Marlon Wayans Wins Cleveland Lawsuit Judge Says Plaintiff is Fat and Similar

The guy who sued Marlon Wayans for putting his pic on blast and comparing him to "Family Guy" character Cleveland Brown just got thrown out of court ... because the shoe fits.

Pierre Daniel claims Marlon racially harassed him on the set of "Haunted House 2" by posting a side-by-side pic of him with the cartoon character, captioning it, "Tell me this n**** don't look like ... THIS N****!!! Ol Cleveland Brown ass lookin."

The judge felt it was a fair comment, ruling, "The Cleveland Brown character, like [Pierre], obviously black, heavy ... with curly 'Afro' hair were all incorporated humorously into the filming of the scene."

The judge also said Marlon's stock in trade is stereotypes, and it's protected speech ... period.

Although the case against Marlon has been thrown out, Pierre's case against the production company seems to still be moving forward.

Marlon tells TMZ, "I am grateful that the judge upheld our constitutional rights of free speech. It's the first amendment and probably the most important for a comedian. This is also a stride toward protecting public figures from often bogus claims and lawsuits. I am grateful now if you'll excuse me I'm gonna go watch reruns of the Cleveland show."

Eminem Sued Hey Lookin' Boy ... You Jacked Our Song!!

Eminem is NOT a rap God ... according to a MC who claims Marshall Mathers sampled his song "Lookin Boy" without permission -- and now he wants MILLIONS.

Raymond Jones -- a rapper from the group Hotstylz -- is suing Em and his record label for $8 million over the song "Rap God" ... which he says features a 25 second sample mid-track.

If you listen to the songs -- the music in question does sound strangely similar.

Sweet freedom tastes just like a sad egg sandwich -- at least that's what "Real Housewives of New Jersey" star Teresa Giudice wants to remember it was like.

Teresa was snapped at 2 AM Monday, somberly chowing down her last meal as a free woman -- a hot egg sandwich at Elmer's Diner in Danbury, where she'll be spending the next 15 months.

We're told she spent most of her time at the table with her lawyer ... on her phone, saying goodbye to friends.

Pretty sure she perked up when she saw that prison commissary list.

TMZ got its hands on the commissary list from Danbury prison ... it ain't Whole Foods but it's a whole lot better than you'd think. Her food choices include:

-- Hummus and macaroons
-- Albacore tuna
-- Cilantro cubes
-- Louisiana hot sauce
-- Deli meat
-- Oreos
-- Dove bars
-- Wild berry frozen yogurt

And there's plenty she can buy to pass the time, including MP3 players w/ Skullcandy earbuds. She can also buy make-up and cover up those zits with acne cream.

And forget sandpaper to clean yourself ... she can buy Charmin, baby! And for those lingering smells, she can purchase fragrance oils.

The best part ... we're told Teresa can spend more than an entire family -- $320/week -- and get this ... her family can put as much money in her account as they want.

So when she's not stocking up on vitamins and beauty supplies she'll be binge eating Fruity Dyno Bites.

Olivier Martinez Airport Employee was Papping Him Before Alleged Assault

The LAX employee who claims Olivier Martinez assaulted him with a baby car seat was an amateur paparazzi in the crush of photogs.

Take a look at the video. As Olivier, Halle Berry, 6-year-old Nahla, and their 1-year-old Maceo arrive at the terminal, a gaggle of photogs descend and the airport employee is part of the pack.

You see him aim his cellphone at Olivier, just before Martinez pushes him against the wall with the car seat.

The employee went to the hospital and filed a police report.

Teresa Giudice 'Real Housewives' Star Checks Into Prison

"Real Housewives of New Jersey" star Teresa Giudice is ringing in the New Year as an inmate ... after checking herself into prison early Monday morning.

Giudice will be serving her 15-month sentence at the Federal Correctional Institution in Danbury, Connecticut. According to our sources, Giudice showed up at 3:00 AM ... without husband Joe in tow. He was spotted later in the morning driving the couple's kids to school.

Giudice pled guilty in March to bankruptcy fraud and conspiracy to commit mail and wire fraud.

Once Teresa is sprung, Joe will serve a 41-month sentence for fraud. This way while one parent is behind bars, the other can do double duty.

Olivier Martinez Battery Suspect After LAX Melee

Olivier Martinez is the named suspect in a battery investigation after things got out of control at LAX ... TMZ has learned.

We're told Olivier, Halle Berry, 6-year-old Nahla and 1-year-old Maceo arrived at the Tom Bradley International Terminal at 1:45 Sunday afternoon. According to LAX Airport Police, the photogs got too close to the family.

An airport employee was also in the crowd, though it's unclear if he too was trying to snap a pic. Cops say Olivier was holding an empty car seat and allegedly shoved it against the employee, causing him to fall backward.

The employee was treated at the scene and taken to a hospital. We're told he complained of abdominal pain. He's filed a battery report.

We just got video of the incident.

Warren Sapp's Ex-Wife You Still Owe Me $3 Million

Warren Sapp ain't out of his ex-wife's doghouse yet ... at least according to court docs which show the NFL legend has still not paid more than $3 million in back support ... TMZ Sports has learned.

Here's the deal ... Sapp filed for Chapter 7 bankruptcy back in 2012 ... and all of his many, many debts were made public.

One of those debts is owed to Jamiko Sapp ... the mother of two of his children ... who claimed Warren owed $3,104,207.20 in "domestic support obligations."

Well, according to new docs filed Monday in Florida bankruptcy court, Warren has only repaid $8,236.85 ... less than 1% of the debt.

Meanwhile, Sapp is still living pretty high on the hog ... making $100k bets with rappers and test-driving fancy cars.

We reached out to both Warren and Jamiko for comment -- so far, no word back.

Lamb of God fans have no spine ... at least one doesn't thanks to a concert stampede that has now triggered a lawsuit.

William Tarantino says he went to see the metal band in November, 2012 in Connecticut. His seat wasn't great ... actually he didn't have one. William was in the standing-only section.

Bill says all was fine until the crowd went crazy, trampling him and causing traumatic fractures of the cervical spine which required surgical fusion. He says the surgery didn't fully heal him ... he has permanent spinal injuries.

Tarantino wants more than $75,000.

Kevin Dillon Cleared of Gas Station Assault ... Alleged by Teens

Just like Johnny Drama on "Entourage"... Kevin Dillon can now chant, "Victory!" -- after getting cleared in an assault investigation involving a mouthy pack of teenagers.

Sources with direct knowledge of the case tell us the incident happened back in July outside a 76 station in Pacific Palisades ... when Kevin allegedly confronted a group of teenagers he felt was harassing and taunting him -- mostly because he's famous.

Our sources say the kids told cops one of them got into a shoving match with Dillon -- and the teenager fractured his ankle being pushed to the ground.

LAPD detectives investigated and reviewed security cam footage showing the scuffle -- but we're told it was unclear who pushed whom in the video. The City Attorney's office ended up rejecting the case in November ... due to insufficient evidence.

We reached out to Dillon's rep for comment ... so far, no word back.

David Cassidy Wins 'Partridge Family' Lawsuit Over Sony ... C'mon Get Happy!

David Cassidy's three-year battle with Sony over profits from "The Partridge Family" is finally over ... but he ended up getting just a fraction of what he was after.

Cassidy filed the suit back in October 2011, claiming Sony was using his image on "The Partridge Family" merchandise for years while paying him peanuts. He also claimed he was getting screwed on profits from re-runs and spinoffs as well.

But while Cassidy was after millions, an arbitrator recently ruled in his favor ... for just $157,964.84.

Cassidy filed a petition with the court last week to confirm the judgment, but he's asking the court to tack on $57,943.06 for his arbitration fees ... plus another $35,824.82 in interest.

Both sides are due back in court later this month.

Paul Simon already got taken in one of the biggest celebrity money scandals of all-time -- and now it turns out he might actually owe money to the the crook who robbed him blind.

Kenneth Ira Starr was locked up in 2011 for a $35 million Ponzi scheme that fleeced celebs like Liam Neeson, Al Pacino, Warren Beatty and Simon.

Starr went bankrupt in 2011, so now a trustee is going through his books to try to collect any money owed to Starr ... which would help pay off his creditors.

So the trustee filed a lawsuit in New York recently, claiming Starr did some legit work for Simon and there's an unpaid $17,174.49 ... for services rendered.

Simon is being sued for that tab, plus interest and attorney's fees.

Meanwhile, Starr's got 2 more years in prison ... where he's apparently been bottling chutzpah.

It turns out ... JLo legally changed her name to Jennifer Muñiz when she married Marc Anthony (his real name is Marco Muñiz) and she never changed it back. The couple filed for divorce in April 2012, but it didn't become official until June 2014.

And JLo remained Muñiz until December 31, when court docs show her name legally reverted back to Jennifer Lopez.

JMu just doesn't have the same ring to it.

The boyfriend of "Mob Wives" star Natalie Guercio wants to know how a guy with a boxcutter could slash him in a crowded nightclub, and then walk away clean ... and he's ready to sue to get answers.

London Rene tells TMZ he's already talked to his lawyer about taking Output Nightclub to court -- because he has two big problems with the Brooklyn hot spot's security team.

His first issue -- how alleged attacker, Rudy Lopez, got into Output armed with a weapon like a boxcutter. London says his attorney's requested security cam footage for a closer look at what happened when Lopez entered -- but he claims the club doesn't typically frisk guests.

Secondly, Rene says he subdued Lopez after the stabbing, took him to club security guards and asked them to hold him until police arrived. He claims security simply let him go.
