Terrence Howard's taking an "L" in his longstanding spousal support war with his ex-wife ... who just won in appeals court.

According to court docs, Michelle Ghent Howard got a ruling on their spousal support overturned. Two years ago, Terrence convinced the court he'd been forced to sign their marital settlement under duress. He claimed she was threatening to go public with naked photos and videos.

At the time, he'd been paying her $5,800 per month.

Michelle appealed that ruling and the judges agreed with her argument -- that Terrence was NOT under duress because too much time had passed between the threat and Terrence signing the agreement. The court said it was more like Terrence had "buyer's remorse" -- and he had other options besides signing on the dotted lines.

For instance, the court said he could have gone to the police if he felt Michelle was blackmailing him.

Anthony Weiner is soaking up his last days of daddy duty before his nearly 2-year prison sentence begins ... and his estranged wife, Huma Abedin, is even hanging with him.

Nothing warm and fuzzy about it -- just co-parenting -- but Huma and Weiner did come together to walk their son, Jordan, to school Monday morning in Manhattan. It's the first time they've all been seen together since he was sentenced to 21 months in prison for sexting a minor.

Huma filed for divorce from the disgraced Congressman in May after he pled guilty, but looks like they're at least burying the hatchet for the kid's sake.

The man who claims he was attacked by Oakland Raiders cornerback Sean Smith suffered so much damage to his face, he required major reconstructive surgery, including a metal plate.

Sources connected to the case tell TMZ Sports ... the victim was diagnosed with 5 facial fractures following the July 4 attack, in which officials say Smith punched and stomped on him in the streets of Pasadena.

Smith has plead not guilty to felony assault charges -- but we're told the victim is adamant Smith was his attacker.

We're told the victim had been dating Smith's sister for 2 years -- and have known each other for 6 years.

As for rumors that Smith was retaliating against the victim for an alleged violent attack on his sister, one source tells us that's "absolutely not true" -- there have never been allegations of domestic violence involving the victim and his GF.

We're told the victim is extremely traumatized by the attack -- and has withdrawn from school where he was working on his master's degree in social work.

O.J. Simpson was no more a free man hours after being released from prison than he was in the pen ... according to the Juice himself.

Paps caught O.J. at a gas station Sunday just 5 hours after he walked out of Nevada's Lovelock Correctional Center ... and the ex-con explained why he still feels trapped.

Surprisingly, he doesn't seem to be super pissed about the paparazzi hounding him. If anything, he's more irritated by the fact he's been locked in a car for the first moments of his newfound freedom.

Oh, and in case you're wondering what's the latest with O.J. ... apparently nada. He says nothing's changed with him after 9 years behind bars -- we're just not sure if that's a good thing or not.

5:40 PM PT -- Pat and Marina were both released from jail and were issued temporary restraining orders to stay away from each other.

5:20 PM PT -- Kelly's attorney Alex Spiro tells us, "Pat denies all wrongdoing and will answer the charges in court."

1:55 PM PT -- Law enforcement sources tell us Pat told cops he was sleeping in his hotel room early Sunday morning when his girlfriend entered with a key he'd given her. That's when they got in the argument, at which point he says she punched him in the face, causing him to react by grabbing her by the arm and pushing her.

Former New York Yankee Pat Kelly and his girlfriend were busted in NYC over the weekend for assault ... TMZ has learned.

Law enforcement sources tell us Pat was arrested Sunday at the London Hotel in midtown along with his girlfriend, Marina Cernova.

We're told they engaged in a verbal dispute, and she punched him in the face. She told cops he grabbed her right arm and pushed her, which she says caused pain and bruising. She called cops around 2:40 AM to report Pat had beaten her.

Cops arrested and booked both of them for misdemeanor assault ... we're told they're still in jail.

O.J. Simpson walked out of prison with a couple boxes of his most prized jail possessions -- all because he was afraid of eBay's wrath ... TMZ has learned.

Law enforcement sources at Nevada's Lovelock Correctional Center -- where O.J. was released early Sunday morning -- tell us he took a handful of his prison belongings with him because he thought fellow inmates and even prison staff would possibly try to sell it on eBay for quick cash if he left it behind.

The prison suggested he take his crap, and he agreed.

We're told O.J. was alerted to his release on short notice, and only had enough time to gather a few of his things before he had to scram. He walked out with boxes that included a hot plate, legal paperwork, a couple pairs of shoes, some clothing and a pillow.

Sources also say his surprise Sunday release was pre-planned, as prison officials felt this would be the quietest way to get him out without a media frenzy.

He walked out the door at 12:08 AM.

O.J. Simpson tried something new on for size early Sunday morning ... freedom.

Simpson signed his exit papers and was then released from Nevada's Lovelock Correctional Center just after midnight ... minutes after he was eligible to be paroled. The release was stealth, because prison officials wanted to avoid a media crush.

As he walked out, he was told by prison staff, "Don't come back" ... it's a standard issue farewell. The 70-year-old convict replied, "I don't intend to."

A driver was waiting to whisk Simpson away. For now he'll be staying somewhere in Nevada ... he wants to live in Florida but the paperwork hasn't been processed. Florida Attorney General Pam Bondi is trying to block the move.

Cher is going after a biopharmaceutical company, claiming officials there screwed her by luring her to sell her stock while it was on the cusp of a medical breakthrough that made the company's value soar.

Cher says she bought 300,000 shares of Altor in 2013 ... but 2 years later a company official spoke to her directly and offered to buy her shares back. However, according to the docs, he withheld key info about successful clinical trials of the drugs they were working on for cancer and HIV research.

The singer claims essentially what the guy didn't tell her was that they had made an incredible breakthrough in both cancer and HIV treatments.

Cher sold the stock and soon after ... the price went through the ceiling.

She's suing for unspecified damages.

Tori Spelling and Benihana put out the fire in their legal battle ... and all signs point to the restaurant chain paying her some cash.

According to new docs ... Tori and Benihana reached a settlement in her lawsuit, in which she alleged she slipped and fell on one of their hibachi grills at the Encino, CA location and suffered deep second and third-degree burn injuries.

Spelling sued in 2015 for medical expenses and pain and suffering, and even if she didn't get her pound of flesh, she at least got an 8-ounce steak from the chain.

Hopefully the settlement included some gift certificates ... that place is delicious.

Jim Carrey has fired back at the mother of his former girlfriend who committed suicide, saying the girlfriend tried to extort him by falsely accusing him of giving her herpes.

Jim is in a battle royale lawsuit over the death of Cathriona White, who killed herself in 2015, shortly after Jim broke up with her.

White's widower and her mom are suing Carrey, claiming he was responsible for her death. They allege in their lawsuit she was distraught over getting herpes, allegedly from Jim.

Carrey says White did indeed text him back in 2013 that she had bumps on her vagina, but he says she actually got those bumps from a wax job. He goes on to say White, with her lawyer, falsely tried to shake Jim down for several million dollars, claiming he gave her an STD.

Jim says the reality ... White had herpes before they even met. As for the wax job, Jim says White and her lawyer used the bumps she got as trumped up evidence of what they said was herpes and tried to pin it on him.

O.J. Simpson will not be allowed to live in Florida after he's released on parole next week ... if the Attorney General of the State has her way.

A.G. Pam Bondi has sent a letter to the Florida Dept. of Corrections, objecting to O.J.'s apparent intention to relocate to Florida.

Bondi cites numerous reasons:

-- A lack of contrition for his crimes

-- A massive civil judgment in the Nicole Brown Simpson/Ron Goldman wrongful death case that Simpson has avoided paying

-- He was convicted of spousal battery against Nicole Brown Simpson

-- His reputation for destructive behavior, including road rage, breaking into a girlfriend's home, an arrest for speeding in his powerboat in a manatee zone and civil theft of television signals.

Bondi also says Simpson moving to Florida would create a burden on law enforcement because of his notoriety.

She's asking the Department to turn thumbs down if Simpson makes a request to live in the Sunshine State.

The Las Vegas Metro Police Dept. says the body cam footage absolutely justifies why police took down Michael Bennett at gunpoint during a search for an active shooter ... saying it was NOT about race.

Bennett had claimed he was racially profiled in the early hours of August 27 -- when cops detained him outside the Cromwell hotel following the Mayweather vs. McGregor fight.

The footage shows a 3-man police team -- made up of 2 hispanic officers and 1 black officer -- identify Bennett as a suspicious person who did not get down on the ground as ordered during the hotel sweep.

Video shows Bennett crouching and running in the casino before bolting out of a hotel door, jumping over a gate and running to the street.

One of the officers quickly asks if the man running had a gun and then gives chase.

Once Bennett was detained, cops determined Bennett was not a shooter. They asked for ID. He said, "Michael Bennett. Seattle Seahawks. Look it up."

Cops took his advice and looked him up on their cell phones.

Cops say the body cam 100% proves the incident had nothing to do with race.

As for Bennett, he told officers he was scared and was only thinking about getting home to his 3 young daughters.

Oakland Raiders cornerback Sean Smith has been ordered to stay at least 100 yards away from the man he allegedly beat up on July 4, this according to court docs obtained by TMZ Sports.

Smith appeared in court today where he pled not guilty to felony assault charges.

During the hearing, Smith's attorney agreed to the terms of the protective order -- requiring Smith to stay 100 yards away from the victim. He's also banned from contacting the victim in any way.

Smith is also not allowed to own or possess a gun.

The terms of the protective order go into effect today.

As we previously reported, the victim was dating Smith's sister at the time of the alleged assault.

Blac Chyna's going to be marching with her friend, Amber Rose, at her annual SlutWalk ... and it's a direct shot at her ex, Rob Kardashian.

Sources close to Chyna tell TMZ ... she's joining the march to speak out against revenge porn and talk about what she's gone through since Rob plastered her nude pics all over social media in July.

We're told she'll have her lawyers -- Lisa Bloom and Walter Mosley -- by her side, and they're planning to speak to the SlutWalk marchers to educate them on how to handle being victims of revenge porn.

Atlanta Hawks star Dennis Schroder shoved another man outside of a hookah bar in Georgia early Friday morning -- triggering a group beatdown that was all caught on video ... TMZ Sports has learned.

We've obtained the police report which shows the 24-year-old NBA star was hanging out with a group of friends around 2AM at a restaurant called 6AM, which is connected to a hookah bar.

Cops say they were called in response to a fight and when they arrived Schroder and his crew were trying to leave.

Cops found surveillance video which show Schroder and his friends in a "verbal heated exchange" with another man. But things escalated when Schroder threw the first shove -- triggering his friends to basically jump the guy.

"[The victim] was struck by hands and feet by the offenders."

Eventually, security broke up the fight. The victim was transported to the hospital with what appeared to be non-life threatening injuries.

Schroder and his 3 friends were all arrested for battery.

The surveillance video was collected and submitted as evidence. Guessing the Hawks are gonna wanna see that.

O.J. Simpson is just days from becoming a free man after nearly a decade behind bars, but he may not get out early Monday morning because of the media.

Officials for the Nevada Dept. of Corrections tell TMZ, if the release point -- 30 miles outside of Vegas -- is swarmed by media, O.J. will not be set free. As one prison official put it, "We don't want another Princess Diana situation" ... the fear being a chase that could result in injury or death.

The concern is not just Simpson. Prison officials say they're worried innocent bystanders might be mowed down in a chase.

Prison officials say they've been notified media from all over the world will be at the release point and they believe European media is even more aggressive than American paparazzi and think the line will almost certainly be crossed.
