Sources close to Oksana tell TMZ she told cops a man named Tony was in the house the night of the alleged assault. She claims Tony is a security guard and driver for Mel.

But here's the rub. We can't find anyone named Tony who worked for Mel at the time.

Nonetheless ... Oksana told investigators she's positive Tony was at Mel's Malibu home that night and she believes he saw at least part of the altercation -- though she's unsure how much he actually witnessed.

We caught up with Puder, along with model Sophie Turner, outside BOA last night where he told us he's been receiving emails from all over the globe -- he even got stopped multiple times inside the restaurant.

Puder wanted to clear one slight misconception: "I don't want to beat up the bullies. What I want to do is I want to basically encourage the bullies and I want to re-train them to think that they don't need to bully people."

He's also inviting anyone who wants to train at his gym to come down to Hollywood Gym, Monday-Thursday 6-8:00 PM.

Sources close to the "Sister Wives" stars tell us the two were married "a few months ago" at a private religious ceremony in Utah.

A close relative of Toni Braxton tells TMZ ... the singer's financial undoing can be traced back to her show in Las Vegas.

The relative tells us Toni took out "show insurance" through Lloyds of London for her act at the Flamingo Las Vegas Hotel and Casino back in 2007.

When Toni was diagnosed with a heart condition -- in the middle of the show's run -- she had to pull the plug, but she was still on the hook to the Hotel for big bucks. Toni expected Lloyds to cover the loss but Lloyds didn't, arguing Toni had a undisclosed, preexisting medical condition, rendering the policy void.

In the end, Toni had to absorb a huge loss, which the relative claims sent her on a downward financial spiral.

TMZ has learned Hulk -- who recently re-injured his back collecting seashells -- had a spinal chord stimulator inserted into his back during a "very, very painful" procedure at a Florida hospital.

A spinal chord stimulator is a device that is inserted below the skin, and uses electric currents to alleviate the effects of chronic pain.

Sources close to Hulk tell TMZ he's "upbeat" about the SCS -- and hopes he'll be allowed to go home soon.

Oksana told the reporter this about Kristian Otto Herzog: "He was somebody that was supportive of me. I didn't know anything about [his record]. I'm withdrawing any communication with him."

TMZ broke the story, Herzog got out of jail several months ago after serving 255 days for impersonating a cop with a loaded gun.

Judge Scott Gordon issued a restraining order against Herzog Monday, prohibiting him from going near Lucia.

Amer Haddadin tells TMZ, he's sick of being jerked around by Octo and her lawyers ... and if they don't settle her gigantic debt by October 9 -- dude says he's going to hold a news conference to tell everyone about how terrible of a resident she has been.

Daniel Horowitz, who arranged the interview, wanted her to do it -- as did Oksana -- but ultimately Horowitz deferred to Kiley.

Judge Scott Gordon issued a restraining order against Oksana's confidante, Kristian Otto Herzog, after Mel Gibson's lawyers claimed he's a danger to Mel's daughter.
