More fingerpointing in the death of "That '70s Show" star Lisa Robin Kelly ... 'cause after Kelly's boyfriend blamed her estranged husband for causing the actress to relapse ... the husband tells TMZ the fault lies with the BF.

We spoke with Kelly's estranged husband Robert Gilliam ... who tells us the only reason LRK's boyfriend trashed him to the media after she died Thursday is because "he's trying to cover his own ass."

"In the last two weeks, she called me 22 times to get away from him," Gilliam says.

Gilliam says he offered to help Lisa -- who struggled with alcohol abuse for years -- but under one condition ... she had to check in to a rehab center closer to Northe Carolina, where they lived when they were together.

Gilliam says Lisa agreed -- so he started setting things up ... but she passed away before she could make the move.

Kourtney Kardashian's DNA test doesn't prove jack ... so says the male model who insists he's the REAL father of her 3-year-old son Mason, not Scott Disick.

Michael Girgenti tells TMZ, he saw the DNA test results TMZ posted on Thursday, which Kourtney got from an independent lab, showing that Scott is Mason's dad -- but Girgenti insists those results could easily have been forged.

As a result, Girgenti is refusing to back off his paternity lawsuit, in which he claims he knocked up Kourtney in 2009 after meeting her at a photo shoot ... and Mason is the result.

Girgenti tells us he won't be satisfied until a court-monitored DNA test is conducted.

Kourtney Kardashian is putting the rumors to rest that she conceived 3-year-old Mason after cheating with a male model, releasing DNA test results Thursday that show Scott Disick is really the father.

TMZ broke the story ... a male model named Michael Girgenti is suing Kourt for paternity over Mason, saying he had sex with her in '09 and 9 months later she popped out a kid.

KK immediately denied the allegations as a grab for fame -- but now she's got hard proof ... a lab doc that says the probability that Scott is the dad is 99.99% ... meaning the male model is 99.99% full of it.

Khloe Kardashian and Lamar Odom are NOT getting a divorce and have never even discussed it ... this according to multiple TMZ sources AND Kris Jenner.

Women have come forward recently and claimed they hooked up with Lamar. Several media outlets are even saying divorce docs are being filed as early as today. But our sources say it's just not true.

Jenner tells us, "Khloe and Lamar are absolutely not getting divorced. There's been no talk of divorce." Jenner also says both Khloe and Lamar were at her house 2 days ago and everything was fine.

Other sources confirm with TMZ ... Khloe has not even spoken with a divorce lawyer.

Our sources say they will only comment on what they know ... so they're not calling the women who have come forward liars. But they are very clear -- Khloe and Lamar are very much together and there is NO divorce.

With rumors of a Michael Phelps comeback, there's one American who thinks MP should STAY OUT of the pool when the 2016 Olympics roll around -- Bruce Jenner.

Phelps announced he "retired" from swimming after dominating at the 2012 games ... but lately, there have been rumblings that he's considering re-shaving his body hair for a dramatic Olympic comeback.

But not everyone's fired up about the idea ... especially Jenner, who knows a little something about what it takes to compete at the Olympic level -- 'cause before he played second fiddle to the Kardashians, he won gold in the decathlon in 1976.

"He's done," Jenner told us in Calabasas yesterday ... "Quit while you're ahead."

For the record, Phelps is only 28 ... and still in incredible shape.

Here comes the bride ... to-be ... at least, that's the way it seemed when Hayden Panettiere arrived to LAX yesterday with a HUGE DIAMOND on her finger.

Rumors have been swirling that the "Nashville" star finally said "Yes" to her massive heavyweight boyfriend Wladimir Klitschko ... but that bling on her hand pretty much put the rumors to bed.

So ... CONGRATS!!!!

Hayden was in a great mood on her way out of the airport yesterday (as usual) -- and there was only one topic to discuss ... weddings! Though it's unclear if she was referencing her own.

Oprah Winfrey says she's kinda sorta "sorry" for the fallout that ensued after she told the media about a "racist" encounter at a purse store in Switzerland ... saying, "I'm really sorry that it got blown up."

Yeah, right.

Oprah addressed the media at the premiere of "The Butler" in L.A. last night -- backpedaling after the shop in question started to refute O's allegations of racism during an incident last month.

The shop owner says the whole thing was a "misunderstanding" and had "nothing to do with racism."

Last night, Oprah said ... "I think that incident in Switzerland was just an incident in Switzerland. I'm really sorry that it got blown up. I purposefully did not mention the name of the store. I'm sorry that I said it was Switzerland."

Problem is ... O's full of it. What did she think was going to happen when she went on national TV and cried racism? The media was just going to ignore that??

Oprah once ragged on hamburgers and single-handedly CRIPPLED the beef industry. She knew damn well how the media was going to handle the Switzerland situation ... which is why she went to the media in the first place. Her mission was to destroy the shop.

There are some people who are saying Oprah's Swiss encounter wasn't really about race -- Oprah was just mad she wasn't treated like Her Royal O-ness because the shop employee didn't recognize her ... but now, after the employee told the media she's being unfairly attacked, O's feeling a little guilty.

But pretending not to know about the impact of her race allegations?? That's like Obama pretending not to know what's gonna happen if he pushes that big red button in the White House.

C'mon O ... you're smarter than that. And so are we.

Famed ex-Scientologist Leah Remini was photographed on Friday, looking alive and well after she turned her back on the Church.

You'll recall, Remini left Scientology recently, then turned around and slapped the Church in the face by filing a missing persons report regarding the bizarre disappearance of Shelly Miscavige, the wife of Scientology leader David Miscavige. The Church was not happy.

It's been a few days since the pic was taken, but as far as we know, she is still breathing.

If you ask the ShamWow guy, she might want to lay low for a while, maybe find herself a safe house, or a relative close by.

You don't attack the Church of Scientology and get away with it ... not by a long shot -- so says one famous ex-Scientologist Vince Offer (the ShamWow Guy), who tells TMZ, Leah Remini is lucky she's still alive.

Offer was out in L.A last night -- and it's clear he's still concerned about L. Ron Hubbard's followers after his highly-publicized split from the Church ten years ago ... because he was VERY hesitant to talk about Remini's situation.

You'll recall, the "King of Queens" actress recently left the Church, then filed a missing persons report regarding Shelly Miscavige, the wife of Scientology leader David Miscavige. The Church was PISSED.

Offer called Remini's move "brave," but said he couldn't say much more because he values his life ... and he wasn't kidding. You have to see how scared this guy is.

7:54 AM PT -- Kourtney's attorney, Todd Wilson, tells TMZ ..."This individual has been selling false and fabricated stories to the tabloids for years about Kourtney Kardashian and her son, Mason. Scott Disick is Mason’s father."

Wilson continues, "We have not seen the reported court filing, but we are informed that this individual has been seeking to get paid to publish his ridiculous pleading. His claims are absurd and this is simply another shameful attempt to gain publicity and profit from fictional stories about my client."

A male model who claims he had unprotected sex with Kourtney Kardashian in 2009 claims 3-year-old Mason is HIS son and he's now filed a paternity lawsuit asking for joint custody ... TMZ has learned.

Michael Girgenti claims in legal docs -- filed Thursday and obtained by TMZ -- he met Kourtney during a photo shoot in August, 2008 (above). Girgenti says they connected and began a texting relationship for 3 months.

Girgenti says in legal doc things heated up by March, 2009, when Kourtney allegedly told him she and then BF Scott Disick were "on the outs" and "she wanted to hang."

Girgenti's suit then describes an alleged sexual encounter in Glendale, where he says they had "unprotected vaginal sex." He adds, "I ejaculated inside [Kourtney's] vagina."

Girgenti says 9 months later Kourtney gave birth to Mason. He says he immediately saw a striking resemblance and tried contacting her, to no avail, so he began a media blitz to get her attention.

Girgenti's docs, filed in L.A. County Superior Court, request joint custody of Mason. He also wants the judge to order DNA tests for Kourtney, Scott, Mason and him. The judge set a hearing for next month.

We also know Girgenti received a letter from Kourtney's lawyer, Shawn Holley, saying his allegations are "false and defamatory."

You'll never EVER see Matt Damon's name on an election ballot ... 'cause the actor tells TMZ he has NO desire to run for political office.

Damon is a super political guy -- he's been heavily involved with the Democratic party for a while (though he's been railing pretty hard against President Obama for the past year).

The Church of Scientology is spewing venom at Leah Remini for daring to file a report with the LAPD ... claiming the wife of Scientology leader David Miscavige is missing.

A Church rep claims Leah cooked up the allegation "with unemployed, anti-religious zealots."

Leah -- who broke ties with Scientology last month -- was alarmed that Shelly Miscavige hasn't been seen publicly in 6 years. The LAPD closed out its investigation last night, and as TMZ first reported, cops say they had a face to face with Shelly. They did not indicate if they probed as to whether Shelly was being held against her will.

The Church rep calls Leah's actions "an inexcusable distraction for the LAPD."

And the Church took this shot: "Sadly, rather than move on with her life and career, Ms. Remini has aligned herself with a handful of untrustworthy, lunatic tabloid sources who obsessively harass the Church to advance their selfish agendas."

Someone is pissed.

Simon Cowell's relationship with Lauren Silverman was going on right under Andrew Silverman's nose, and he at the very least "kinda knew" what was going on ... this according to friends of the couple.

Multiple sources tell TMZ ... Lauren would spend hours on the phone at her home talking to Simon, and Andrew heard the whole thing. Several of their friends tell us they believe Andrew knew that Simon was banging his wife, and they think the outrage he's expressing now is a giant crock.

Several sources close to Andrew shade the story slightly differently. They say Andrew is telling them looking back there were plenty of "warning signs" but he just didn't pick up on them. They also acknowledge Andrew knew that Simon and Lauren were "flirting," but he didn't think that necessarily meant they were banging.

As for settling the divorce ... we're told they're still at an impasse, but continue to talk.

Kim Kardashian's ex-stepmom Ellen Kardashian has just sued Kris Jenner and the Kardashian sisters for defamation, claiming the K-fam is on a mission to make her look like a bitter gold digger -- when they're the ones who should be ashamed of themselves.

Ellen filed the suit against Kris, Kim, Khloe, Kourtney, Rob, and even Ryan Seacrest Productions -- insisting the girls and "Keeping Up with the Kardashians" producers attempted to ensnare her in a recent plot line on the show, involving a private investigator attempting to hawk damaging information about the Kardashians.

According to the lawsuit, the investigator attempted to sell the information to Ellen -- in order to make her look like some kind of black mailing scumbag -- but Ellen refused to take the bait.

Ellen says the Kardashians trashed her on the show anyway, making up lies about her to fit their anti-Ellen agenda, such as accusing Ellen of marrying Kim's dad Robert Kardashian for his money -- and Ellen's lawsuit gets downright nasty.

Ellen -- who was married to Robert Kardashian before he died -- calls Kris Jenner a "manipulative and devious mother and ex-wife who simply used and exploited her children." She also calls the family's careers meaningless.

FYI, the feud between Ellen and the Kardashians has been raging for years ... it's nothing new.

Ellen is suing for unspecified damages. Calls to the Kardashians weren't returned.

Legendary Spanish radio host Eddie "Piolin" Sotelo isn't pulling any punches after a former employee accused him of sexual harassment -- telling us the man behind the allegations hasn't been right in the head for a long time.

As we reported, Alberto "Beto" Cortez -- a former writer, producer and performer on the Piolin por la Manana show -- accused Piolin of physically, sexually and emotionally harassing him for 3 years ... but Piolin gave TMZ a statement, insisting it's BS ... and Beto's emotionally erratic history backs him up.

Piolin says he stood by Beto for more than a decade "through all of Beto's personal travails," but Beto went off his rocker in 2012 ... and Piolin could no longer protect him. Piolin says Univision decided not to renew Beto's contract as a result ... and now, Beto's out for revenge.

TMZ has obtained an email sent from Beto to Univision higher-ups -- sent in 2012 -- in which he admits that his life has gone off the rails and he's trying to get better. He was let go shortly afterward. Piolin claims the email proves Beto was nuts before these allegations surfaced.

Piolin is currently off the air as a result of Beto's allegations, but tells us, "I plan to be back on the radio very soon."
