Mel Gibson had multiple weapons that he turned over to the LAPD, after Oksana Grigorieva accused him of domestic violence ... TMZ has learned.

TMZ has obtained an LAPD document called "Receipt for Property Taken Into Custody," dated July 15, 2010. Judge Scott Gordon ordered Mel to surrender his weapons, after Oksana filed for a domestic violence restraining order. The order to surrender is standard operating procedure when domestic violence is alleged.

Here's what Mel surrendered:

-- A blue steel, semi-automatic 9 millimeter Glock handgun

-- A blue steel, semi-automatic 9 millimeter Beretta handgun

-- A blue steel, semi-automatic 12 gauge Benelli shotgun

-- A blue steel, lever action Winchester rifle

-- A magazine for the Glock

-- A magazine for the Beretta

-- A speed loader for the Glock -- which allows someone to load the gun quicker

Oksana claims Mel waived a gun and threatened her life during their January 6 blowout. Mel denied doing any such thing.

Kanye West: HELL NO, I Won't Perform on 'Today'

Kanye West claims there's no way he's going to perform on the "Today" show later this month -- as he was scheduled to do -- strictly because of the way Matt Lauer and Co. handled his interview about George W. Bush.

Just hours ago, Kanye went to his Twitter page and pounded out the following message, "I'm not performing on the Today Show for obvious reasons. I'm so happy the world got to see just a small piece of 'the set up.'"

As we previously reported, Kanye butted heads with "Today" over an interview they aired on Wednesday -- in which Kanye said, "I would tell George Bush, in my moment of frustration that I didn't have the grounds to call him a racist."

As of yesterday, the people at "Today" still expected Kanye to do their show on Black Friday -- but now a rep tells us Kanye's officially out.

Jodeci Singer Arrested -- Toasted at Subway

When you think about Subway restaurants, you probably don't think, "Great place to go when you're super drunk" ... unless you're the ex-leader of the '90s R&B group Jodeci.

TMZ has learned DeVante Swing -- real name Donald DeGrate Jr. -- was arrested at a Subway in Burbank, CA this past weekend. Cops say he was so hammered, he couldn't even walk straight ... and it was all caught on tape.

Law enforcement sources tell us ... police received a call from a concerned citizen around 5:00 PM on Sunday ... after DeVante was sloppily crashing into tables and falling on the floor.

When officers arrived, they arrested the 41-year-old singer for being drunk in public -- and hauled him to a nearby jail.

We're told DeVante was released around 11 PM -- after cops determined he had finally sobered up ... but we're told he won't be charged with a crime.

Oksana Shows Off Little Lucia

Before battling Mel Gibson in court in their custody war Wednesday, Oksana Grigorieva spent some time with their rarely-seen-in-public adorable daughter Lucia.

Oksana wants the judge to yank overnight visits from Mel.

The dynamic duo's next court date is November 22.

Mel Gibson Chokes Up on Stand: I Love Lucia

Mel Gibson choked up on the stand Wednesday as he testified about how much he loves Lucia and his other children ... sources familiar with the testimony tell TMZ.

Mel's voice cracked as he talked about his 1-year-old during his testimony.

Oksana Grigorieva -- who wants Judge Scott Gordon to strip Mel of overnight visits with Lucia -- testified that whenever the baby spent the night at Mel's, she came back "acting funny." We're told Oksana did not get specific as to what "funny" meant.

On cross examination Mel's lawyers did a show-and-tell, playing video of Oksana talking to PEOPLE magazine and other media outlets, asking, "Do you think by talking to the media you are looking out for the best interests of Lucia?" Oksana was also grilled about allegedly talking to TMZ.

Oksana's lawyers were trying to get the judge to invalidate the mediation agreement, but Judge Gordon shut them down, saying that issue wasn't before the court.

As for Martin Garbus, the judge still has not given the out-of-state lawyer permission to represent Oksana in a California courtroom ... all the paperwork was not in order.

The next court date is November 22. Oksana will take the stand for further cross-examination.

Judge Rejects Gag Order in Mel Gibson Case

Mel Gibson's lawyers wanted everyone in the custody war to shut up or else ... but the judge has rejected issuing a gag order ... TMZ has learned.

Sources tell TMZ ... Oksana Grigorieva's lawyers did not want a gag order, partly because other people -- including members of the L.A. County Sheriff's Department -- were talking about the case and impacting Oksana's public profile. In the end, Judge Gordon did not see it fit to issue a gag order.

We're also told both Mel and Oksana testified today about the custody arrangement. Oksana is asking the judge to deny Mel all overnight visits, on grounds Mel's nanny allegedly cares for the baby and she needs full-time parenting ... also she believes Mel is a danger to Lucia. But Mel is sticking by the tried-and-true formula -- he's already successfully raised 7 kids.

We're told the judge did not rule on whether to alter any of the custody/visitation arrangements.

The judge did settle one issue -- that Oksana will get $20,000 a month in child support and can live rent free -- meaning Mel can't deduct rent from the $20k.

Nicole Richie Gets Restraining Order For Harlow

Nicole Richie just got a restraining order against a photographer who she claims has been stalking her child at her preschool ... TMZ has learned.

This photo -- taken by Nicole -- was attached to legal papers filed in support of the restraining order, showing Fabricio Luis Mariotto lurking at Harlow's preschool.

Nicole says in her petition for the restraining order, "[Mariotto] drives erratically around my children and others, yells, screams and attempts to scare us so that he can photograph our reaction. He trespasses on preschool property to photograph the children."

Nicole adds, "He has often left his car in the middle of a busy street just to chase me for a photograph."

Nicole, who did not show up in court but was represented by Tamar Arminak from Mark Geragos' law firm, adds, "His predatory behavior caused and continues to cause severe emotional distress as I fear for the safety of my children."

The temporary restraining order requires Mariotto to stay 100 yards away from Nicole, Harlow, Sparrow and Joel Madden, as well as the preschool.

Katherine Jackson's Ultimate Revenge on Dr. Murray

Katherine Jackson could get some quick payback against Dr. Conrad Murray, with the help of the Texas Medical Board ... TMZ has learned.

Sources tell TMZ ...the Medical Board is itching for a full copy of Michael Jackson's medical records, for the purpose of initiating license suspension/revocation proceedings. But there's a rub ... someone needs to release the records, and the board thinks Katherine has the power to do it.

As we previously reported -- the Texas Medical Board has already prohibited Dr. Murray from administering Propofol or other heavy sedatives while he continues to practice medicine at his Houston clinic. The restriction was triggered by the criminal case in California.

No word from Katherine's camp on whether she'll play ball with the Medical Board. Sources tell us the family has a complete copy of MJ's medical file chronicling the events that led to his death.

A rep for Murray tells us his legal team has "fought any attempt by anyone to strip [Murray] of his license, and will continue to do so for the doctor." They added, "His paramount concern is for his patients, particularly the patients of his Houston clinic who desperately need his care."

On her way into court, Oksana said, "I'm fighting for my daughter and for her safety and that's all I'm doing. There's no money involved. It's all about my daughter."

UPDATE 9:30 AM PT: Oksana's mom -- who was subpoenaed -- was ordered by Judge Scott Gordon to leave the courtroom because she's going to be called as a witness.

And Sorrell Trope, who repped Oksana until recently, just left the courthouse after asking for Mel to pay his firm's attorney's fees. Sources tell us Trope asked for around $200,000.

UPDATE 11:00 AM PT: We know the identities of some of the witnesses who will be testifying today. Mady Shany, Oksana's facialist, is in the hallway, sitting next to Oksana's mom. Also in the hallway -- Jimmy Hoyson, the music engineer who claims he saw the explosive January 6 fight between Mel and Oksana.

Oksana Slaps Former Lawyer with Subpoena

Oksana Grigorieva may be playing with fire, because TMZ has learned her lawyers have fired off a subpoena to her former lawyer, who could blow the lid off the case.

TMZ has obtained the subpoena sent to Eric George, who repped Oksana during her mediation with Mel Gibson back in May. The subpoena requires George to show up for a court hearing on Wednesday.

Up to now, George has been muzzled by the attorney-client privilege, but if Oksana's lawyers plan to ask George about his conversations with Oksana, the privilege would probably be waived.

As TMZ first reported ... Oksana's emails and texts to George and Gibson during the mediation figure prominently in the L.A. County Sheriff's Department extortion investigation.

Sources say George would like very much to testify freely about Oksana and the mediation. We're guessing Mel's lawyers would like that as well.

The Oksana Grigorieva extortion investigation is still weeks away from being completed, because downloading her data has become quite the time-consuming thing.

L.A. County Sheriff's Department spokesperson Steve Whitmore tells TMZ investigators are knee-deep in downloading and reviewing data from Oksana's computer.

Oksana's lawyers tried to block investigators from reviewing most of the data in her computer, but last month the judge said it was all fair game.

We're told one of the major downloads is almost complete, but there's still a lot of other data that must be retrieved and reviewed.

Whitmore says all the witnesses have been interviewed and when the data is reviewed it will be sent on to the L.A. County District Attorney, who will decide whether to prosecute Oksana for extortion. The D.A. will also decide whether to prosecute Mel Gibson for domestic violence.

On an episode of "Oprah" airing today, Katherine explained how everyone at the hospital was reluctant to tell her what happened to her son.

She says Dr. Murray took so long in explaining things ... she had to cut him off, saying, "'Well, what happened? How is he? Did he make it?' And he said, 'No, he's gone.'"

There had been some debate in Michael's family about whether the vocals are really Michael's, but numerous experts say it is 100% definitely, positively MJ. Katherine Jackson's Partner -- My Bad!

Howard Mann, Katherine Jackson's business partner in JacksonSecretVault.com, screwed up royally and he knows it -- and now he's reaching out to all Michael Jackson fans to say he's sorry.

Mann published a Jackson song on his website that was touted as an "unreleased MJ track" that came with the blessing of Katherine. As we previously reported ... it was neither of those things.

Mann knows that now, and in a letter to TMZ, apologizes for his "act of stupidity and random ignorance." Mann says he had no idea the track he thought was called "Opis None" was really just a version of an old track called "Destiny."
