Jesse James: My Ex Was Stoned and Drove Our Kid

Published | Updated

Jesse James just filed blistering legal papers against his ex-wife, Janine Lindemulder, claiming she was once drugged out of her mind with their young daughter in the car.

Jesse is fighting Janine's attempt to wrestle custody and visitation from Jesse. Currently he has full custody of 6-year-old Sunny.

On Friday, Jesse filed several declarations with the court ... obtained by TMZ ... one of which was written by Jesse's sister, Julie James England. Julie claims two years ago -- when Sunny was 4 -- she got a call from Janine, "slurring her words, telling me she's letting my niece, Sunny drive." Julie says Janine told her she had taken "some numbing drugs her neighbors gave her from Mexico and she drank tequila" and that she and Sunny were "going to get munchies."

Julie claims she sent a friend to Janine's house, who found Janine "passed out in her car in the garage with Sunny."

And there's a lot more. Sgt. Mark T. England, Jesse's brother-in-law and a medic in the Army, wrote his own declaration, claiming Janine once asked if he could score her narcotics, including Soma, Vicodin, Lunesta and Ambien.

England says he's seen Janine perform at a strip club in the past and do lines of cocaine before getting on stage.

Jesse claims he can provide Sunny with a stable environment -- and even though Janine says she's cleaned up her act, Jesse believes she poses a high risk to their daughter.

A custody hearing is set for June 17.

Heidi Montag Files for Legal Separation

Published | Updated

TMZ has learned Heidi Montag just showed up at the Santa Monica Courthouse and officially filed for legal separation from Spencer Pratt. She lists irreconcilable differences as the reason for separation.

Heidi did not file divorce papers. The legal significance of legal separation is that her earnings will become her separate property from the date of separation. Heidi lists the date of separation as today, June 8.

Interesting ... under the section, "community assets and debts," Heidi wrote, "No such assets or debts." It's unclear if Heidi and Spencer have a prenup which keeps their assets separate, or if they're broke.

Heidi tried filing in Malibu -- of course -- but the Malibu courts don't do divorces.

Heidi filed the legal docs in her own handwriting. There's no evidence she has a lawyer.

Dwyane Wade's Wife's 9th Lawyer: I Quit Too

Published | Updated

NBA Superstar Dwyane Wade's estranged wife Siohvaughn was just dumped by her ninth divorce lawyer ... who ironically cited "irreconcilable differences" as the reason for their professional breakup.

TMZ has learned an emergency motion was filed yesterday in Cook County, IL by Siohvaughn's attorney, Marsha Fisher -- requesting she be withdrawn as Siohvaughn's representation in her ongoing divorce battle with the Miami Heat star.

That means Marsha is the NINTH lawyer Siohvaughn has parted ways with in the case.

And just for fun, here's the list of her former attorneys in chronological order (you're welcome): Dorene Marcus, Burton Hochberg, Michael Berger, David Stein, John Rokacz, Rosaire Nottage, Andrew Leinoff, and Michael Bruck.

All except one withdrew from representing her, one was only used for an appeal which was subsequently denied.

No word on if Matlock will be available when the trial resumes in June.

Jesse James' Ex -- I Want My Daughter Back

Published | Updated

Jesse James' porn star ex-wife has decided she wants to regain custody of their 6-year-old daughter -- but she can't afford to pay the legal costs to get the little girl back.

The woman making the claim is Janine Lindemulder -- who lost custody of her daughter Sunny James to Jesse while she was serving a 6-month prison stint in 2009 for tax evasion.

Lindemulder is now a free woman and claims she's ready to get 50-50 custody back -- but she's too broke to pay a lawyer to handle the case. So, she's filed documents in Orange County, CA asking a judge to make Jesse spot her a cool $5,000 for legal fees.

But according to the docs, Janine doesn't think Jesse's gonna play ball -- and expects him to fight her request for 50-50 custody.

Hasselhoff and Bach divorced in 2006.

Jesse James at Lawyer Happy Hour

Published | Updated

Jesse James made a quick trip to Austin, TX yesterday and one of his destinations -- a law office, but it wasn't for anything divorce-related -- it was for Happy Hour.

James stopped by the law firm of Schwake Zielinski, L.L.P. -- where they just happened to be smack in the middle of Thirsty Thursdays.

Attorney Brad Zielinski told TMZ he was shocked when Jesse arrived, and his only connection to the firm is that Jesse bought a truck from one of Brad's friends.

The subject matter -- trucks. Jesse didn't drink, stayed a short time and left.

TMZ broke the story that Sandra Bullock filed divorce papers in Austin last month ... using initials instead of full names to keep the papers under the radar.

Elin's Lawyers Accused of Leaks in Tiger Divorce

Published | Updated

Things have already gotten nasty in the Tiger Woods divorce. TMZ has learned Tiger's lawyers have accused Elin Nordegren's legal team of leaking like a sieve to the media.

Elin's lawyer, Walter H. White, Jr., who practices in London, sent an email to his staff on April 19, 2010 -- an email obtained by TMZ. White warns his people, "Recently we have been accused by the other side of leaking information to the press. While we do not believe that anyone in the firm has been responsible for the leaks, we are aware that this is the second time that we have been so accused ... "

White urges his staff to "avoid conversations relating to firm activities in public ..."

After we called White on Wednesday and told him we had information he was repping Elin, he sent a staff email saying, "TMZ the web news service has discovered that we in London represent Elin Nordegren ... "

The email notes that Elin's sister, Josefin, works at the firm and then boasts, "To some extent it is a surprise and a tribute to the office and the firm that it has taken them so long to figure this out."

As we reported yesterday, White was already repping Elin in January -- a month and a half after Tiger's car crash.
