his fellow North Carolina Tar Heel ... and was only waiting tor permission from the league.

Well, we spoke with Tim Frank -- Senior V.P. of Communications for the NBA -- and asked if everything was a go for tonight and here's what Tim said:

"He is ... Danny was asked and given permission to wear them for one game. Unlike some reports you might have read, he was never told 'no.'"

It's a great night for Green -- since the Spurs vs. Bulls game will be nationally broadcast on TNT.

Bravo star and fitness instructor Greg Plitt will live on after death ... we've learned the network will air the episodes he shot shortly before his death.

Plitt -- who was hit by a train Saturday -- shot multiple episodes for "Friends to Lovers," which features 2 friends who attempt to take their relationships to the next level.

Production sources tell TMZ ... the network will air 3 to 4 episodes in which Plitt tests the waters with long-time bud Melanie Marden.

We don't know if they hook up on the show, but everyone involved knows it will be tough for Melanie because she'll have to go solo promoting the show.

We're told the episodes will hit the air in the next few weeks.
