Justin Bieber is not only out of control ... he's hard-core stupid. He knew last week -- before he took off for New Jersey -- his plane would get searched by U.S. Customs yet he and his friends still hotboxed on the private jet.

TMZ has confirmed .... the pilot radioed in the air Justin and his gang were smoking weed on the plane and the flight attendant couldn't get them to stop. The pilot complained the smoke in the cabin was thick. NBC News says the pilot actually had to don a gas mask because it was so bad.

Now here's what's incredible ... TMZ has previously reported Justin is on a Homeland Security watch list because of 2 pending criminal cases.

Multiple sources connected with Bieber tell TMZ ... Justin's people called federal officials before the plane took off and they were informed Justin was on the list. Justin's people told him before he got on the jet that he would be searched in New Jersey and interrogated, yet Bieber STILL smoked up the aircraft.

We're also told Bieber and his buds were abusive to the flight attendant because she ordered them to stop smoking ... in vain.

And to add icing to the cake ... Bieber's father was on the plane.

By the time the plane landed the weed was gone, but drug-sniffing dogs detected trace amounts.

One person who was on the plane 3 hours after it landed says it continued to reek of marijuana.

Rapper French Montana was as nonchalant as could be walking the streets of NYC Tuesday ... laughing off his arrest during Super Bowl weekend.

No one knew he had been busted ... but turns out French was popped early Saturday morning in Times Square because of a 5-year-old warrant for driving on a suspended license.

French was taken to the pokey and bailed out soon thereafter.

When you watch the video, you'll be hard pressed to find a happier defendant.

David Cassidy Charged With DUI

David Cassidy has just been charged with one count of driving under the influence of alcohol ... the L.A. City Attorney's office tells TMZ.

We broke the story ... Cassidy was arrested in L.A. Jan. 10th after cops say he made an illegal right turn. We're told he had alcohol on his breath ... and failed a field sobriety test.

Law enforcement sources tell us he blew a .19 in the field -- more than twice the legal limit -- and refused to submit to more testing back at the police station.

Cassidy has a prior conviction for DUI in FL ... and a DUI arrest in NY. According to the city attorney, that means he'll serve a mandatory 96 hours in jail if convicted this time ... and could face up to a year behind bars.

Kourtney Kardashian's baby daddy has filed a lawsuit against the auto company, alleging the 2012 Mercedes-Benz SLS AMG he bought breaks down so much it's "virtually useless."

Disick says the only people who can admire the car are mechanics in the repair shop -- because that's mostly where it sits. And to add insult to injury ... the sticker price for a new one is $190K. He doesn't say how much he paid.

Disick claims MB has failed to make the car roadworthy after numerous attempts, so he wants his money back, plus expenses, plus anything else he can get for his troubles.

Justin Bieber He'll Be Searched Indefinitely By U.S. Customs

Justin Bieber's days of breezing in and out of the U.S. are over ... because we're told he will continue to be a target of U.S. Customs every time he comes back to the states.

TMZ broke the story ... when Justin flew into a New Jersey airport from Canada last Friday ... U.S. Customs searched his plane and then grilled him for hours, before letting him leave. Law enforcement sources tell us ... Custom's flagged Bieber because he's on a Homeland Security watch list for his 2 ongoing criminal cases.

We're told Bieber is subject to the exact same treatment every time he leaves and then re-enters the U.S. -- a thorough search and then exhaustive questioning.

It's very hard to get off the watch list once you're on it. You can appeal to Homeland Security but the agency has broad discretion. What's more ... if Bieber is found guilty or pleads no contest to any criminal charge, it will be extremely difficult for him to go under the radar again.

As for whether that will cramp his style ... Bieber sources say he just doesn't care. As one person put it, "He's gonna do what he wants to do."

Dog the Bounty Hunter Smashed Up in Hit and Run Accident

6:10 AM PT -- Police say the driver of the white truck was arrested and booked for DUI.

Dog the Bounty Hunter and his wife just got wrecked in a nasty multi-car hit and run accident in Hawaii ... TMZ has learned.

According to witnesses ... Dog and Beth Chapman were in a black GMC Yukon on Highway 1 when they got smashed in the rear by a white Chevy truck -- and ended up in a ditch off the shoulder of the road.

We're told a third vehicle allegedly started the chain reaction accident -- but that driver fled the scene after the truck hit Dog and Beth's SUV.

We're told ambulances are on the way ... as there may be some minor injuries. Dog and Beth seem to be fine at this point.

The other black SUV in the photo was also part of Dog's entourage ... carrying several of his family members ... but it was NOT involved in the wreck.

Dog is still on the scene ... and we're told police put the driver of the white truck in handcuffs. It's unclear at this point why he would be arrested.

Talk about hands-off parenting -- Jada Pinkett Smith didn't just let her 15-year-old son Jaden go skydiving Sunday ... she celebrated it.

Jada tweeted the photo today, showing Jaden leaping out of a plane while strapped to someone's chest ... along with the caption, "Jaden jumping from a plane. Life. Happy Super Bowl Sunday."

FYI, there's no minimum legal age for skydiving, but most parachute centers require jumpers be 18. You can jump at 16 with parental consent, but Jaden's just 15.

Justin Bieber Miami Beach Prosecutors Confident We'll NAIL Him!

The DUI case against Justin Bieber has some big holes -- but law enforcement sources tell us prosecutors will NOT back down and are confident the case is so strong ... Justin will cop a plea.

TMZ broke the story ... although Miami Beach police claimed Justin reeked of booze ... his blood alcohol level was almost imperceptible -- .014.

Sources connected to the case tell us ... prosecutors say the officer who made the observation is a star witness who is one of the most authoritative people in the area on DUI -- and an unimpeachable witness.

There's another hole in the case. Cops claimed Justin was drag racing, yet we've obtained the GPS read on his car and it actually shows in the middle of the so-called drag race he was going 27 MPH -- UNDER the 30 MPH speed limit.

Our sources say they're not buying the GPS read out and they have their own GPS which they believe will show a higher rate of speed.

Bottom line -- sources connected with the case are confident ... this case will NEVER go to trial because Justin was driving under the influence of marijuana and Xanax. They are virtually certain Justin will take a deal.

Justin Bieber FLAGGED By Customs Because of Criminal Charges

We're told Bieber has just been released by Custom's officials ... after 5-hours of heavy grilling.

Justin Bieber was flagged by U.S. Customs officials when he landed in New Jersey this afternoon because he has 2 pending criminal cases ... law enforcement sources tell TMZ.

Bieber is still being grilled by Customs people ... after they searched his plane because they allegedly smelled weed. The search turned up nothing.

We're told -- as a result of the Patriot Act -- Customs officials have broad power to flag people coming in from another country when they have an active criminal case or a conviction. Justin currently has an assault case in Canada and a DUI case in Miami Beach.

Sources say Bieber is being "put through the grinder" right now by Customs folks. As one source said, "Once you're flagged it's a grueling process to get in the country."

It's almost certain Justin will eventually be cleared to leave Teterboro Airport because both alleged offenses are minor.

As we first reported ... Justin flew there for the Super Bowl.

5:45 PM PT We're told Bieber has just been released.

5:03 PM PT -- We were just told Bieber is still being questioned -- and everyone has ordered out for pizza. Cops tell us ... it's gonna be a while.

2:55 PM PT -- TMZ has learned Justin is now being held and questioned by U.S. Customs officials.

12:59 PM PT -- We're told all passengers were released. No drugs were found.

Justin Bieber's private jet touched down outside NYC for the Super Bowl -- and authorities immediately held him for questioning ... because of a strong odor of pot coming from his plane ... TMZ has learned.

We're told ... the plane was stopped after it arrived at Teterboro airport in New Jersey. As we told you ... Justin, his dad and some friends were traveling there for Super Bowl parties.

Sources tell us law enforcement is holding the plane ... because they think there may be marijuana on board. We're told the plane and the passengers are currently being searched ... but so far no pot has been found.

A source close to Bieber tells us, the passengers knew they'd be searched ... since they were flying into the U.S. from Canada.

Justin Bieber GPS Records Show NO DRAG RACING

TMZ has obtained GPS records from the rented Lambo Justin Bieber was driving when he was arrested for DUI ... and there is NO evidence of drag racing.

TMZ broke the story ... Miami Beach cops claimed they noticed Bieber and his buddy Khalil (who drove a red Ferrari) drag racing and that's why they were stopped. Cops claimed they were going between 55 and 60 MPH.

But the GPS on Justin's car records speed when the car accelerates quickly. Take a look at the read-out. At 4:07 AM Justin left the club and zoomed away ... reaching a maximum speed of 44 MPH. Two minutes later the GPS registered at a max speed of 27 MPH.

Here's why the read-out is so significant. Cops claim they noticed the drag race on the 2600 block of Pine Tree Drive. Bieber came to a stop and was then arrested on the 4100 block. The 27 MPH read out is on the 3700 block ... smack in the middle of the supposed drag race. Mind you ... 27 MPH is UNDER the 30 MPH speed limit.

If Justin had been racing ... the GPS would have recorded a higher speed. Yet the maximum speed on Pine Tree was 27 MPH.

Now check this out. The cops say 2 Escalades were stopped on Pine Tree to block traffic so Bieber and his buddy could drag race. We obtained the GPS for one of the Escalades (below) which shows at 2:35 AM the SUV stopped -- and that's when Bieber's dad (who was in the Escalade) went inside the nightclub with his son. They were there for 1.2 hours.

At 4:06 AM the Escalade started rolling and it didn't stop again until Bieber was pulled over. So it never stopped to accommodate a so-called drag race.

This could present huge problems for prosecutors, because if the pretext of stopping Bieber's car proves false, it could derail the case. Which is probably why TMZ's videos of Justin's cars were subpoenaed. Problem is ... the videos don't show drag racing either.

The rented Lambo Justin Bieber was driving before his DUI arrest is now practically a celebrity itself -- in fact, so famous ... it's become a Holy Grail for Bieber fanatics and modeling shoots.

Good example ... here's 24-year-old Miami smokeshow Madison Murray rubbing her ass on the car at a showroom on Tuesday.

Sure, it's a yellow Lambo -- who wouldn't want to pose beside it -- but sources tell us, Justin's car has made such a reputation for itself this month ... local models are practically clawing at each other to get a photo op.

And it's not just models ... a source at Miami's Lou La Vie exotic car rental -- which owns the whip -- tells us, the company's been inundated with calls from crazy Bieber fans too ... asking to rent it just for a day to take photos at the DUI arrest site.

It ain't cheap though ... the car rents for $1,500-$1,700 a day, depending on how many days you rent it for. So far, it's already booked through this weekend.

Justin Bieber FIGHTS Miami Beach Charges Pleads NOT GUILTY

Justin Bieber will FIGHT charges in Miami Beach that he resisted arrest, was driving under the influence and driving with an expired license ... he has pled not guilty.

In Miami Beach, being arrested for a misdemeanor is equivalent to being charged. Justin's arraignment is scheduled for Valentine's Day, but his lawyer, Mark Shapiro, has entered a written not guilty plea.

Bieber will still be arraigned but is not required to be present in court.

Law enforcement sources tell us ... they could still add charges before the arraignment.

TMZ broke the story ... prosecutors are going to have problems because Justin's blood alcohol level was imperceptible -- .014 -- yet they claim he reeked of booze. Cops also say he was drag racing yet the GPS readout shows he was not.

As we reported ... Justin will be charged in Toronto with assaulting a limo driver. And he's also being investigated for egging his neighbor's house, and that could be filed as a felony.

Justin Bieber Miami Beach Cops Subpoena TMZ 'Drag Racing' Video

Miami Beach cops have subpoenaed video TMZ posted which they believe might show Justin Bieber was drag racing, but it seems the cops are barking up the wrong tree.

The subpoena seeks "All videos related to the drag racing incident involving Justin Bieber on January 23, 2014 on Miami Beach, Florida."

Here's the problem. The videos we posted do NOT show a drag race on Pine Tree Street ... as the cops described in their police report.

Furthermore, our videos -- all shot before Justin and Khalil turned onto Pine Tree -- do NOT show them drag racing at any point.

One video (above) shows Justin leaving the club in his rented yellow Lambo, revving the engine and leaving quickly ... but Khalil and his red Ferrari are nowhere in sight.

TMZ broke the story ... the GPS device on the Lambo shows one of the cars clocked at a maximum speed of 52 MPH and the other 47 MPH ... and that was only as they left the club. Both drivers slowed down and in the middle of the alleged drag race they were actually traveling BELOW the speed limit -- 27 MPH.

The other 2 videos show the Lambo at a stand still -- In one he's sitting in the car outside the club as fans come up to speak with him. In the other, Justin's already been pulled over.

We're assuming cops want our video to help justify the traffic stop ... which is interesting.
