The Florida Department of Children and Families is investigating the death of 2-year-old Brayden Tennyson, who was fatally shot by his 4-year-old cousin, TMZ has learned.

A DCF spokesperson tells TMZ … "The Florida Department of Children and Families investigates all child deaths related to allegations of abuse, neglect, or abandonment in close coordination with law enforcement."

As TMZ previously reported, Brayden was shot inside a rental home in Kissimmee after investigators said his 4-year-old cousin got ahold of an unsecured handgun.

Presley Gerber's former girlfriend Lexi Wood is remembering the late model for being "incredibly resilient" and fighting "so hard for his life."

The "Summer House" alum shared a post Tuesday honoring Presley, looking back at the time she spent with the son of Cindy Crawford and Rande Gerber.

Lexi says ... "It's hard to put into words what it means to lose someone who was such a meaningful part of my life for so many years."

She says Presley "fought so hard for his life and he was brave enough to be open about that fight. More than anything, he wanted to use his story to help other people, and he did."

Dead Kennedys guitarist East Bay Ray has been diagnosed with Parkinson's Disease ... the band announced.

The group's manager announced Tuesday, "Ray says he plans to continue performing and touring with Dead Kennedys for as long as his health allows, and expresses his appreciation to everyone for their continued support." 

Ray has been a band member since the group was founded in 1978. The band is currently scheduled to perform several dates starting in October. 

3:25 PM PT -- Adam Wolf, the attorney representing the baby's biological parents, tells TMZ ... "We are grateful that Rumi can continue receiving the treatment he needs to survive, and that he will not be stripped away from his parents, who are ensuring their child receives top-notch medical care."

The statement continued ... "Ms. West’s legal filings across three states, numerous courts of appeals, and now the U.S. Supreme Court have sought to undermine Rumi’s parents’ right to provide him with the care he needs. Those efforts have been rejected by every single court."

Surrogate McKenna West lost her bid to have the Supreme Court review her battle with the biological parents of the child she gave birth to, TMZ has learned. 

On Tuesday, Justice Elena Kagan decided to reject McKenna's plea for the court to review the decision to award custody of the baby to the biological parents, Omar Ahmed and Nausheen Gilkar.

McKenna argued she should have custody since Omar and Nausheen wanted to abort the child due to a birth defect. Omar and Nausheen scoffed at the suggestion that they shouldn't be the ones to take care of the baby.

Dorit Kemsley’s estranged husband, PK Kemsley, is firing back at "The Real Housewives of Beverly Hills" star’s “disheartening and bizarre” claims in court ... TMZ has learned.

TMZ obtained court docs filed by PK in response to Dorit’s request for over $40K in combined monthly child and spousal support payments.

PK said Dorit earns more than him but proposed paying her $581 per month in child support, but didn’t believe either party should pay spousal support.

PK's lawyers claim Dorit "controls when, and whether, the children see their father" and say she has even told him "to schedule time directly with the children, who are 10 and 12 years old."

The final independent autopsy report commissioned by Nolan Wells' family found signs of blunt force trauma to the back of his head and body ... findings Ben Crump believes demand answers.

Crump's legal team released the report Tuesday, shortly after holding a press conference in Atlanta -- and one day after a Mississippi grand jury declined to pursue criminal charges, saying the circumstances of Nolan's death were consistent with drowning.

The autopsy says a 12-by-8-inch area of discoloration on the back of Nolan's head was confirmed to be blood from blunt force trauma. It also identified three additional bruises -- two on his lower back and one near his left shoulder blade -- that were not documented in the preliminary autopsy report.
