Lindsay Lohan Can Drink ... For a Price

TMZ has done some digging, and it turns out Lindsay Lohan is effectively free to drink as she pleases, provided she's willing to pay $10,000 for a vodka on the rocks.

The man who posted Lindsay's bail yesterday -- David Perez -- tells TMZ Lindsay didn't really forfeit her $100,000 bail. The judge just applied the $100,000 to the new, enhanced bail, adding another $100,000 on, thus forcing Lindsay to pay an additional 10% premium to Perez. So Lindsay has really lost nothing, other than having to pay a total of $20,000 to the bail bondsman.

If the SCRAM people tell the judge Lindsay is drinking again, the judge will go through the same drill. Judge Revel can't revoke bail altogether and throw Lindsay in jail ... because the case involves only a misdemeanor. As long as Lindsay keeps paying the increased premium, she'll be free.

Bottom line ... if Lindsay wants to keep drinking, it will probably cost her $10,000 a pop.

One more twist. Even though Lindsay is insisting she wasn't drinking Sunday night, it won't do her any good to get Shawn Chapman Holley to challenge it. Even if Holley can convince the judge the SCRAM reading was bogus, all the judge would do is cancel the $200,000 bail and go back to the $100,000 bail. So Lindsay would get $10,000 back, but it would probably cost $25 grand in legal and expert fees.

Jesse James: My Ex Was Stoned and Drove Our Kid

Jesse James just filed blistering legal papers against his ex-wife, Janine Lindemulder, claiming she was once drugged out of her mind with their young daughter in the car.

Jesse is fighting Janine's attempt to wrestle custody and visitation from Jesse. Currently he has full custody of 6-year-old Sunny.

On Friday, Jesse filed several declarations with the court ... obtained by TMZ ... one of which was written by Jesse's sister, Julie James England. Julie claims two years ago -- when Sunny was 4 -- she got a call from Janine, "slurring her words, telling me she's letting my niece, Sunny drive." Julie says Janine told her she had taken "some numbing drugs her neighbors gave her from Mexico and she drank tequila" and that she and Sunny were "going to get munchies."

Julie claims she sent a friend to Janine's house, who found Janine "passed out in her car in the garage with Sunny."

And there's a lot more. Sgt. Mark T. England, Jesse's brother-in-law and a medic in the Army, wrote his own declaration, claiming Janine once asked if he could score her narcotics, including Soma, Vicodin, Lunesta and Ambien.

England says he's seen Janine perform at a strip club in the past and do lines of cocaine before getting on stage.

Jesse claims he can provide Sunny with a stable environment -- and even though Janine says she's cleaned up her act, Jesse believes she poses a high risk to their daughter.

A custody hearing is set for June 17.

The Next 'Jersey Shore' -- Rednecks Wanted

The masterminds behind "Jersey Shore" are looking for a new stereotype for a new reality show -- keg tappin', mud ridin', Skynyrd lovin', God fearin', honky tonkin' Southern folk.

TMZ has learned Doron Ofir Casting is looking for "12 lucky guys and gals who are keepin' it country and want to party their asses off" to star in a new reality show called "Party Down South."

According to DOC, there will be a casting RV that'll slow ride through Florida, Alabama, Mississippi, Louisiana, Arkansas, Tennesse, Kentucky and West Virginia -- and hopefully land a crop of rednecks wild enough to make "Jersey Shore" look like "Hey Dude."

Lindsay Lohan -- Bench Warrant Recalled

The bench warrant for Lindsay Lohan's arrest has been recalled ... a little more than an hour after it was issued, thanks to the fast work of bail bondsman David Perez.

Perez's peeps just posted $20,000 (the standard 10% of bail) in Judge Marsha Revel's court. The judge recalled the warrant, which means she is able to remain free, though she has a tough road ahead.

If Lindsay violates the terms of the SCRAM program again, it's likely the judge will throw her in jail pending the July 6 hearing on the alleged probation violation for DUI.

In short, one more false move ... and she's probably going to the slammer.

Charlie Sheen May Be Screwed in Plea Deal

Law enforcement sources tell TMZ ... the Pitkin County Sheriff will not go along with the plea deal that was supposed to be approved yesterday -- and Charlie Sheen's lawyer says it just ain't right.

TMZ broke the story ... the plea deal went south yesterday because Beverly Campbell, the Jail Administrative Officer, was adamantly opposed to giving Charlie work release. Campbell felt Charlie was only eligible for "Useful Public Service" -- UPS. Under UPS, Charlie would not be allowed to smoke or eat outside the jail, and his hours of freedom would be more limited than work release.

Sheriff Bob Braudis refused yesterday to order his underling to approve work release for Charlie, even though multiple sources tell TMZ Braudis had already given thumbs up to a signed plea deal between the prosecutor and Charlie -- a plea deal that specifically approves work release.

Now we're told, the Sheriff is backing Beverly ... leaving it all up to her. And we're told Beverly is firm ... no one gets work release under these circumstances.

Charlie's lawyer, Yale Galanter, tells TMZ, "People should always honor their agreement, no matter what the circumstances."

Lindsay Lohan -- Possible SCRAM Violation

Lindsay Lohan's SCRAM bracelet generated an alcohol report that is being sent to the judge in her DUI probation case ... and it could mean big trouble for LiLo.

We're told the SCRAM people got the report sometime between Sunday night and Monday morning -- after Lindsay attended the MTV Movie Awards.

There are reports a SCRAM alarm went off ... not true. We spoke with SCRAM officials who tell us there is no alarm, no light that goes off. SCRAM gets notified by a data download.

As for what triggered the download, we're told it could be a positive alcohol reading or a cut strap. SCRAM would also receive a download if Lindsay didn't get home at a prescribed time ... when she needs to be near the base station.

Whatever the reason, we're told the SCRAM report is going to the judge.

Heidi Montag Files for Legal Separation

TMZ has learned Heidi Montag just showed up at the Santa Monica Courthouse and officially filed for legal separation from Spencer Pratt. She lists irreconcilable differences as the reason for separation.

Heidi did not file divorce papers. The legal significance of legal separation is that her earnings will become her separate property from the date of separation. Heidi lists the date of separation as today, June 8.

Interesting ... under the section, "community assets and debts," Heidi wrote, "No such assets or debts." It's unclear if Heidi and Spencer have a prenup which keeps their assets separate, or if they're broke.

Heidi tried filing in Malibu -- of course -- but the Malibu courts don't do divorces.

Heidi filed the legal docs in her own handwriting. There's no evidence she has a lawyer.

Why Charlie Sheen's Plea Deal Went South

Sources tell TMZ ... a woman who works in the Pitkin County Jail derailed Charlie Sheen's plea deal today, because she refused to honor the agreement -- even though her own boss signed off on it.

We're told the Pitkin County Sheriff signed off on the deal, as did the undersheriff, the lead prosecutor and Pitkin County District Attorney Marty Beeson. But the woman who supervises the work release program at the jail threw the monkey wrench before court today, saying she wasn't going to honor the deal because she had problems with the way it was structured. In short, she would not let Charlie do what all of the parties agreed he could do to complete his 30-day sentence.

We're told the woman made it clear ... she didn't care if her boss made a commitment -- she would not enforce it. We're told the Sheriff would not force the woman to honor the agreement.

At that point, attorney Yale Galanter, who brokered the deal for Sheen, pulled the plug.

Charlie is in Aspen tonight but we're told he will not be going back to court tomorrow.

If the parties work it out, a new court date is set for July 12.

Charlie Sheen Plea Deal Derailed

Something happened on the way to the courthouse ... because Charlie Sheen's plea deal didn't go down today.

Prosecutor Arnold Mordkin said in court, "We need more time than is available for us to complete some of the finer points [of the plea deal]."

After the hearing, Mordkin said, "It hit a snag." He was not specific.

Charlie's lawyers seemed stunned when the plea deal didn't happen.

Charlie and company will return to Aspen on July 12.

Hospital Knew Gary Coleman's Ex Took Pics

Officials at the hospital where Gary Coleman died tell TMZ they were "aware" that Shannon Price and her family were "inside taking pictures" around the time Coleman passed away.

A rep from Utah Valley Regional Medical Center tells us, "We were aware that Shannon and her family were inside taking pictures ... we made notes that the family was taking pictures."

Shannon's rep -- who had previously doubted the existence of the photos -- now tells us, "Shannon and her family did take pictures but they were never meant to get out."

As we first reported, Shannon is set to get a cut of the action -- but her rep is still adamant that Shannon "is in no way getting compensated for these pictures."

Paula Deen -- Our Maid Robbed Us Blind

Food Network chef Paula Deen says her maid cleaned her out of more than $10,000 in jewelry and other expensive stuff before she fired her and had her arrested.

According to a police report filed by Paula's husband, Michael Groover, and obtained by TMZ, Mary Alice White stole jewelry and other precious metals during a fairly long period of time -- August, 2009 to May, 2010.

Groover claims the maid did not have a sex bias ... she stole men's and women's jewelry -- allegedly.

Groover told cops when he found some of the missing jewelry in White's possession, he and Paula fired her immediately. Funny the way that happens ...

White was arrested on May 5 and arraigned on charges of felony theft.

Gary Coleman Hospital Pics -- Sold

Just as we predicted, the pictures of Gary Coleman's final moments among the living have been sold to a tabloid -- but the photo taken after Gary died was not part of the deal ... sources tell TMZ.

Sources say three of the four photos -- which Gary's ex-wife Shannon Price orchestrated -- may hit stands as early as this week.

One of the photos that sold -- Shannon posing next to a bedridden Gary who is riddled with tubes.

As we first reported, Shannon will get a cut of the profits.

Oprah Ticks Off Homeless Guys in Chef Case

The homeless guys who exposed an alleged murder-for-hire plot involving a Food Network chef are pissed off at Oprah Winfrey -- claiming they deserve to be on her show ... not Juan-Carlos Cruz.

As we previously reported, Oprah has already reached out to Cruz in an attempt to land an interview from jail -- but she hasn't reached out to the homeless men who alerted cops about his alleged plan to have his wife killed ... and they're bitter.

According to Homeless Shane (pictured above) -- he and his band of "Homeless Heroes" feel snubbed that O would "rather interview some lame chef instead of three homeless guys that helped save someone's life."

So far, Cruz has not responded to Oprah's request for an interview. The homeless guys tell us they're still more than willing to fill in.

Possible Plea Deal in Murder-for-Hire Case

TMZ has learned ...Juan-Carlos Cruz could cop a plea in his attempted murder case as early as June 23.

We've learned ... last week a Santa Monica detective approached the three homeless men whom Cruz allegedly tried to hire to kill his wife. We're told the detective expressed his displeasure that the men had spoken with TMZ about the case. One of the men tells TMZ ... the detective said, "You can't talk about the case until the plea bargain happens on June 23."

Turns out ... Cruz' case is indeed in back in court June 23, and as we first reported the prosecutor and Cruz' lawyer, Shawn Chapman Holley, are already in plea bargain negotiations.

TMZ broke the story ... cops and prosecutors believe Cruz' story ... that his wife, Jennifer Campbell, had been suicidal for years over the fact that they could not have kids, but she could not take her life because of her religious beliefs. Cruz told cops ... killing his wife was supposed to be an act of mercy, which would be followed by Cruz taking his own life.

Law enforcement sources tell us the D.A. does not believe the case should go to trial. We're told the likely resolution is a no contest plea to solicitation to commit murder, which carries a 3 - 9 year sentence. If Cruz gets 3 years, he could be out in half that time.

Neither the prosecutor nor defense would comment on a possible plea deal on June 23.

Sandra Bullock Makes Surprise Appearance

Sandra Bullock made her first public appearance since the Jesse James cheating scandal broke, accepting an award at last night's Guys Choice Awards in Los Angeles.

Sandy won the "Troops Choice" Award for Entertainer of The Year ... which was voted on by members of the military.

Showing she had a sense of humor (and looking pretty hot), she joked to the crowd, "Did I win this for being Entertainer of the Year or did I win this because of the spectacular IED explosion that became my personal life? It's okay because I would do it over and over and over again if it was to entertain our troops."

Heidi and Spencer -- Suspicious Living Arrangement

Before Heidi and Spencer announced their big breakup -- there was a secret plan in the works that could prove the whole split is a giant sham ... possibly for a new reality show.

It all has to do with the $5.5 million Malibu pad where Heidi and her friend Jen Bunney claimed they moved in to so Heidi could get away from Spencer.

But TMZ has learned the lease for the place was signed two days before Heidi's rep confirmed the split -- and neither Heidi nor Jen were named on the lease ... neither is Spencer. We're also told the lease is only three months long with an option to re-new for six months or a year.

So we have to ask the question ... did somebody KNOW the breakup was coming? Why would somebody else sign the lease unless they had something to gain ...somebody like a reality show producer?

Something's fishy here ... so we gotta ask ...
