Richie Thinks Jail is a Joke
Nicole Richie is laughing about the possibility of going behind bars -- and judging from Paris Hilton's quick release, it's not hard to see why.
The stick-thin sometimes-BFF to Ms. Hilton was on "The Late Show with David Letterman" last night, where she started to chuckle when telling Dave that prison is indeed a likelihood for her. Incarceration -- hilarity!
In between giggles, wrong-way Richie also said she is "keeping her fingers crossed ... but I'm willing to face whatever consequences come my way." Clearly, prison food won't bother her.

Cops: Paris Under House Arrest
Paris Hilton has been fitted for ankle bracelet and reassigned to house arrest, after authorities decided to release Hilton from jail due to medical reasons, this according to Los Angeles County Sheriff's Dept. spokesperson, Steve Whitmore.
Reporters hammered away about Paris' medical condition during a press conference in front of the jail, where she was released early this morning, but Whitmore said that due to confidentiality laws, he could not discuss even the slightest health-related details.
Paris will be under house confinement in her West Hollywood home for 40 days, where she has a 3000-4000 ft. radius of freedom. Her jail cell was 96 square feet. After the 40 days are up, Whitmore says she will have "fulfilled her debt to society."
Whitmore made it clear that Paris was not released early -- she was reassigned. She is technically still in custody.

Richie Pimps 'Simple Life' Sans Paris
Nicole Richie dropped by "The Late Show with David Letterman" today, and the main topic of conversation was inmate #9818783 -- aka Paris Hilton.
TMZ cameras caught Nicole as she made her way through the crowd to tape her appearance. "The Simple Life" star told Dave that she hasn't spoken to Paris since she entered prison, but she did talk to her right before, and said that Paris felt "just like anyone would feel before they were going to go to jail." Fearful of not being able to shop on Melrose?
Dave even brought up Nicole's court problems and the possibility she could be headed to the slammer as well. Nicole took a page from the Paris apology book, telling Dave, "I'm just keeping my fingers crossed, and you know, of course, I'm scared also, but you know, I'm willing to face whatever consequences come my way and I take responsibility for what I've done."

Why Nicole Richie Can Still Drive
TMZ ran a story earlier today saying that officials from the DMV and the D.A. couldn't explain why Nicole Richie didn't have her drivers license automatically suspended, more than six months after she was busted driving the wrong way on a Burbank freeway and charged with DUI. After all, Paris had her license suspended 5 months after she was busted for DUI. Well, after more digging, we've finally gotten to the bottom of the mystery.
Under California law, the DMV must suspend the license of anyone busted for driving with a .08 alcohol level or higher. In Richie's case, alcohol was not a factor. At the time of her arrest, Richie admitted she had taken Vicodin and smoked pot, but there were no traces of alcohol, therefore, an automatic suspension was not an option.
If, however, Richie is convicted, her license will be on the line, especially since this is her second DUI in 4 years.
Officials 'Have No Idea' Why Wrong-Way Richie Can Drive
While Paris Hilton heads off to jail this week, her "Simple Life" cohort Nicole Richie is still cruising the streets with a valid drivers license -- even though she has the same DUI charge under her belt and a record as a repeat offender! But here's the kicker -- no one seems to know why!
Paris was busted September 7, 2006 -- and around 5 months later, she had already lost her driving privileges and was later arrested for violating her probation for driving on the suspended license. Richie was busted for DUI on December 11, 2006 -- and almost 6 months later, she is not only still driving ... but the California DMV hasn't even begun to take action against her.
TMZ spoke with Deputy District Attorney Ed Greene, a prosecutor assigned to Nicole's DUI case, who admitted, "I am a little surprised too." However, Greene pointed out that until Richie is actually convicted of DUI, the decision to revoke or suspend her license is up to the folks at the California DMV. Greene added, "They generally do it quicker than this."
We contacted the California DMV to try and get some answers, and the rep said: "I have no idea why Nicole still has her license."

Tracy Morgan Sought by Police
Funnyman Tracy Morgan wasn't so funny to a female disc jockey -- and now the cops want to have a little chat with the former "SNL"er. The DJ says Morgan grabbed her arms, kissed her and put his head in her lap after he appeared on a Florida radio show.
Witnesses say the "30 Rock" star was "totally out of it" in an early morning appearance today on Big 105.9's "Paul and Young Ron" show. DJ Yuleika DeCastro told police that Morgan walked down the hall to the studio of sister station Mega 94.9 and began fondling her.
Beginning May 25, Tracy must wear an alcohol-sensing ankle bracelet as part of a DUI probation violation case in L.A.

Paris 45 Days in the Clink?
Paris Hilton is in big trouble, if the Los Angeles City Attorney has his way. TMZ has obtained documents filed with the court, in which prosecutors say they want Hilton to spend 45 days in jail.
Paris must appear tomorrow on a probation violation, for allegedly driving on a suspended license. Hilton was already on probation after pleading no contest last January to alcohol-related reckless driving. The DMV had suspended Hilton's license as a result of her DUI bust.
While her license was suspended, Hilton was stopped by the CHP last January 15, and again by the L.A. County Sheriffs on February 27.
The City Attorney will argue that Hilton certainly knew after she was stopped in January that she wasn't allowed to drive, so the second stop was a flagrant violation of law.
The documents suggest Hilton mistakenly relied on her lawyer's assumption that Hilton had a right to drive, but the City Attorney claims in the legal papers that it's a bogus argument.
According to the papers, Hilton also failed to enroll in an alcohol education program within 21 days of the order directing her to do so.
The legal papers ask that "Hilton be ordered to serve 45 days in County Jail." Prosecutors also want her to be ordered "not to consume any alcohol for a continuous period of 90 days." During that 90-day period, prosecutors want her "to be monitored for alcohol consumption ... by use of a Secure Continuous Remote Alcohol Monitoring (SCRAM) device at her expense."
Tracy Morgan was just ordered to wear a SCRAM device.
The City Attorney wants more. Because of her "flagrant" driving violations, they want her license suspended for an additional four months -- and they want her car impounded for 30 days.

Tracy Morgan Ordered to SCRAM, Escapes Jail Time
TMZ has learned that "30 Rock" star Tracy Morgan has copped a plea that will keep him out of jail, but he'll have to wear a high-tech ankle bracelet to make sure he stays off the booze.
Friday afternoon, in a Los Angeles Superior County Court, a judge ordered Morgan, who was not present, to wear a SCRAM (Secure Continuous Remote Alcohol Monitoring) device -- an ankle bracelet worn to test for alcohol vapors that come out of the skin. The tests will go on every 30 minutes for 90 days. If Morgan tests positive for alcohol use he will have to start his 90 days over, and if he fails a second time he'll be forced to spend 30 days in a county jail.
Morgan will also have to complete five days of community service.
NYPD officers busted Morgan after he was spotted driving erratically in November. The bust violated the probation of a previous DUI conviction in Los Angeles.
Morgan is due back in court May 25, when he will be fitted for his new accessory.
Gere to Indian 'Moral Police' Kiss My White A**
Richard Gere isn't bothered that a warrant's out for his arrest in India, and he's accusing a "very small right-wing, very conservative" faction in the country for coming after him for his public kissing of an Indian actress. "They do this kind of thing quite often," Gere told Jon Stewart on last night's "Daily Show." "I don't know that anyone has actually gone to jail ... It goes to a reputable court and they throw it out." Yesterday, an Indian judge issued a warrant for Gere's arrest in Jaipur, saying that he had "transgressed all limits of vulgarity" when he smooched Shilpa Shetty at an AIDS benefit.

The rapper-actress, says a source, was "surprised" to see Penn arrive at the Hollywood division, and when he offered to pay her $30,000 bail, she politely declined. But Penn then got skittish when he noticed that the paparazzi were assembling, though it was too late – TMZ caught him coming out. It's still unclear whether the pair were hanging out earlier in the evening.

With marble floors, a gourmet chef's kitchen, home theater, recording studio, pool, spa, and a tennis/basketball court, it's everything an indicted rapper could ever hope to unload to pay legal bills.
The sale comes on the heels of DoggFather's various legal issues. As TMZ first reported, Snoop was arrested several times in the last year, including pinches in Los Angeles, Orange County and London. Scott Weiland's Wife Arrested for Torching Wardrobe
The wife of Velvet Revolver frontman Scott Weiland was arrested this weekend after cops say she torched the rocker's $10,000 wardrobe in front of the couple's home in Toluca Lake, Ca.
According to police, 31-year-old Mary Weiland was booked for investigation of felony arson vandalism after cops responded to a "female burning clothes" call late Saturday evening.
The couple's two kids were placed in the custody of family friends.
Weiland was booked at a Burbank police station just after midnight Sunday morning and was released after posting $50,000 bail three hours later.
The arrest came only hours after the couple was kicked out of the Graciela Hotel in Burbank following a ferocious argument that left Weiland's room in shambles and blood on the linens, as TMZ exclusively reported. The hotel is pressing charges against the Weilands for the damage they caused.
