Charlamagne tha God and Rolling Stone have settled their beef in a charitable way ... teaming up to make a donation after the magazine printed a headline falsely accusing him of making transphobic comments.

We're told the money will go to the National Black Justice Coalition. The exact amount is unknown but we're told it's in the thousands.

The 'Breakfast Club' host had fired off a legal letter to RS demanding an apology and retraction after they picked up his July interview with comedian, Lil Duval. Duval had made headlines by alluding that he'd kill a transgender woman if he discovered he'd unknowingly slept with one. RS then ran a headline saying Charlamagne made transphobic comments, which Charlamagne called defamatory since he never made such remarks. Rolling Stone later changed the headline.

NBA star Zach Randolph has been formally charged with 2 misdemeanors for that August 9 weed arrest in L.A. ... TMZ Sports has learned.

We broke the story ... the Sacramento Kings star was arrested in Nickerson Gardens in Watts earlier this month ... which was followed by a crazy, violent standoff between cops and locals.

Randolph was initially arrested for felony possession of marijuana with intent to sell, a charge based on the large quantity of weed cops say he had at the time.

But now, prosecutors have reduced the charges down to misdemeanor possession of more than 1 ounce of marijuana and misdemeanor resisting arrest.

If convicted on both counts, Randolph faces up to 1 year in jail -- but since it's his first arrest, he likely won't spend another minute behind bars.

Overall, it's good news for Randolph who didn't seem too concerned when TMZ Sports spotted him leaving jail hours after the arrest.

The Game hired a burger joint to cater his shindig, but went radio silent when it came time to pay the piper ... so says the owner suing the rapper, but Game says the owner's lying her ass off.

The owner of Big D's Burgers sued Game claiming the joint is out $8,500 for unpaid catering services for a Fourth of July party.

A rep for Big D's tells us Game hired the restaurant on 2 separate occasions and each time Game paid cash. The rep says Game requested food for up to 250 partygoers. But the rep says about 450 people showed up, forcing Big D's to make a food run.

What's more ... the rep says he was told to also grab booze and cleaning supplies, which wasn't part of the deal but agreed to buy and bring back anyway. When it came time to pay Big D's, the rep says Game promised to wire the money the next day ... but the dough never came.

DMX says he's opting to check outta house arrest and into rehab -- taking full advantage of a judge's decision ... TMZ has learned.

X says, "House arrest wasn't working for me, so I made the decision to do something positive and better for myself." Our DMX sources tell us he's getting treatment for substance abuse at a facility in New England.

We broke the story, a judge approved DMX breaking his house arrest for tax evasion ... specifically to enter a rehab program. He can even go without wearing a GPS ankle monitor.

X's manager, Pat Gallo, tells us the rapper's already been working with recovery coach Joseph Griffin, and has made "great progress." He recently took a community outreach trip to a firehouse with his rehab group.

Flavor Flav's still fighting the powers that be, even when those powers include fellow founding Public Enemy member Chuck D ... according to a new suit that rocks the legendary group.

In docs, obtained by TMZ, Flav says he and Chuck have a long-standing agreement to share profits from their music, live concerts and merchandise -- but he hasn't seen a royalty check in several years. Flav says he co-wrote more than 50 of the group's songs, and he's especially pissed because Chuck's still getting paid.

What's worse ... the rapper claims his voice and image were used without his consent on the new PE album, "Nothing Is Quick in the Desert" ... released in June. Flav says he requested $75k for the record, but only got $7,500. He thought he was going to get the remainder later, but it never came.

Flav's also going after producer Gary G-Wiz for making a deal to create action figures of Public Enemy without his knowledge. In the suit, Flav says Gary got cash from the toy company, but he got zilch.

Flavor Flav's suing Chuck, Gary and several other PE managers and producers for lost profits and to stop using his mug to make a buck. We reached out to Chuck, but no word back.

Richard Simmons will appeal the devastating ruling on his transgender defamation lawsuit, TMZ has learned, and that could establish whether people are allowed to say someone's gay or transgender without fear of lawsuit.

Simmons' lawyer, Neville Johnson, tells TMZ, if the ruling becomes final he will absolutely challenge by filing an appeal. As we reported, Simmons filed a defamation lawsuit against American Media for a National Enquirer story claiming the fitness guru was transitioning to a woman ... which he says is a lie.

The judge in the case just gave a tentative ruling, saying misidentifying someone as transgender does not inherently expose someone to "hatred, contempt or ridicule," adding "the characteristic may be held in contempt by a portion of the population, [but] the court will not validate those prejudices by legally recognizing them."

Johnson scoffs at the logic, telling TMZ, "Transgenders can't joint the Air Force, they can't go to the bathroom" ... in other words, it's ridiculous to say there is not significant scorn and ridicule in the U.S.

The DEA nixed a happy ending for 5 people busted for pushing candles ... shaped like penises and made outta meth.

The federal agency tells TMZ ... 4 men and 1 woman were arrested last week in New Jersey for trafficking and conspiring to distribute more than1,300 pounds of wax candles laced with meth. TMZ obtained photos of the haul which show the knickknacks could totally double as dildos.

Agents grabbed 27 boxes in all. We're told the DEA got a whiff of the plan when one of the suspects drove an undercover agent to the warehouse where they planned to store and convert the candles to crystal meth. The DEA, along with the NYPD and Homeland Security, swooped in to make the arrests.

Each suspect faces 10 years to life in prison.

Richard Simmons just suffered a potentially devastating loss in his lawsuit against American Media -- which claimed he was transitioning to a woman -- because the judge just said calling someone transgender is NOT defamatory.

The National Enquirer published a story saying Simmons had undergone hormone treatment and was in the process of sexual reassignment. Richard says it's a lie and sued for defamation.

The judge just said being misidentified as transgender does not inherently expose someone to "hatred, contempt or ridicule... ."

The judge went on to say, "While, as a practical matter, the characteristic may be held in contempt by a portion of the population, the court will not validate those prejudices by legally recognizing them."

9:20 AM PT -- Kanye's attorney, Howard King, tells us the countersuit "is the same generic response Lloyd's files when they don't want to honor a legitimate claim but can't find a factual basis to deny the claim."

Kanye West isn't getting paid for his canceled tour because Lloyd's of London believes his breakdown was his own fault, and fueled by prescription drugs and illegal drugs ... according to a new lawsuit.

Lloyd's filed a countersuit against Kanye's Very Good Touring, and in the docs, says he refused to produce information it needs to determine whether to cover his losses after pulling the plug on the Saint Pablo Tour last year.

Lloyd's doesn't state specifically that Kanye was using drugs and/or booze, but claims something he did triggered the policy exclusions that refer to using substances. You'll recall ... in the original lawsuit, Kanye's touring company claimed Lloyd's was dragging its feet because it believed his breakdown was triggered by marijuana.

Kanye sued the insurer for $10 mil. In its docs, Lloyd's says it wants the judge to rule it's free and clear to NOT pay Kanye a dime.

TMZ Sports has obtained video of Kansas City Royals pitcher Danny Duffy face-to-face with cops while being popped for DUI in a Burger King drive-thru.

It all went down in Overland Park, Kansas around 7:35 PM on Sunday evening. The person shooting the video thought it was crazy that someone could get a sobriety test in the BK parking lot -- she had no idea it was the World Series star.

You can see 6'3" Duffy with the shaved head and the green sweatshirt.

BK employees told KCTV5 that he ordered a combo meal and some burgers -- but passed out behind the wheel before getting to the pickup window. Cops woke him up and he was cited for DUI before being released to a friend.

He never got that combo meal.

Derek Fisher has pled no contest to DUI stemming from a June 5 crash in which he flipped his SUV on the 101 Freeway in Los Angeles.

Fisher previously pled not guilty to 2 misdemeanor counts of DUI -- but struck a plea deal with prosecutors in which he pled no contest to driving with a B.A.C. of .08 and got probation and 100 hours of community service (or 10 full days).

He's also required to install an ignition interlock device in his car -- which will monitor his breath before he can start the vehicle.

There's more ... Fisher must participate in a MADD victim impact panel where he will speak with families of victims in drunk driving accidents. Plus, he's been ordered to complete a 3-month-long alcohol education class.

Miraculously, no one was injured in the crash -- including his passenger/girlfriend, Gloria Govan.

After the incident, Fisher told his fans the situation will NEVER happen again.

Kansas City Royals pitcher Danny Duffy -- the best pitcher on the team -- was busted for DUI in Kansas on Sunday ... at a Burger King.

Here's what we know ... 28-year-old Duffy was pulled over in Overland Park in his 2015 black Escalade around 7:35 PM and the officer suspected he was driving under the influence.

But we're told in Kansas, drunk driving doesn't mean you're automatically locked up. An Overland Park city official tells us suspected DUI offenders can be cited and picked up by a friend ... and that's exactly what happened with Duffy.

The Royals played earlier that day -- and lost -- but Danny didn't play, he was placed on the disabled list on Saturday for an elbow injury.

He's due back in court on Sept. 19.

Duffy is a big deal -- he was part of the World Series team in 2015 and signed a 5-year, $65 million extension this past January.

Justin Bieber went to the ER back in May fearing a soccer injury had caused one of his testicles to twist, and that triggered a nasty legal claim between the hospital and a fired employee.

Justin made an emergency run to Northwell Health in Long Island New York, and a staffer named Kelly Lombardo found out about it. The hospital claims Lombardo illegally accessed Justin's medical file in one of the computers ... this after hearing rumors Justin had been admitted for an STD.

According to the lawsuit, the hospital fired Lombardo for being "an immoral employee" who violated Bieber's privacy rights.

Lombardo has just filed a wrongful termination lawsuit, claiming she never accessed Justin's file and simply heard from others he was there for treatment of an STD.

Sources connected to Justin tell TMZ, he did NOT go to the hospital for an STD. They say he had been playing soccer and suffered a painful injury. Justin "WebMD'd himself" into a tizzy and believed he had testicular torsion, a serious condition caused when a spermatic cord becomes twisted cutting off the flow of blood to the attached testicle. It almost always requires surgery.

We're told the doctor examined Justin and quickly realized all that was wrong was a swollen testicle. A relieved Justin then left the ER and went about his life.

As for Lombardo, she's filed a claim with the New York Division of Human Rights, claiming she was singled out and fired because she's a woman.

New York employment attorney David H. Rosenberg tells TMZ that "my client never accessed Mr. Bieber's medical file and yet she was fired for doing so."

For Justin there's a happy ending.

Katy Perry is in a toe jam, after a woman claims she lost one of hers while working on the singer's tour.

Christina Fish claims in a lawsuit she was hired as a stagehand for Katy's Prismatic World Tour in 2014.

On the night of Katy's Raleigh, NC concert she was asked to help move a wall ... when it got stuck and then rolled across her foot. She says she felt her shoe fill with blood.

She says she was offered ice but no one called for an ambulance, so she had to call a friend to pick her up and take her to the ER.

Christina says her right toe became gangrenous, and eventually needed to be amputated. She says she wasn't able to use her foot for months.

She also says she suffered great emotional distress, because orthopedic doctors instructed her to keep her "dead toe" on as long as possible before the eventual amputation.

Christina says she had a passion for yoga and that's now a distant memory without a toe.

Nipsey Hussle spent the night in jail simply because he left his ride in a disabled parking spot -- well, that and his outstanding warrants ... TMZ has learned.

LAPD busted the rapper around 9 PM Monday when officers spotted his car illegally parked -- Nipsey doesn't have a disabled placard -- and when they ran the plates, discovered he had warrants for previous traffic violations.

Nipsey clearly ain't sweating the arrest. He was back in the studio at 5 AM Tuesday after bailing out on "some bulls**t" ... as he put it.
